97STATEMENT OF THE ISSUE

101The issue in this case is whether Petitioner, Marlene

110Serrano ("Serrano"), should be awarded certification as a

120firefighter or, in the alternative, whether Serrano should be

129allowed to re-take the hose operation and ladder operation

138portions of the Firefighter Minimum Standards Written and

146Practical Examination.

148PRELIMINARY STATEMENT

150By letter dated February 21, 2011, Respondent, Department

158of Financial Services (the "Department), through the State Fire

167Marshall, notified Serrano that she had not successfully

175completed the minimum requirements of the firefighter

182examination. Serrano timely filed an Election of Rights form,

191requesting a formal administrative hearing to challenge the

199results of the examination.

203At the final hearing, Serrano testified on her own behalf

213and offered two exhibits which were admitted into evidence as

223Exhibits A and B. The Department called two witnesses:

232Karl Thompson, standards supervisor; and Kenneth Harper, field

240representative. The Department's Exhibits A through F were

248admitted into evidence.

251The parties advised that a transcript of the final hearing

261would be ordered. The parties were given ten days from the date

273the transcript was filed at the Division of Administrative

282Hearings ("Division") to submit proposed recommended orders.

291The Transcript was filed at the Division on June 15, 2011. Each

303party timely submitted a Proposed Recommended Order, and each

312was duly considered in the preparation of this Recommended

321Order.

322FINDINGS OF FACT

3251. Serrano was a candidate for certification as a

334firefighter in the State of Florida.

3402. The Department is the state agency responsible for

349testing all candidates for certification as a firefighter, for

358conducting such tests, and for issuing a certification upon

367successful completion of minimum requirements by a candidate.

375One such examination administered by the Department is the

384Firefighter Minimum Standards Written and Practical Examination

391("Firefighter examination").

3953. The Firefighter examination has a written portion, as

404well as three practical components: Self-Contained Breathing

411Apparatus, Hose Operations, and Ladder Operations. In order to

420meet the minimum requirements for certification, a candidate

428must obtain at least a 70-percent score on each component of the

440Firefighter examination. If a candidate fails the test, he or

450she is afforded one chance to take a re-test.

4594. The ladder component of the Firefighter examination is

468scored using a form listing five mandatory steps which the

478candidate must pass and ten evaluative component steps worth ten

488points each. A candidate taking the ladder component, who

497successfully passes the five mandatory steps, receives a total

506score of the sum of the scores from the ten evaluative component

518steps. A candidate who does not successfully complete one or

528more of the mandatory steps automatically fails the ladder

537component section and receives a score of zero out of 100

548points.

5495. Serrano initially took the Firefighter examination on

557December 22, 2010. That test was administered at the

566Firefighter Academy, a more controlled environment. She failed

574to obtain a passing grade on two components of the examination,

585the hose operations component and the ladder operation

593component. Specifically, she failed to successfully complete

600the components within the required time limit of two minutes,

61020 seconds; and one minute, 25 seconds, respectively. Her times

620were two minutes, 40 seconds; and one minute, 41 seconds,

630respectively. As allowed by law, Serrano was given the

639opportunity to re-take those components of the examination one

648time only.

6506. On February 15, 2011, Serrano went to a training

660facility in Ocala, Florida, to re-take the examination. The

669Ocala site was more open than the Academy site; there were other

681non-firefighter personnel engaged in activities in close

688proximity. Thomas Johnson and Kenneth Harper were the examiners

697assigned to administer the examination to Serrano.

7047. Serrano received a score of 100 on the hose operation

715component of the examination. She completed that portion of the

725test in one minute and 25 seconds, within the prescribed time.

7368. When Serrano finished the hose operation component, she

745was going to begin the ladder operation section. However, one

755of the examiners "yelled" at her that her protective face shield

766was not in place. That is, the shield had been raised to the

779top of her helmet, rather than being in the lowered position

790required during testing. The instructor yelled for her to "put

800your shield down." Serrano interpreted that instruction as a

809sign that she had failed the prior (hose operation) test. She

820began to walk toward the examiners, but they pointed her back in

832the direction of the ladder test.

8389. Serrano was confused, but undertook the ladder

846operation component of the examination anyway. Her

853concentration was somewhat broken by the examiner's comments,

861and she was flustered. Then she heard loud noises coming from

872the field next to the testing site. Apparently, there were

882military maneuvers of some type going on at the adjacent field.

893Furthermore, there was a four-wheeler driving around the

901training ground, creating more distraction for Serrano.

908However, the Department's field representative said he had

916administered over 1,000 tests in the same conditions as were

927present for Serrano's test.

93110. During the test, ten points were deducted from Serrano

941due to her inability to maintain the ladder in a vertical

952position. Further, Serrano did not complete the ladder

960operation component of the examination within the prescribed

968time frame for that section of the test. Her recorded time was

980two minutes and 49 seconds, some 29 seconds longer than allowed.

991The examiner also noted that Serrano almost lost control of the

1002ladder twice during the examination and struggled with the

1011halyard and safety lines.

101511. There are numerous events going on at the training

1025site during testing. The training grounds are intentionally

1033somewhat hectic in order to simulate real "fire ground"

1042conditions. There is no attempt made by the examiners to keep

1053the testing site quiet. Conversely, at the Firefighter Academy

1062where firefighters are initially trained, there is less noise

1071and distraction.

1073CONCLUSIONS OF LAW

107612. The Division of Administrative Hearings has

1083jurisdiction over the parties to and the subject matter of this

1094proceeding pursuant to sections 120.569 and 120.57(1), Florida

1102Statutes (2010). 1/

110513. The Department has jurisdiction over firefighter

1112training and certification in the State of Florida pursuant to

1122Chapter 633, Florida Statutes. Specifically, section 633.35(2)

1129states in pertinent part, as follows:

1135The [Department] shall issue a certificate

1141of compliance to any person satisfactorily

1147complying with the training program

1152established in subsection (1), who has

1158successfully passed an examination as

1163prescribed by the [Department], and who

1169possesses the qualifications for employment

1174in s. 633.34, except s. 633.35(5). . . .

118314. The Department has also adopted rules governing the

1192training and certification of firefighters. Florida

1198Administrative Code Rule 69A-37.056 sets forth the testing

1206parameters for firefighter candidates. Subsection (6) of that

1214rule states:

1216Each subject area within the Minimum

1222Standards Course will be tested to validate

1229the acquisition and application of relevant

1235knowledge and skill. All subject area and

1242final tests, both written and practical,

1248given during the Minimum Standards Course

1254shall require maintenance of a percentage

1260score of not less than 70% on each subject

1269listed in the Minimum Standards Course. If

1276a minimum score of 70% is not achieved on

1285any test, the student shall be afforded a

1293one-time make up examination to achieve the

1300required 70%. Students not in compliance

1306with the minimum score requirement shall be

1313dropped from the course.

131715. Serrano, as the party, who is applying for

1326certification by the state, has the burden of proof. Fla. Dep't

1337of Transp. v. J.W.C. Co., Inc. , 396 So. 2d 778 (Fla. 1st DCA

13501981).

135116. Serrano must prove by a preponderance of the evidence

1361that the Firefighter examination was arbitrary or capricious, or

1370that the grading process was devoid of logic and reason.

1380Espinoza v. Dep't of Bus. & Prof'l Reg. , 739 So. 2d 1250 (Fla.

13933rd DCA 1999).

139617. Serrano did not meet her burden of proof in this

1407matter. The evidence presented did not show that the

1416examination was arbitrary or capricious, as administered, or

1424that the grading process was flawed. By rule, Serrano must be

1435dropped from the course, i.e., her Petition must be denied.

1445RECOMMENDATION

1446Based on the foregoing Findings of Fact and Conclusions of

1456Law, it is

1459RECOMMENDED that a final order be entered by Respondent,

1468Department of Financial Services, dismissing the Petition of

1476Marlene Serrano, in full.
