The Final Order was in response to a Petition for Variance and/or Waiver from St. Petersburg Kennel Club, Inc. d/b/a Derby Lane, Petitioner, filed June 28, 2019, and advertised in Volume 45, Issue Number 132 of the Florida Administrative Register.
The Final Order provides a variance to specific greyhound industry employees of the Petitioner regarding the length of occupational licensure and the fees associated with the same due to the elimination of their occupations at pari-mutuel facilities on December 31, 2020 pursuant to Florida Constitutional Amendment No. 13. All requirements for investigation, licensure and enforcement shall be met under the proposed variance without harm or impediment to the ongoing regulation of gaming within the state, as applicants will be subject to the same application process under Rule 61D-5.001, F.A.C., and the heightened scrutiny required by Section 550.105(2), Florida Statutes.
