135STATEMENT OF THE ISSUE
139Whether Respondent has the discretion to deny Petitioner's
147application for a beverage license on the grounds set forth in
158the Notice of Intent to Deny License and, if so, whether
169Respondent abused its discretion.
173PRELIMINARY STATEMENT
175Petitioner's application for a beverage license was denied
183by Respondent on the grounds that the applicant had a previous
194beverage license revoked in 1994 and was not believed to be of
206good moral character.
209Petitioner timely challenged the denial, the matter was
217referred to the Division of Administrative Hearings, and this
226proceeding followed.
228At the final hearing, Petitioner testified on his own behalf
238and presented the additional testimony of his daughter, his
247daughter-in-law, and his wife. Petitioner offered no exhibits.
255Respondent presented no testimony, but offered one exhibit,
263which was accepted into evidence.
268No Transcript of the proceedings was filed. Respondent
276filed a Proposed Recommended Order, which has been duly-
285considered by the undersigned in the preparation of this
294Recommended Order. Petitioner did not file a proposed
302recommended order.
304FINDINGS OF FACT
3071. Respondent is a licensing and regulatory agency of the
317State of Florida charged with the responsibility and duty to
327issue beverage licenses pursuant to Chapter 561, Florida
335Statutes, and applicable rules.
3392. Prior to October 21, 1994, Petitioner, doing business as
349Wilson's Grocery, was the owner and holder of beverage license
35966-0123.
3603. On November 9, 1992, Petitioner's daughter, daughter-in-
368law, and wife were convicted of felony charges pertaining to food
379stamps fraud that occurred on or near the licensed premises. On
390November 9, 1992, Respondent issued to Petitioner a Notice to
400Show Cause why license 66-0123 should not be revoked based on
411those convictions.
4134. Petitioner timely requested a formal hearing to
421challenge the Notice to Show Cause, the matter was referred to
432the Division of Administrative Hearings, and assigned DOAH Case
441No. 94-0929. A formal hearing was convened in Fort Pierce,
451Florida, on July 21, 1994, before Administrative Law Judge J. D.
462Parrish. At the formal hearing, Petitioner withdrew his request
471for a formal hearing with the knowledge that license 66-0123
481would be revoked.
4845. On October 21, 1994, a Final Order was entered by
495Respondent revoking license 66-0123.
4996. Petitioner offered no evidence that would establish he
508has good moral character.
512CONCLUSIONS OF LAW
5157. The Division of Administrative Hearings has jurisdiction
523of the parties to and the subject of this proceeding. Section
534120.57(1), Florida Statutes.
5378. Section 561.15(1), Florida Statutes, provides that
544Respondent shall issue beverage licenses only to persons of good
554moral character.
5569. Section 561.15(3)(a), Florida Statutes, provides as
563follows:
564(3 ) The division may suspend or revoke the
573license under the Beverage Law of, or may
581refuse to issue a license under the Beverage
589Law to:
591(a ) Any person, firm, or corporation the
599license of which under the Beverage Law has
607been revoked or has been abandoned after
614written notice that revocation or suspension
620proceedings had been or would be brought
627against the license . . .
63310. Rule 61A-1.017, Florida Administrative Code, provides,
640in pertinent part, the following pertaining to moral character:
649(1 ) For purposes of the Beverage Law, a
658person of "good moral character" shall mean a
666person who:
668(a ) Has the ability to distinguish between
676right and wrong and the character to observe
684the difference;
686(b ) Observes the rules of right conduct;
694and
695(c ) Acts in a manner that indicates and
704establishes the qualities of trust and
710confidence that is generally acceptable to
716the state.
718(2 ) Conduct that does not establish the
726qualities of trust and confidence include the
733following:
734* * *
737(k ) Having had an ownership interest or
745managed a business whose alcoholic beverage
751license or permit was revoked by a government
759agency for a violation of a criminal law that
768is punishable by imprisonment for a term
775exceeding 1 year or four violations of the
783same law during the preceding 3 years.
79011. Respondent established that it was within its
798discretion to deny Petitioner's application for a beverage
806license based on the revocation of his prior beverage license.
81612. Rule 61A-1.017(2)(k), Florida Administrative Code,
822provides, in pertinent part, the following as to applicants who
832need to establish that he or she has good moral character:
843(3 ) Mitigation the division will consider
850in determining a person's good moral
856character when there is evidence of the
863conduct described in subsection (2) of this
870rule includes:
872(a ) An affidavit explaining the
878circumstances of past conduct and evidence of
885the qualities of trust and confidence, the
892ability to distinguish between right and
898wrong, and the character to observe the
905difference; and
907(b ) Character references from people who
914have personal knowledge of the applicant's or
921licensee's qualities of trust and confidence,
927the ability to distinguish between right and
934wrong, and the character to observe the
941difference. References may not include
946spouse, sons, daughters, or anyone employed
952by the applicant or licensee.
957(c ) Evidence of good citizenship and
964improving the quality of life in their
971community.
97213. Petitioner failed to present any evidence as to whether
982he has good moral character.
98714. Petitioner failed to establish that Respondent abused
995its discretion in denying his application for a beverage license.
1005RECOMMENDATION
1006Based on the foregoing Findings of Fact and Conclusions of
1016Law, it is RECOMMENDED that Respondent enter a final order
1026denying Petitioner's application for a beverage license.
