On December 12, 2007, the Department received from International Paper Company a petition for a waiver from subparagraphs 62-660.300(1)(a)(3) and (4), F.A.C., which restricts public access and recreation on waters under consideration for an experimental use of wetlands for low energy water and wastewater recycling. Notice of receipt of this petition was published in the Florida Administrative Weekly on December 28, 2007. No public comments were received. On July 18, 2008, the Department granted the waiver from 62-660.300(1)(a)(3) and (4), F.A.C., to International Paper Company in a final order, OGC File No.: 07-2621. This rule waiver was granted because International Paper demonstrated that a strict application of the rule would result in undue hardship and because they successfully fulfilled the requirements of the underlying statutes by other means.
