Published on: 15988042. On April 10, 2015, the Division issued a final order on a petition for waiver from Petitioner, Dania Entertainment Center, LLC, filed March 16, 2015, and noticed in Vol. 41, No. 55, of the Florida Administrative Register – DBPR Case No. 2015011763 (VW 2015-063).
The final order grants Petitioner a waiver of the requirement of Rule 61D-11.007(2), Florida Administrative Code (F.A.C.), that requires written internal controls be filed with a cardroom’s annual operating license application. Specifically, it grants petitioner a waiver of this Rule 61D-11.007(2) requirement, but only for the 2015-16 license year and only until the Division’s pre-opening inspection of Petitioner’s new cardroom facility (presently under construction), at which time Petitioner is required to have filed and received Division approval for its updated/revised internal controls before it may open and operate its new cardroom facility.

Petitioner is a pari-mutuel facility which holds an annual cardroom license to conduct authorized card games in Broward County, Florida, pursuant to Sections 550.0251(12) & 849.086(4), Florida Statutes. For the current annual 2015-16 operating license year (until at least December 2015), Petitioner seeks a waiver of the requirement of Rule 61D-11.007, Florida Administrative Code (F.A.C.), that requires written internal controls be filed with a cardroom’s annual operating license application. Petitioner seeks a r waiver of Rule 61D-11.007’s cardroom internal controls requirement because it closed its Broward cardroom and slots facilities in October 2014 and does not expect to re-open its new facility until at least December 2015. Petitioner’s internal controls have to and will be substantially revised to reflect and conform to the substantial renovations of Petitioner’s cardroom facilities prior to its re-opening, but those revised internal controls can’t be finalized until the plans for Petitioner’s new cardroom facility are themselves finalized, and that itself won’t occur until the re-opening of the facility imminent. In addition, Petitioner presently employs no cardroom staff capable of making the internal control revisions deemed necessary by the Division. Further, Petitioner will not be permitted to re-open its cardroom without the necessary approved internal controls, but to require it to revise its internal controls at this time, when they cannot be finalized and when Petitioner would have to further revise them before re-opening, would impose a substantial hardship.
