Published on: 20320935. St. Joseph’s Hospital, Inc.; The Notice of Petition for Declaratory Statement published on March 2, 2018, in Vol. 44, No. 43, of the Florida Administrative Register. The petition seeks the Board’s interpretation of Rule 64B3-10.005(10), Florida Administrative Code, entitled, “Scope of Practice Relative to Specialty of Licensure,” seeking clarification regarding the definition of blood gas analysis, as it relates to the performance of certain testing by respiratory therapists during ambulance transport.
The Board of Clinical Laboratory Personnel considered the Petition at a duly noticed public meeting held on March 23, 2018, in Orlando, Florida. The Board=s Order filed on April 12, 2018, stated that the Petitioner previously filed a Petition for Declaratory Statement before the Board of Respiratory Care asking whether the testing described in the petition falls within the scope of respiratory therapists. Because respiratory therapists are exempt from Chapter 483, Part III, Florida Statues, and the Board of Respiratory Care found that the testing falls within the scope of respiratory care practice, the Board declined to answer the petition.
