On March 5, 2014, the Division issued a final order on an emergency petition for variance from Petitioner, Dania Entertainment Center, LLC, filed February 19, 2014, and advertised in Vol. 40, No. 36, of the Florida Administrative Register – DBPR Case No. 2014007074 (VW 2014-045).
The final order grants Petitioner a variance from Rule 61D-14.051(4)(d), Florida Administrative Code (F.A.C.), that requires segregated access to a slot machine surveillance room for surveillance employees. Specifically, it gives Petitioner until no later than June 27, 2015, to complete facility renovations and provide for a surveillance room with segregated access that complies with Rule 61D-14.051(4)(d), F.A.C.

Petitioner is a pari-mutuel facility which holds a slot machine license to conduct slot machine gaming in Broward County, Florida, pursuant to Chapters 550 and 551, Florida Statutes. Petitioner seeks an 18-month waiver of the requirement of subsection 61D-14.051(4)(d), Florida Administrative Code (F.A.C.), that requires segregated access to a slot machine surveillance room. Pursuant to the floor plan showing Petitioner’s non-segregated surveillance room that the Division approved upon issuance of Petitioner’s initial slot machine operational license in November 2013, Petitioner engaged in substantial renovations of its facility pursuant to that floor plan and is scheduled to open for slot machine gaming on February 20, 2014. Subsequently, by late 2014 or early 2015 Petitioner will complete substantial additional renovations of its facility to accommodate additional slot machines, which additional renovations will include a segregated access surveillance room complying with the rule. Without waiver of the rule requirement, to require Petitioner to immediately relocate its newly constructed surveillance room could cost in excess of $500,000 and delay the opening of Petitioner’s new slot machine gaming facility by up to two months with concomitant loss of substantial income to Petitioner and tax revenue to the state. In all other respects Petitioner complies with the surveillance and security rules, and has implemented additional safeguards to ensure surveillance personnel are able to enter and exit its surveillance room without being identified. This waiver is requested to be effective for 18 months from the date of any Division final order granting it. Any person whose substantial interests may be affected by a waiver on the subject matter of the Petition may file comments within five (5) days of publication of this notice.
