The purpose of repealing Rules 25-30.438, 25-30.4385 is to delete obsolete requirements. The purpose of repealing Rules 25-30.440 and 25-30.443 is to move filing requirements into Rule 25-30.437. The effect of these amendments and repeals would be to delete unnecessary, obsolete, or duplicate rule provisions; clarify and update rule requirements; and improve administrative efficiency.

New Rule 25-30.091 would be adopted to implement the statutory requirements contained in Section 367.072, FS, by establishing a process by which customers may petition for revocation of their water utility’s certificate of authorization to provide water service, and would incorporate by reference instructions for petitioning for revocation of water certificate and a sample petition form. In addition, Rule 25-30.440 would be amended to require that when a Class A or Class B water utility applies for a rate increase, it must provide a copy of all customer complaints that it has received during the past 5 years regarding secondary water quality standards as established by the Department of Environmental Protection. Rule 25-30.443, Minimum Filing Requirements for Class C Water and Wastewater Utilities, which references Rule 25-30.440, would thereby require Class C utilities seeking a rate increase to also provide a copy of all such customer complaints.

Published on: 15078764. Rule 25-30.091 would be adopted to implement section 367.072 FS, which became effective on July 1, 2014. Section 367.072 FS provides that customers may petition the Commission for revocation of their water utility’s certificate of authorization for failing to provide quality of water service and requires such petitions to state with specificity each issue that customers have with the quality of water service, each time the issue was reported to the utility, and how long each issue has existed. Section 367.072 FS further requires such petitions to be signed by at least 65 percent of the customers of the service area covered under the certificate of authorization. Rule 25-30.440 would be amended to implement the requirement in section 367.0812(1)(c) FS that the Commission shall consider complaints filed by customers during the past 5 years regarding the secondary water quality standards as established by the Department of Environmental Protection in determining whether a utility has satisfied its obligation to provide quality of water service.
