123STATEMENT OF THE ISSUE

127The issue for determination is whether Respondent committed

135the offense set forth in the Administrative Complaint and, if

145so, what action should be taken.

151PRELIMINARY STATEMENT

153The Department of Business and Professional Regulation,

160Division of Hotels and Restaurants, hereinafter Department,

167issued an Administrative Complaint against Food For Your Mood,

176dated August 22, 2008. The Department charged Food For Your

186Mood with violating Food Code Rule 6-501.111, Controlling Pests,

195in that 30-plus live roaches and 20-plus dead roaches were

205observed behind the reach-in cooler in the kitchen. Food For

215Your Mood disputed the material allegations of fact and

224requested a hearing. On October 8, 2008, this matter was

234referred to the Division of Administrative Hearings.

241At hearing, the Department presented the testimony of two

250witnesses and entered two exhibits (Petitioner’s Exhibits

257numbered 1-2) into evidence. Food For Your Mood presented the

267testimony of one witness, Nicole Moxley, who testified on her

277own behalf, and entered no exhibits into evidence. The

286undersigned took official recognition of Section 509.032(6),

293Florida Statutes (2007), and Food Code Rule 6-501.111.

301A transcript of the hearing was ordered. At the request of

312the parties, the time for filing post-hearing submissions was

321set for ten days following the filing of the transcript. The

332Transcript, consisting of one volume, was filed on April 7,

3422009. The parties timely filed their post-hearing submissions,

350which have been considered in the preparation of this

359Recommended Order.

361FINDINGS OF FACT

3641. At all times material hereto, Food For Your Mood was

375licensed as a public food service establishment in the State of

386Florida by the Department, having been issued license type 2010

396and license number 2330809.

4002. At all times material hereto, Food For Your Mood was

411located at 16650 Northwest 27th Avenue, Opa-Locka, Florida

41933054.

4203. A critical violation in food service is considered to

430be a violation that can immediately constitute a health threat

440or food-borne illness, or can contribute directly to a food-

450borne illness. A non-critical violation is considered to be a

460violation that does not immediately constitute a health threat

469or food-borne illness, but, if not corrected, can constitute or

479often lead to a health threat or food-borne illness.

4884. On August 22, 2008, Kevon Pierre, a sanitation and

498safety specialist with the Department, conducted an inspection

506of Food For Your Mood. Accompanying Mr. Pierre was another

516inspector with the Department, Guillermo Alonso, a sanitation

524and safety supervisor, who did not perform any of the

534inspection.

5355. Food For Your Mood was situated between two

544restaurants, one of which was closed and abandoned.

5526. During the inspection, Mr. Pierre found a violation,

561which he considered to be a critical violation. Further, during

571the inspection, Mr. Pierre prepared a food inspection report on

581his PDA (Personal Data Assistant), setting forth the alleged

590critical violation. Mr. Pierre made Ms. Moxley aware of the

600alleged critical violation and reviewed the inspection report

608with her. The inspection report was signed by Mr. Pierre,

618Ms. Moxley, and Mr. Alonso.

6237. The inspection on August 22, 2008, involved a possible

633closure of Food For Your Mood. Even though Mr. Pierre conducted

644the inspection, Mr. Alonso, as a supervisor, was also required

654to sign the inspection report because the inspection involved a

664possible closure of Food For Your Mood, and because, at that

675time, Mr. Pierre was not a “standardized” inspector, meaning

684that he was on probationary status.

6908. The alleged critical violation on August 22, 2008, was

70035A-05-1: 1 “Observed roach activity as evidenced by live roaches

710found 30 PLUS LIVE ROACHES BEHIND REACH IN COOLER IN KITCHEN

721AREA.” The reach-in cooler was on wheels, so Mr. Pierre was

732able to move it, observe the area behind it, and observe the

744roaches. Mr. Pierre counted the roaches. Additionally,

751Mr. Alonso observed live roaches behind the reach-in cooler, but

761did not count them. Mr. Pierre and Mr. Alonso considered this

772alleged violation to be a critical violation because the roaches

782constituted an immediate health threat and/or cause a food-borne

791illness due to some of the diseases that they may carry. Their

803testimony on this subject is found to be credible and clear and

815convincing.

8169. Ms. Moxley looked behind the reach-in cooler after

825Mr. Pierre and Mr. Alonso, but failed to observe any roaches.

836Her testimony is found to be credible; however, the testimony of

847Mr. Pierre and Mr. Alonso is found to be more credible.

85810. Even though Mr. Pierre testified that it was standard

868procedure to inspect an adjoining restaurant in a shopping

877complex or a complex, no testimony was presented as to the

888findings of his inspection of the restaurant that was still

898operating.

89911. Mr. Pierre did not enter and inspect the adjoining

909restaurant that was closed and abandoned because the Department

918did not have jurisdiction to enter and inspect a closed

928restaurant.

92912. Food For Your Mood was closed as a result of the

941critical violation being found.

94513. No evidence was presented regarding the alleged

953violation set forth in the Administrative Complaint regarding

96120-plus dead roaches observed behind the reach-in cooler in the

971kitchen area.

973CONCLUSIONS OF LAW

97614. The Division of Administrative Hearings has

983jurisdiction over the subject matter of this proceeding and the

993parties thereto pursuant to Sections 120.569 and 120.57(1),

1001Florida Statutes (2008).

100415. The Department has the burden of proof to show by

1015clear and convincing evidence that Food For Your Mood committed

1025the offense set forth in the Administrative Complaint.

1033Department of Banking and Finance, Division of Securities and

1042Investor Protection v. Osborne Stern and Company , 670 So. 2d 932

1053(Fla. 1996); Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987).

106416. Section 509.032, Florida Statutes (2008), provides in

1072pertinent part:

1074(1) GENERAL. --The division [Division of

1080Hotels and Restaurants of the Department of

1087Business and Professional Regulation] shall

1092carry out all of the provisions of this

1100chapter and all other applicable laws and

1107rules relating to the inspection or

1113regulation of public lodging establishments

1118and public food service establishments for

1124the purpose of safeguarding the public

1130health, safety, and welfare. . . .

1137(2) INSPECTION OF PREMISES.

1141(a) The division has responsibility and

1147jurisdiction for all inspections required by

1153this chapter. The division has

1158responsibility for quality assurance. . .

1164(b) For purposes of performing required

1170inspections and the enforcement of this

1176chapter, the division has the right of entry

1184and access to public lodging establishments

1190and public food service establishments at

1196any reasonable time.

1199(c) Public food service establishment

1204inspections shall be conducted to enforce

1210provisions of this part and to educate,

1217inform, and promote cooperation between the

1223division and the establishment.

1227(d) The division shall adopt and enforce

1234sanitation rules consistent with law to

1240ensure the protection of the public from

1247food-borne illness in those establishments

1252licensed under this chapter. These rules

1258shall provide the standards and requirements

1264for obtaining, storing, preparing,

1268processing, serving, or displaying food in

1274public food service establishments . . .

1281conducting necessary public food service

1286establishment inspections for compliance

1290with sanitation regulations . . . and

1297initiating enforcement actions, and for

1302other such responsibilities deemed necessary

1307by the division. . . .

1313* * *

1316(3) SANITARY STANDARDS; EMERGENCIES;

1320TEMPORARY FOOD SERVICE EVENTS. --The

1325division shall:

1327(a) Prescribe sanitary standards which

1332shall be enforced in public food service

1339establishments.

1340* * *

1343(6) RULEMAKING AUTHORITY. --The division

1348shall adopt such rules as are necessary to

1356carry out the provisions of this chapter.

136317. Florida Administrative Code Rule 61C-1.004, “General

1370Sanitation and Safety Requirements,” provides in pertinent part:

1379The following general requirements and

1384standards shall be met by all public lodging

1392and public food service establishments:

1397(3) Vermin control - Effective control

1403measures shall be taken to protect against

1410the entrance into the establishment, and the

1417breeding or presence on the premises of

1424rodents, flies, roaches and other vermin.

1430All buildings shall be effectively rodent-

1436proofed, free of rodents and maintained in a

1444rodent-proof and rodent-free

1447condition. . . .

145118. As to alleged violation 35A-05-1, Food Code Rule 6-

1461501.111, “Controlling Pests,” provides in pertinent part:

1469The presence of insects, rodents, and other

1476pests shall be controlled to minimize their

1483presence on the PREMISES by:

1488(A) Routinely inspecting incoming shipments

1493of FOOD and supplies;

1497(B) Routinely inspecting the PREMISES for

1503evidence of pests;

1506(C) Using methods, if pests are found, such

1514as trapping devices or other means of pest

1522control as specified under §§ 7-202.12, 7-

1529206.12, and 7-206.13; and

1533(D) Eliminating harborage conditions.

1537(emphasis in original)

154019. The evidence is clear and convincing and demonstrates

1549that Food For Your Mood violated Food Code Rule 6-501.111 in

1560that 30-plus live roaches were found behind the reach-in cooler

1570in the kitchen area. Furthermore, the evidence is clear and

1580convincing and demonstrates that the violation was a critical

1589violation.

159020. Regarding the alleged violation of Food Code Rule 6-

1600501.111 as to 20-plus dead roaches found behind the reach-in

1610cooler in the kitchen area, this violation is considered

1619abandoned by the Department since no evidence was presented.

162821. As to penalty, Section 509.261, Florida Statutes

1636(2008), provides in pertinent part:

1641(1) Any public lodging establishment or

1647public food service establishment that has

1653operated or is operating in violation of

1660this chapter or the rules of the division,

1668operating without a license, or operating

1674with a suspended or revoked license may be

1682subject by the division to:

1687(a) Fines not to exceed $ 1,000 per

1696offense;

1697(b) Mandatory attendance, at personal

1702expense, at an educational program sponsored

1708by the Hospitality Education Program; and

1714(c) The suspension, revocation, or refusal

1720of a license issued pursuant to this

1727chapter.

172822. The Department suggests an administrative fine in the

1737amount of $2,000.00, which is contrary to the administrative

1747fine provision of Section 509.261(1)(a), Florida Statutes

1754(2008).

1755RECOMMENDATION

1756Based on the foregoing Findings of Fact and Conclusions of

1766Law, it is

1769RECOMMENDED that the Department of Business and

1776Professional Regulation, Division of Hotels and Restaurants,

1783enter a final order imposing an administrative fine in the

1793amount of $1,000.00 against Food For Your Mood.
