115STATEMENT OF THE ISSUE
119Whether the Petitioner should receive credit for her
127answers to certain specified questions on the Clinical
135Application of Medical Knowledge portion of the Florida Medical
144Licensure Examination administered November 19 and 20, 1999.
152PRELIMINARY STATEMENT
154Gloria Patricia Jimenez sat for the Florida Medical
162Licensure Examination ("FMLE") on November 19 and 20, 1999. In
174an Examination Grade Report dated January 27, 2000, the
183Department of Health ("Department") advised Ms. Jimenez that she
194had achieved a score of 347 on the Clinical Application of
205Medical Knowledge portion of the examination and had, therefore,
214failed that portion of the examination because she had not
224attained the passing score of 350. Ms. Jimenez timely requested
234an administrative hearing to contest the grading of her answers
244to several questions on the examination. The Department
252transmitted the matter to the Division of Administrative
260Hearings for the assignment of an administrative law judge.
269Pursuant to notice, the final hearing was held by video
279teleconference on August 18, 2000.
284Prior to the hearing, Ms. Jimenez amended her request for
294an administrative hearing, and, in a second amendment filed
303August 11, 2000, she specified that her challenge was limited to
314the grading of her answers to questions 3, 11, 55, 81, 174, and
327183 of Part IIA of the examination and to question 113 of Part
340IIB of the examination. The Department stated at the start of
351the final hearing that it had given credit to Ms. Jimenez for
363her answer to question 174 of Part IIA of the examination and
375that her revised score was 348.
381At the hearing, Ms. Jimenez testified in her own behalf,
391and Petitioner's Exhibits 1 through 6 were offered and received
401into evidence. The Department presented the testimony of Walter
410Chason, a psychometrician employed by the Department, and of
419Anh-Vu Tien Nguyen, an expert in the field of primary care
430medicine. Respondent's Exhibits 1 through 9 and 11 were offered
440and received into evidence. At the Respondent's request,
448official recognition was taken of Section 90.616, Florida
456Statutes (1999); Sections 455.574, .581, and .647, Florida
464Statutes (1999); Sections 458.311, .3115, .31151, .3124, .313,
472and 314, Florida Statutes (1999); Rule Chapters 64B-1, 64B8-5,
48164B8-14, and 64B8-15, Florida Administrative Code; and
488Rules 64B8-4.001, 4.018, and 4.0 27, Florida Administrative Code.
497The one-volume transcript of the proceeding was filed with
506the Division of Administrative Hearings on September 8, 2000,
515and the parties timely filed proposed findings of fact and
525conclusions of law. In her proposed findings of fact and
535conclusions of law, Ms. Jimenez stated that she no longer
545disputed the correctness of the Department's answer to question
55455 of Part IIA of the FMLE. The proposed findings of fact and
567conclusions of law have been considered in preparing this
576Recommended Order.
578FINDINGS OF FACT
581Based on the oral and documentary evidence presented at the
591final hearing and on the entire record of this proceeding, the
602following findings of fact are made:
6081. The Department of Health is the state agency
617responsible for licensing and regulating physicians practicing
624medicine in Florida, including foreign-licensed physicians.
630Sections 458.311 and 458.3115, Florida Statutes (1999);
637Rule 64B8-5.002, Florida Administrative Code.
6422. In order to be issued a restricted license to practice
653medicine in Florida, a foreign-licensed physician must pass the
662FMLE, an examination that is developed by the Department and
672that consists of two parts; Part I tests a candidate's knowledge
683of Basic Science and Disease Processes, and Part II tests a
694candidate's knowledge of Clinical Applications of Medical
701Knowledge.
7023. Ms. Jimenez was accepted as a candidate for the FMLE
713and sat for the examination on November 19 and 20, 1999. At the
726time of the hearing, Ms. Jimenez had attained a sc aled score of
739348 on the Clinical Application of Medical Knowledge portion of
749the FMLE; a scaled score of 350 is required to pass Part II of
763the examination.
7654. The questions that comprise the Clinical Application of
774Medical Knowledge portion of the FMLE are objective, multiple-
783choice questions drawn from a bank of questions written by
793physicians, field-tested, reviewed, and edited. A
799psychometrician employed by the Department oversees the
806development of the examination questions.
8115. The questions for the November 1999 FMLE were drawn
821from the bank of questions in accordance with a test blueprint
832developed by a committee of physicians, and the questions were
842compiled into an examination. A committee of physicians then
851reviewed the examination to determine whether it would
859adequately and reliably test the candidate's ability to practice
868medicine with reasonable care and safety. A psychometrician
876employed by the Department oversaw the process of compiling the
886examination.
8876. The Department sends each candidate registering to take
896the FMLE a Candidate Information Booklet which contains, among
905other things, information about the test, the material to be
915covered on the test, sample questions, and a list of reference
926books that the candidates should consult in preparing for the
936examination.
9377. Ms. Jimenez disputes the Department's determination
944that the answers she gave to questions 3, 11, 81, and 183 of
957Part IIA and to question 113 of Part IIB of the FMLE
969administered November 19 and 20, 1999, were incorrect.
9778. According to the Department, the correct answer to
986question 3 of Part IIA of the examination is "C"; Ms. Jimenez
998chose answer "D." Question 3 is clear and unambiguous, the
1008question contains sufficient information to answer the question
1016correctly, and the question has only one correct answer, which
1026is included among the choices provided. The correct answer can
1036be found in the reference book entitled Harrison's Principles of
1046Internal Medicine , 14th Edition, 1998, which is included in the
1056list of reference books provided to candidates for the
1065examination. In this treatise, medical therapy is identified as
1074the preferred treatment for distal dissection, that is, for a
1084Type B or descending aortic dissection. "C" is, therefore, the
1094correct answer to question 3 of Part IIA of the FMLE, and
1106Ms. Jimenez should not receive credit for her answer because the
1117answer she gave is not the correct answer.
11259. According to the Department, the correct answer to
1134question 11 of Part IIA of the examination is "A"; Ms. Jime nez
1147chose answer "D." Question 11 is clear and unambiguous, the
1157question contains sufficient information to answer the question
1165correctly, and the question has only one correct answer, which
1175is included among the choices provided. The correct answer can
1185be found in the reference book entitled Harrison's Principles of
1195Internal Medicine , 14th Edition, 1998, which is included in the
1205list of reference books provided to candidates for the
1214examination. In this treatise, it is observed that significant
1223changes in the QRS complexes are consistent with acute
1232myocardial infarction; all other answer choices are consistent
1240with a diagnosis of acute pericarditis. "A" is, therefore, the
1250correct answer to question 11 of Part IIA of the FMLE, and
1262Ms. Jimenez should not receive credit for her answer because the
1273answer she gave is not the correct answer.
128110. According to the Department, the correct answer to
1290question 81 of Part IIA of the examination is "B"; Ms. Jimenez
1302chose answer "A." Question 81 is clear and unambiguous, the
1312question contains sufficient information to answer the question
1320correctly, and the question has only one correct answer, which
1330is included among the choices provided. The correct answer can
1340be found in the reference book entitled Harrison's Principles of
1350Internal Medicine , 14th Edition, 1998, which is considered an
1359authoritative text by physicians and which is included in the
1369list of reference books provided to candidates for the
1378examination. In this treatise, it is observed that the
1387prevalence of MS varies significantly among different ethnic
1395groups. "B" is, therefore, the correct answer to question 81 of
1406Part IIA of the FMLE, and Ms. Jimenez should not receive credit
1418for her answer because the answer she gave is not the correct
1430answer.
143111. According to the Department, the correct answer to
1440question 183 of Part IIA of the examination is "A"; Ms. Jimenez
1452chose answer "D." Question 183 is clear and unambiguous, the
1462question contains sufficient information to answer the question
1470correctly, and the question has only one correct answer, which
1480is included among the choices provided. The correct answer can
1490be found in the reference book entitled Novak's Gynecology , 12th
1500Edition, 1998, which is considered an authoritative text by
1509physicians and which is included in the list of reference books
1520provided to candidates for the examination. The question
1528elicits the answer identifying the treatment that is most
1537appropriate for the described patient, and, in the treatise, it
1547is observed that hormone replacement therapy is indicated for
1556women who are menopausal and have no contraindications. "A" is,
1566therefore, the correct answer to question 183 of Part IIA of the
1578FMLE, and Ms. Jimenez should not receive credit for her answer
1589because the answer she gave is not the correct answer.
159912. According to the Department, the correct answer to
1608question 113 of Part IIB of the examination is "A"; Ms. Jimenez
1620chose answer "D." Question 113 is clear and unambiguous, the
1630question contains sufficient information to answer the question
1638correctly, and the question has only one correct answer, which
1648is included among the choices provided. The correct answer can
1658be derived from information found in the reference books
1667entitled Harrison's Principles of Internal Medicine , 14th
1674Edition, 1998, and Robert B. Taylor's Family Medicine:
1682Principles and Practice , 5th Edition, 1997, which are considered
1691authoritative texts by physicians and which are included in the
1701list of reference books provided to candidates for the
1710examination. The question elicits the answer identifying the
1718intervention that is most appropriate for the described patient.
1727It can be determined from the information contained in the
1737treatises that the patient described in the question should not
1747be treated with drugs but, rather, should be treated with diet
1758and exercise. "A" is, therefore, the correct answer to question
1768113 of Part IIB of the FMLE, and Ms. Jimenez should not receive
1781credit for her answer because the answer she gave is not the
1793correct answer.
1795CONCLUSIONS OF LAW
179813. The Division of Administrative Hearings has
1805jurisdiction over the subject matter of this proceeding and of
1815the parties thereto pursuant to Sections 120.569 and 120.57(1),
1824Florida Statutes (1999).
182714. Ms. Jimenez has the burden of proving by a
1837preponderance of the evidence that the Department's decision to
1846give her no credit for her answers to the challenged examination
1857questions is arbitrary or capricious or constitutes an abuse of
1867discretion. See State ex rel. Glasser v. J. M. Pepper , 155 So.
18792d. 383 (Fla. 1st DCA 1963); State ex rel. Topp v. Board of
1892Electrical Examiners , 101 So. 2d. 583 (Fla. 1st DCA 1958).
1902Based on the facts found herein, Ms. Jimenez has failed to meet
1914this burden with respect to questions 3, 11, 81, and 183 of Part
1927IIA and to question 113 of Part IIB of the FMLE administered
1939November 19 and 20, 1999.
1944RECOMMENDATION
1945Based on the foregoing Findings of Fact and Conclusions of
1955Law, it is RECOMMENDED that the Department of Health enter a
1966final order dismissing the petition of Gloria Patricia Jimenez
1975challenging questions 3, 11, 81, and 183 of Part IIA and
1986question 113 of Part IIB of the Florida Medical Licensure
1996Examination administered November 19 and 20, 1999..
