109The issue is whether Respondent violated the Beverage Law.
118PRELIMINARY STATEMENT
120Petitioner, Department of Business and Professional
126Regulation, Division of Alcoholic Beverages and Tobacco
133(Division), issued an Administrative Action with regard to
141Respondent Palladium West Corporation (Palladium) on April 3,
1492008. The Administrative Action listed sanctions that might be
158applied to the license of Palladium for violations of
167Subsection 561.17(1), Florida Statutes (2007), within Subsection
174561.29(1)(a), Florida Statutes; Subsection 561.20(2)(a)4.,
179Florida Statutes (2007), within Subsection 561.29(1)(a), Florida
186Statutes; and Florida Administrative Code Rule 61A-3.0141(3)(d)
193within Subsection 561.29(1)(a), Florida Statutes.
198Palladium, through its agent Leonid Brenman, on July 20,
2072008, demanded a hearing. The Division forwarded the complaint
216and allied papers to the Division of Administrative Hearings and
226it was set for hearing in Fort Myers, Florida, on November 18,
2382008. Palladium was duly notified. At the appointed time and
248place, no one representing Palladium appeared. The Division,
256through counsel, appeared.
259FINDINGS OF FACT
2621. The Division is the state agency charged with
271supervising businesses licensed under the Beverage Law.
2782. Palladium of 1110 Seawane Drive, Hewlett, New York, has
288a consumption on the premises license issued by the Division for
299operations at 41 West Restaurant and Lounge in Bradenton,
308Florida.
3093. Palladium, through its failure to pursue its demand,
318has admitted that no disputed facts exist with regard to the
329Administrative Action.
331CONCLUSIONS OF LAW
3344. The Division of Administrative Hearings has
341jurisdiction over the subject matter of and the parties to this
352proceeding. § 120.57(1), Fla. Stat.
357RECOMMENDATION
358Based upon the Findings of Fact and Conclusions of Law,
368it is
370RECOMMENDED that the Division take jurisdiction of the
378matter and enter such final order as it deems appropriate.
