212STATEMENT OF THE ISSUE
216Whether proposed Rule 69O-186.013 is an invalid exercise of
225legislatively delegated authority as defined in Section
232120.52(8), Florida Statutes.
235PRELIMINARY STATEMENT
237This case originated with the filing of a Petition to
247Determine Invalidity of Proposed Rule on December 15, 2006,
256challenging proposed Rule 69O-186.013. The case was assigned to
265the undersigned on December 19, 2006, and that same day, the
276matter was scheduled for hearing January 18, 2007.
284On January 10, 2007, the Respondent filed a Motion for
294Continuance, asserting that the Department intended to publish a
303Notice of Change with respect to the proposed rule, which could
314address Petitioners' objections in their entirety or change the
323scope of issues to be presented for hearing. Petitioners did not
334object to the motion and the case was rescheduled for hearing on
346May 7, 2007, in order to accommodate both the publication of any
358changes and the conduct of any hearings or workshops on those
369changes.
370On March 9, 2007, Petitioners filed a Motion for
379Continuance, asserting that the Department had not published any
388Notice of Change, and requesting that the case be continued until
399after August 7, 2007. After a telephone conference call on the
410motion, the hearing scheduled for May 7, 2007, was canceled and
421the case was rescheduled for June 27, 2007.
429On March 16, 2007, a Motion to Appear Pro Hac Vice was
441filed, asking that out-of-state counsel be permitted to appear
450along with local counsel on behalf of the Petitioners. On
460May 11, 2007, Petitioners filed a Motion for Relief on Account of
472Respondent's Failure to Satisfy Its Discovery Violations (Motion
480for Relief). No response was filed to either motion. The Motion
491for Relief alleged that the Department had failed to respond to
502Petitioners' Request for Production and had filed insufficient
510responses to interrogatories and requests for admissions. The
518motion requested that the matter be continued for at least 60
529days following compliance with the discovery requests. The
537Motion for Relief was filed almost three months after receiving
547the incomplete responses to discovery. Accordingly, on May 25,
5562007, an Order on Pending Motions was entered granting the Motion
567to Appear Pro Hac Vice; requiring compliance with Petitioners'
576discovery requests no later than June 4, 2007; and denying
586Petitioners' request for a continuance of the final hearing.
595On June 1, 2007, the Department filed a Motion for
605Reconsideration of the Order on Pending Motions Dated May 25,
6152007, asserting that due to a miscommunication in counsel's
624office, he did not receive the Motion for Relief in time to file
637a response. Petitioners did not file a response to this motion,
648most likely because of the events detailed in the Findings of
659Facts and Conclusions of Law. On June 7, 2007, Respondent filed
670a Motion to Dismiss for Lack of Subject Matter Jurisdiction,
680asserting that the Petition to Determine Validity of Proposed
689Rule was not timely filed.
694On June 8, 2007, Petitioners filed a Consent to Dismissal of
705Proceedings Based on Representations Contained in Respondent's
712Motion to Dismiss for Lack of Subject Matter Jurisdiction
721(Consent to Dismissal). Both the Motion and the Consent to
731Dismissal have been considered in the preparation of this Final
741Order of Dismissal. Those matters contained in the Findings of
751Fact below are those matters for which there appears to be no
763dispute.
764FINDINGS OF FACT
7671. Pursuant to Section 20.121(3), Florida Statutes, the
775Financial Services Commission (the Commission) serves as the
783agency head for the Office of Insurance Regulation for the
793purpose of rulemaking.
7962. On May 26, 2006, the Office of Insurance Regulation
806issued a Notice of Development of Rulemaking to amend existing
816Florida Administrative Code Rule 69O-186.013. A workshop was
824held pursuant to this notice on June 15, 2006.
8333. On August 15, 2006, the Commission approved for
842publication a notice of proposed rule amendments to Rule 69O-
852186.013.
8534. A Notice of Proposed Rulemaking was published in the
863Florida Administrative Weekly on October 6, 2006. A public
872hearing was held October 31, 2006.
8785. On November 22, 2006, a second notice of hearing was
889published in the "Notices of Meetings, Workshops and Public
898Hearings" section of the Florida Administrative Weekly, advising
906of "an additional public hearing on the proposed amendments to
916Rule 69O-186.013, Title Insurance Statistical Gathering,
922published on October 6, 2006, in Vol. 32, No. 40, of the F.A.W."
9356. A public hearing was conducted as noticed December 5,
9452006.
9467. Petitioners filed their Petition to Determine Invalidity
954of Proposed Rule December 21, 2006.
9608. On June 7, 2007, the Respondent filed its Motion to
971Dismiss for Lack of Subject Matter Jurisdiction. Included in its
981Motion are several statements relevant to the Petitioners'
989position regarding dismissal of these proceedings:
9955. [The December 5, 2006, hearing] of
1002course, was not the "final public hearing,"
1009was not noticed as a hearing at which any
1018action would be taken and never intended to
1026be the "final public hearing" as that term is
1035used in Section 120.56(2)(a), Florida
1040Statutes. In fact, the "final public
1046hearing" would have been held before the FSC
1054as the collegial body responsible for
1060rulemaking for the Office.
10646. When it is appropriate, the FSC will hold
1073such a "final public hearing" prior to
1080adoption of a proposed rule. As in every
1088other instance in which the FSC intends to
1096adopt a rule, notice will be provided in the
1105Florida Administrative Weekly (sample
1109attached as Exhibit E). In this instance,
1116the final hearing has not yet been held, or
1125even scheduled.

113011. Therefore, this case must be dismissed
1137as the Petition to Determine Invalidity of
1144Proposed Rule was untimely filed. The
1150Petitioners may, if they desire, challenge
1156the proposed rule after the final public
1163hearing. Nevertheless, they may not maintain
1169this action at this time.
11749. Petitioners have responded to the Motion to Dismiss by
1184consenting to dismissal of these proceedings, "in reliance on
1193representations made by the State of Florida, Financial Services
1202Commission/Office of Insurance Regulation (the Respondent) in
1209paragraphs 5, 6, and 11 of Respondent's Motion to Dismiss for
1220Lack of Subject Matter Jurisdiction (the Motion to Dismiss) filed
1230on June 7, 2007, that no 'final public hearing' within the
1241meaning of Section 120.54 . . . has been held . . . and that no
1257'final public hearing' shall be held unless Respondent has first
1267provided to Petitioners proper notice and an opportunity to
1276contest the validity of the Proposed Rule."
128310. Petitioners assert, however, that the Petition should
1291be dismissed without prejudice, and that should Respondent
1299attempt to promulgate the Proposed Rule without first holding a
"1309final public hearing" with proper notice, they reserve the right
1319to reinstate this proceeding.
1323CONCLUSIONS OF LAW
132611. The Division of Administrative Hearings has
1333jurisdiction over the subject matter and the parties to this
1343action in accordance with Sections 120.569 and 120.57(1), Florida
1352Statutes.
135312. After review of the pleadings, it is determined that
1363this proceeding shall be dismissed based on the consent of
1373Petitioners in response to Respondent's Motion to Dismiss. The
1382undersigned declines to make any ruling on the merits of
1392Petitioners' Petition or Respondent's Motion to Dismiss given the
1401consent of Petitioner to dismissal.
140613. While Petitioners reserve the right to reinstate this
1415proceeding under certain circumstances, they cite no authority
1423for a dismissal of a rule challenge without prejudice.
1432Based on the following, it is
1438ORDERED:
14391. Respondent's Motion for Reconsideration of the Order on
1448Pending Motions Dated May 25, 2007, is denied as moot.
14582. Respondent's Motion to Dismiss for Lack of Subject
1467Matter Jurisdiction is denied as moot.
14733. Petitioners' Petition to Determine Invalidity of
1480Proposed Rule is dismissed based on Petitioners' consent to
1489dismissal of the proceeding, which is construed as a withdrawal
1499of their Petition to Determine Invalidity of Proposed Rule. The
1509file of the Division of Administrative Hearings in the above-
1519captioned case is hereby closed.
