Published on: 14967408. The proposed rule adopts the most recent published version of NFPA 54, National Fuel Gas Code, 2012 Edition, in accordance with §527.06, F.S. In addition, the proposed rule adopts the current edition of the National Fuel Gas Code Handbook, NFPA 54, 2012 Edition. This handbook is utilized by the Department as a guide in interpreting NFPA 54.

Pursuant to s. 527.06(2), F.S., the department is required to adopt rules setting forth the "minimum general standards" that will apply to LP gas activities carried out under Chapter 527, F.S. Section 527.06(3), F.S., deems the published standards of the National Fire Protection Association ("NFPA") to be "in substantial conformity" with the safety standards required to be adopted by s. 527.06(2), F.S. Accordingly, these NFPA standards (and the handbooks that assist in interpreting and applying the standards) are adopted in Rule 5F-11.002, F.A.C.
Rule 5F-11.002, F.A.C., currently adopts the 2006 editions of the National Fuel Gas Code, NFPA 54 and accompanying handbook, both of which were revised in 2012. Rule 5F-11.002, F.A.C., should be amended to adopt these current editions.

That Notice of Rule Development addressed changes to Chapter 5F-11, Florida Administrative Code, which included incorporating NFPA 58, Liquefied Petroleum Gas Code, 2011 Edition and NFPA 54, National Fuel Gas Code, 2006 Edition, and other code-related materials into a new section in Rule 5F-11.004, Florida Administrative Code, allowing all materials pertaining to compliance with Chapter 527, Florida Statutes, and Chapter 5F-11, Florida Administrative Code, to be listed and incorporated in one rule section. Current Rule 5F-11.002, adopts the 2008 version, of NFPA 58, and is in conflict with proposed Rule 5F-11.004, Florida Administrative Code.
The proposed rule development removes all references in Rule 5F-11.002, Florida Administrative Code, to a particular edition of both NFPA 58, Liquefied Petroleum Gas Code, and NFPA 54, National Fuel Gas Code. This language is not necessary in this section. It also removes reference to particular numbered sections in each standard that were not adopted in Florida.
