162STATEMENT OF ISSUE

165The issue in this case is whether Suncoast Concrete, Inc.

175(Suncoast), is entitled to Permit No. 194919-003-SO, to

183construct and operate a construction and demolition debris

191disposal facility (C & D facility) in Santa Rosa County,

201Florida.

202PRELIMINARY STATEMENT

204On October 9, 2008, the Department of Environmental

212Protection (Department) issued a Notice of Intent to issue

221Permit No. 194919-003-SO to Suncoast, to construct and operate a

231C & D facility in Santa Rosa County. On October 30, 2009, the

244Department received a petition from 35 persons challenging the

253proposed agency action. The matter was then referred to DOAH.

263Many of the original Petitioners apparently did not

271understand that their names had been submitted as Petitioners

280and did not intend to present evidence or to otherwise

290participate as Petitioners. Before the final hearing, 25 of the

300Petitioners voluntarily dismissed their claims in the case.

308Only three Petitioners attended the final hearing: Lois Mahute,

317Wallis Mahute, and Nathaniel Williams, Jr. The other remaining

326Petitioners were dismissed by order of the Administrative Law

335Judge at the final hearing.

340The Department’s motion in limine to preclude Petitioners

348from offering evidence on zoning issues and impacts to real

358property values, was granted.

362The Department’s request for official recognition of

369Florida Administrative Code Chapter 62-701 and Rules 62-4.070

377and 62-296.320, was granted.

381At the final hearing, Joint Exhibits 1 through 12 were

391admitted into evidence. Suncoast presented the testimony of

399Tony Mellini, an expert in C & D facility design and

410construction. The Department presented the testimony of

417Marshall Seymour, an expert in engineering and solid waste

426management design; and Ross Mitchell, a field inspector with the

436Department. Petitioners presented the testimony of Kyle Holley,

444a local businessman with an interest in local water and land use

456issues. Petitioners’ Exhibit 1 was admitted into evidence.

464Petitioners attached to their post-hearing submittal a

471number of documents which had not been offered as exhibits at

482the final hearing or had been offered, but not admitted into

493evidence over Respondents’ objections. Respondents’ motion to

500strike these documents from Petitioners’ post-hearing submittal

507was granted.

509A one-volume Transcript of the final hearing was prepared

518and filed with DOAH. Petitioners and Respondents filed post-

527hearing writings that were carefully considered in the

535preparation of this Recommended Order.

540FINDINGS OF FACT

5431. Petitioners Lois and Wallis Mahute live within two

552miles of the proposed C & D facility. Petitioner Nathaniel

562Williams, Jr., resides less than one mile from the proposed

572facility.

5732. Suncoast is a Florida corporation and is the applicant

583for Permit No. 194919-003-SO.

5873. The site of the proposed C & D facility is already

599permitted by the Department as a disposal facility for land-

609clearing debris. It is located on U. S. Highway 90, 1.9 miles

621east of State Road 87.

6264. The disposal area is 7.2 acres on a parcel of land that

639is 57.8 acres.

6425. Suncoast provided all of the information required by

651the Department for applications for C & D facilities, including

661geotechnical data, hydrologic data, and financial assurance for

669closure.

6706. The proposed permit includes numerous conditions,

677including the use of an impermeable liner, groundwater

685monitoring, stormwater controls, leachate collection and

691storage, and access control. The requirement for an impermeable

700liner is uncommon for C & D facilities and adds greater

711protection for groundwater.

714Issues Raised by Petitioners

7187. Petitioners expressed concern about groundwater

724contamination. The required liner is designed to prevent

732rainwater that might become contaminated after contact with the

741materials in the landfill from entering the groundwater.

7498. The proposed facility would be located over some

758existing land-clearing debris. The existing debris is located

766on part of one side of the proposed landfill. Before the liner

778is installed, the base would be prepared by covering the area

789with six inches of compacted soil. After the liner is

799installed, two feet of clean soil is placed on top of the liner.

812The liner would be installed in a manner to prevent the liner

824from being punctured or torn.

8299. Groundwater monitoring is required so that any

837contamination that occurs will be detected and remediated.

84510. There are no potable water wells within 500 feet of

856the proposed facility. The nearest public water supply well is

866approximately 4,000 feet away.

87111. Petitioners presented the testimony of Kyle Holley,

879who expressed his views on hydrogeologic conditions in the area.

889Mr. Holley is not a geologist or hydrologist and was not

900competent to testify regarding the hydrogeologic conditions in

908the area.

91012. Petitioners expressed concern about odors, but

917presented no competent evidence that foul or unhealthy odors

926would be generated by the facility. The permit conditions that

936require a small working face and weekly cover with soil would

947minimize odors.

94913. Petitioners expressed concern about fires, partly

956because fires have occurred at other C & D facilities. The

967evidence shows that the requirements of the proposed permit,

976including the prohibition against burning and requirements to

984maintain a small working face and to cover with soil on a weekly

997basis, would minimize the possibility of fires at the facility.

1007The facility must maintain access for fire trucks to the

1017disposal area so that, if a fire occurs, it can be suppressed.

102914. Petitioners expressed concerns that the facility would

1037not be safely closed in the event that Suncoast became bankrupt

1048or otherwise ceased operations at the facility. The evidence

1057shows that the financial assurance requirements of the proposed

1066permit provide a means to close the facility in the event that

1078Suncoast was unwilling or unable to close the facility.

108715. Petitioners expressed concerns about the “pattern of

1095abuse” by landfill owners. However, Petitioners presented no

1103evidence that Suncoast has shown a pattern of noncompliance, or

1113that the landfills where these alleged abuses have occurred are

1123similar to Suncoast’s proposed C & D landfill with respect to

1134physical conditions and permit requirements.

113916. Suncoast provided reasonable assurance by a

1146preponderance of the evidence that the facility, with the

1155conditions in the permit, will comply with all applicable rule

1165requirements regarding the protection of groundwater, odor and

1173fire control, and proper closure of the facilities.

118117. In summary, Suncoast proved by a preponderance of the

1191evidence that it has provided reasonable assurance that the

1200proposed facility meets all regulatory criteria for entitlement

1208to Permit No. 194919-003-SO.

1212CONCLUSIONS OF LAW

121518. The Division of Administrative Hearings has

1222jurisdiction over the parties to, and the subject matter of,

1232this proceeding pursuant to Sections 120.569 and 120.57(1),

1240Florida Statutes.

124219. Petitioners’ standing to initiate this proceeding was

1250not placed at issue. Petitioners' residences are close enough

1259to the facility site that odors and fires at the facility, if

1271not prevented or controlled, could adversely affect their

1279health, safety, and welfare. Petitioners have standing to

1287initiate this proceeding.

129020. The burden of proof in a permit case is on the

1302applicant for the permit. Fla. Dep't of Transp. V. J.W.C., Co.,

1313Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981). The standard of proof

1326is preponderance of the evidence. Id.

133221. After the applicant demonstrates that all applicable

1340regulatory criteria have been met, the burden shifts to the

1350challenger to present contrary evidence of equal quality to

1359support its claim that the applicant is not entitled to the

1370permit. Id. Speculation or expressions of concern by a

1379challenger are not sufficient to rebut the applicant’s prima

1388facie showing of entitlement.

139222. A permit applicant must provide reasonable assurances,

1400which means that there is a substantial likelihood of compliance

1410with standards, or “a substantial likelihood that the project

1419will be successfully implemented.” Metropolitan Dade County v.

1427Coscan Florida, Inc. , 644 So. 2d 648 (Fla. 3d DCA 1992). It

1439does not mean absolute assurances. Save Our Suwanee v. Fla.

1449Dep't of Envtl. Prot. , 18 F.A.L.R. 1467, 1472 (DEP 1996).

145923. Competent substantial evidence based upon detailed

1466site plans and engineering studies, coupled with credible expert

1475testimony is a sufficient basis for a finding of reasonable

1485assurances. Hamilton County Bd. of County Comm'ns. v. Fla.

1494Dep't of Envtl. Prot. , 587 So. 2d 1378 (Fla. 1st DCA 1991).

150624. Suncoast provided competent substantial evidence based

1513upon detailed site plans and engineering studies, coupled with

1522credible expert testimony, that there is a substantial

1530likelihood of compliance with all applicable standards. The

1538evidence offered by Petitioners in support of their concerns was

1548insufficient to rebut Suncoast’s prima facie case.

155525. Suncoast proved by a preponderance of the evidence

1564that it is entitled to the proposed permit.

1572RECOMMENDATION

1573Based on the foregoing Findings of Fact and Conclusions of

1583Law, it is

1586RECOMMENDED that the Department issue a final order

1594granting Permit No. 194919-003-SO, subject to all the conditions

1603set forth in the Department’s Notice of Intent to Issue, for the

1615construction and operation of a construction and demolition

1623debris disposal facility in Santa Rosa County, Florida.
