114STATEMENT OF THE ISSUE

118Whether Timothy John O'Dea, on behalf of Respondent,

126Skyline Caterers Corporation, d/b/a Cracker Barrel, willingly

133and knowingly falsely swore to having no criminal charges filed

143against him within the past 15 years on his Alcoholic Beverage

154and Tobacco license application on September 1, 1999.

162PRELIMINARY STATEMENT

164On March 21, 2001, the Agency (DABT) referred the Petition

174for Administrative Action and Respondent's Request for Hearing

182to the Division of Administrative Hearings to conduct a Section

192120.57(1) hearing. By the petition, DABT is attempting to

201revoke, suspend, or otherwise discipline Respondent's license.

208On March 29, 2001, Petitioner filed a Unilateral Response

217to Initial Order. On March 30, 2001, an Order of Pre-Hearing

228Instructions and a Notice of Hearing, with the hearing scheduled

238for May 16, 2001, were issued.

244On May 5, 2001, Petitio ner filed its Prehearing

253Stipulation. On May 11, 2001, Respondent, by letter to the

263undersigned, requested a continuance to retain counsel. On

271May 14, 2001, an Order Granting Continuance was issued,

280rescheduling the final hearing for June 19, 2001, at 9:00 a.m.,

291Judicial Center, Courtroom 7, at Sarasota, Florida. It is noted

301that all orders and notices of hearing issued in this case were

313furnished to and received by : Michael Martinez, Esquire, for

323Petitioner; Captain Allen F. Nash, for the Department; and

332James C. Rowe, Esquire, for Respondent. On July 3, 2001,

342Timothy John O'Dea faxed a letter to the undersigned

351maintaining, first, that James Rowe did not represent him.

360Second, he alledged that he did not receive the order granting

371his requested continuance and rescheduling the final hearing.

379Finally, he requested that the hearing be reopened for his

389participation. Attorney Rowe's letter of July 3, 2001,

397maintained that he did not represent O'Dea and that he had not

409entered a Notice of Appearance on his behalf. Mr. Rowe

419expressed belief that O'Dea had notice of the final hearing.

429This confusion between Respondent and Attorney Rowe results

437solely from O'Dea's failure to act. Accordingly, O'Dea's late-

446written request to reopen the hearing is, herewith, denied.

455The final hearing was delayed for 30 minutes to wait for

466the arrival of Respondent. At 9:30 a.m., the hearing proceeded

476without the participation of Respondent who failed to appear.

485Petitioner presented the testimony of Suzanne Castro,

492Special Agent, DABT, and offered five exhibits (1-5) each of

502which was accepted in evidence. Petitioner's counsel's request

510for Official Recognition of Rule 61A-2.022, Florida

517Administrative Code, was granted.

521FINDINGS OF FACT

5241. Petitioner, the Department of Business and Professional

532Regulations, Division of Alcoholic Beverages and Tobacco, is the

541Agency charged with the responsibility of administrating and

549enforcing the beverage laws of the State. Chapters 559-568

558Florida Statutes.

5602. At all times material to this proceeding, Respondent,

569Skyline Caters Corporation, d/b/a Cracker Barrel, Timothy John

577O'Dea, President, operated a licensed restaurant-catering

583business located at 7984 North Tamiami Trail, Sarasota,

591Florida 34243.

5933. At all times material to this proceeding, Respondent

602applied for and was holding Beverage License Number 51-00228,

611Series 2APS, package sales only of beer and wine (and other

622alcoholic beverages under 6 percent alcohol by volume) and

63151-02385 tobacco.

6334. On or about September 1, 1999, Timothy John O'Dea, on

644behalf of Respondent, completed a License/Permit application,

651Form ABT 4000-001L. On page four of the application, under oath

662or affirmation, Mr. O'Dea answered "NO" to the question have you

673had any criminal charges filed against you within the past

68315 years.

6855. Special Agent Suzanne Castro, testimony proved that the

694criminal charges portion of the Alcoholic Beverage License

702Application, that asks whether Respondent has any criminal

710charges filed against him, is used in determining applicant's

719initial eligibility for the requested license.

7256. According to Special Agent Castro, reliance upon the

734sworn information provided by Respondent was the basis upon

743which the Agency issued to Timothy John O'Dea the herein-

753referred to license.

7567. In completing the approval process, DABT's routine and

765subsequent investigation revealed that Timothy John O'Dea had

773been arrested and charged with thief of services by the Passaic,

784New Jersey, Police Department on January 18, 1995. The Bergen,

794New Jersey, Police Department, on August 3, 1995, arrested

803Respondent a second time on the charge of thief of services.

814The dispositions of the arrests are unknown. Presently, there

823are two outstanding New Jersey arrest warrants for Timothy John

833O'Dea.

8348. Timothy John O'Dea, willingly and knowingly, falsely

842swore, under oath or affirmation, of having no criminal charges

852filed against him within the 15 years prior to September 1,

8631999.

864CONCLUSIONS OF LAW

8679. The Division of Administrative Hearings has

874jurisdiction over the parties and the subject matter of this

884proceeding pursuant to Section 120.57(1), Florida Statutes.

89110. Section 559.791, Florida Statutes, provides that:

898Any license issued by the Department of

905Business and Professional Regulation which

910is issued or renewed in response to an

918application upon which the person signing

924under oath or affirmation has falsely sworn

931to a material statement, including, but not

938limited to, the names and addresses of the

946owners or managers of the licensee or

953applicant, shall be subject to denial of the

961application or suspension of revocation of

967the license, and the person falsely swearing

974shall be subject to any other penalties

981provided by law.

98411. Timothy John O'Dea falsely swore that he had not been

995charged with a criminal offense within the 15 years prior to his

1007completion of the license application. At the time of

1016completing his license application, O'Dea knew he had been

1025arrested on two separate occasions in New Jersey and he knew

1036those arrests had not been disposed of by the court. O'Dea knew

1048or should have known there were warrants outstanding for his

1058arrest. Accordingly, Timothy John O'Dea's license shall be

1066subject to denial, suspension, or revocation.

107212. Rule 61A-2.002, Florida Administrative Code, Penalty

1079Guidelines, calls for a revocation of the license of a

1089Respondent for a first occurrence of a violation of

1098Section 559.791, Florida Statutes. Timothy John O'Dea's first

1106violation of this statute requires a revocation of the license

1116issued to him by DABT.

112113. The Department is statutorily empowered to suspend or

1130revoke an alcoholic beverage license, such as the one held by

1141Respondent, Skyline Caterers Corporation, d/b/a Cracker Barrel,

1148based upon any of the grounds enumerated in

1156Section 561.29(1)(a) and (g), Florida Statutes, which in

1164pertinent part provides:

1167(1 ) The Division is given full power and

1176authority to revoke or suspend the license

1183of any person holding a license under the

1191Beverage Law, when it is determined or found

1199by the division upon sufficient cause

1205appearing of:

1207(a ) Violation by the licensee or its

1215agents, officers, servants, or employees, on

1221the license premises, or elsewhere while in

1228the scope of employment, of any the laws of

1237this state. . . .

1242* * *

1245(g ) A determination that any person

1252required to be qualified by the division as

1260condition for the issuance of the license is

1268not qualified.

127014. The DABT has shown by clear and convincing evidence

1280that Timothy John O'Dea, on behalf of Respondent, Skyline

1289Caterers Corporation, d/b/a Cracker Barrel, personally violated

1296Section 559.791, Florida Statutes, when he knowingly and

1304willingly falsified his prior arrest record on his license

1313application.

131415. Based on the above, DABT shall revoke the license

1324issued to Timothy John O'Dea.

1329RECOMMENDATION

1330Based on the foregoing Findings of Fact, Conclusions of

1339Law, and review of the penalty guidelines in Rule 61A.2-022,

1349Florida Administrative Code, it is RECOMMENDED that the

1357Department of Business and Professional Regulation enter a final

1366order revoking license numbered 51-00228, Series 2APS, issued to

1375Timothy John O'Dea.
