Published on: 18487829. The purpose of this rulemaking is to implement new statutory authority to adopt safety procedures for the clearance of residential structures after a fumigation. The effect will be improved structural fumigation safety and regulatory oversight. This rulemaking will: prohibit the performance of fumigations without proper stewardship training of all employees associated with fumigation; require special endorsement for employee identification cards associated with employees performing structural fumigation; and require stewardship training for all persons involved in fumigation activities. This rulemaking also requires fumigation companies to own and maintain two (2) operational fumigant clearance devices and utilize the department’s electronic website to list/register all clearance devices and document their operational status.
