166PRELIMINARY STATEMENT
168Dr. Mancini a pplied for licensure as a mental hea lt h
180counselor by exami na tion. O n December 30, 2010, Respondent,
191Departme n t of Health, Board of Clinical Social Work, Marriage
202and Family Therapy and Mental Health Counseling (Board), issued
211its Notice of Intent to Deny Dr. Mancini's application.
220Dr. Manc ini requested a formal hearing pursuant to Section
230120 . 57(1), Florida Statutes. On February 1, 2011, the Board
241referred the request to the Division of Administrative Hearings
250(DOAH) for conduct of the hearing.
256On February 9, 2011, the hearing was sched uled for April 7,
2682011. T he hearing was conducted by video teleconference , as
278noticed, with sites in West Palm Beach and Tallahassee, Florida.
288Dr. Mancini attended the hearing from the West Palm Beach site.
299All other participants attended the hearing fr om the Tallahassee
309site.
310Dr. Mancini testified on his own behalf and presented
319testimony of Dr. Peter Sherrard, Cindy Phelps - Dilmore, Sue
329Foster, and Robin McKenzie. Dr. Mancini offer ed most of his
340exhibits on a CD . He also offered some in paper form. The
353exhibits were not consecutively numbered. Some exhibits on the
362CD were distinguished by the format in which they were recorded,
373PDF or Word. Three, although identified as Word files, were
383digital audio recordings. The Board, as a courtesy, provided
392printed copies of the documents. The following exhibits of

622FINDINGS OF FAC T
626Based on the evidence presented at the final hearing and on
637the entire record of this proceeding, the following findings of
647fact are made:
6501. On December 30, 2010, the Board issued its Notice of
661Intent to Deny Dr. Mancin i's application for licensure as a
672Mental Health Counselor. Dr. Mancini requested a hearing to
681challenge the decision. This proceeding followed.
6872 . Dr. Mancini has been licensed to practice psychology in
698California and Pennsylvania. His Pennsylvania l icense expired
706November 30, 2003. His California license was canceled on
715May 31, 2006.
7183 . Dr. Man c ini earned a master's degree in psychology from
731Fairleigh Dickinson University. He completed 34 semester hours
739of coursework there. The Fairleigh Dicki nson University
747master ' s in psychology program that Dr. Mancini completed was
758not a mental health counseling program accredited by the Council
768of Accreditation of Counseling and R elated Educational Programs.
777The p rogram is, however, related to the practic e of mental
789health counseling .
7924 . A t the time Dr. Mancini attended Farleigh Dickinson , it
804was accredited by the Commission on Higher Education of the
814Middle States Assoc i a tion of Colleges and Schools. It was also
827accredited by the Council of Higher Ed ucation Accreditation.
8365 . By completing Fairleigh Dickinson course 20PY624,
844Counseling and Interviewing, Dr. Mancini obtained three sem e ster
854hours of graduate coursework in the con t ent are a of counse l in g

8736 . By completing Fair leigh Dickinson cours e 30PY633,
883Abnormal Psychology, Dr. Mancini obtained three sem e ster hours
893of graduate coursework in the content area of diagnosis and

9077 . By completing Fairleigh Dickinson Course 30PY600, Tests
916and Meas urements I, Dr. Mancini obtained three sem e ster hours of
929graduate coursework in the content area of individual evaluation

9408 . By completing Fairleigh Dickins on course s 20PY603 and

9809 . By completing Fairleigh Dickinson course 30PY710,
988Social Problems, Dr. Mancini obtained three semester hours of
997graduate coursework in the content area of substa n ce abuse.
100810 . Dr. Mancini attended, but did not receive a degree
1019from, Hahneman University Medical College of Philadelphia (now
1027Drexel University). He completed four semester hours of
1035graduate coursework there. At the time, it w as regionally
1045accredited by the Council of Higher Education Accreditation .
10541 1 . Dr. Mancini attended, but did not receive a degree
1066from, Glassboro State College (now Rowan University). He
1074completed six sem e ster hours of graduate coursework there. At
1085the time, it was regionally accredited by the Council of Higher
1096Education Accreditation.
10981 2 . Dr. Mancin i earned a doctoral degree in counseling
1110psychology from the Professional School of Psychological
1117Studies. At the time, the school was not regionally acc redited.
11281 3 . Dr. Mancini has not obtained three semester hours of
1140graduate - level coursework from a regionally accredited
1148institution in each of the following content areas: human
1157growth and development; human sexuality, group theories and
1165practice; car eer and lifestyle assessment; social and cultural
1174foundations; counseling in community settings; and legal,
1181ethical, and professional standards issues in the practice of
1190mental health counseling.
1193CONCLUSIONS OF LAW
119614 . Sections 120.569 and 120.57(1), Flo rid a Statutes,
1206grant t he Division of Administrative Hearings jurisdiction over
1215the subject matter of this proceeding and of the parties .
12261 5 . As the applicant, Dr. Mancini bears the burden of
1238persuasion to establish by a preponderance of the evidence that
1248he meets the requirements for licensure. § 4 91.005(4)(b)2, Fla.
1258Stat. ; Richard S. Espinoza vs. Dep't. of Bus . & Prof 'l Reg . ,
1272Fla . , Bd. Prof ' l Engineers , 739 So. 2d 1250 (Fla. 3d DCA 1999);
1287Dep' t of Trans p . v. J.W.C. Company, Inc ., 396 So. 2d 778 (Fla.
13031st DCA 1981); Balino v. Dep ' t of HRS , 348 So. 2d 349 (Fla. 1st
1319DCA 1977).
132116 . Section 491.005 (4) establishes the requirements for
1330licensure as a mental health counselor. An applicant must meet
1340the specific educational requirements of section 491.005 (4) .
1349S ee Koger v. Dep't of Prof'l Reg . , 647 So. 2d 312 (Fla. 5th DCA
13651994). Since neither Dr. Mancini 's master ' s degree n or his
1378doctorate is from a mental health counseling program accredited
1387by the Council for the Accreditation of Counseling and Related
1397Educat ional Programs, he must prove that he meets the graduate
1408level cour s ework requirements set forth in section
1417491.005(4)(b) 1 .
142017 . The statute requires that an applicant have earned a
1431master 's degree or higher that includes completion of at least
144260 semest er hours from an institu t ion of higher education . The
1456institution must have been fully accredited by a re g ional
1467accredit ation body recognized by the Commission on Recog n it i on
1480of Postsecondary Accredit at i o n at the time of the applicant's
1493graduation . 2 The coursework must meet specific requirement s
1503addressed later. Dr. Mancini has not proven by persu a sive
1514evidence that he meets the 60 hour requirement.
152218 . Section 491.005(4)(b)1 also requires , among other
1530things, a minimum of three semester hours in 12 con tent areas.
1542Seven of the content areas are : human growth and development;
1553human sexuality, group theories and practice; career and
1561lifestyle assessment; social and cultural foundations;
1567counse ling in community settings; and legal, ethical, and
1576profession al standards issues in mental health counseling .
158519 . Florida Administrati v e Code Rule 64B4 - 31.010 clarifies
1597the content requirements of section 491.005(4)(b), as provided
1605in section 491.005(6). The clarifications of that rule have
1614been applied to the e valuation of the courses completed by
1625Dr. Mancini.
162720 . Dr. Mancini has not proven by persuasive evidence that
1638he has obtained a minimum of three semester hours in the content
1650areas of human growth and development; human sexuality, group
1659theories and pract ice; career and lifestyle assessment; social
1668and cultural foundations; counseling in community settings; and
1676legal, ethical, and professional standards issues in mental
1684health counseling .
16872 1 . Dr. Mancini has not proven that he has completed the
1700required number of hours in an appropriately accredited
1708institution. He also has not proven that he completed the
1718required minimum number of hours in the specific mandatory
1727content areas. Consequently Dr. Mancini is not entitled to
1736licensure as a mental health c ounselor.
1743RECOMMENDATION
1744Based on the foregoing Findings of Fact and Conclusions of
1754Law, it is RECOMMENDED that the Department of Health, Board of
1765Clinical Social Work, Marriage, and Family Therapy and Mental
1774Health Counseling issue a final order denying D r. Mancini's
1784licensure application.
