40BACKGROUND

41On April!, 2015, JSCH submitted an application for approva l as a le vel II trauma

57cen ter ("2015 Application") .

64After conduc ting a provisional review of JSCH's 2015 Application, th e

76Department determined that th e app lication did not meet the critical e lem ents for

92opera ting as a provisional l eve l II trauma center. On April 30, 2015, the Department

109notified JSCH of its decision denying JSCH provisional tr auma center status.

121On May 18, 2015, JSCH filed a Petition for Formal Administra ti ve Hearing to

136Contest the Decision to Deny Jackson South Community Hospital's Application to

147Operate a Provisional Level II Trauma Center.

154On February 29, 2016, Administrative Law Judge John G . Van Laningham i ssued

168a Recommended Order recommending that JSCH be granted provisional status as a

180level II trauma center.

184On or about April!, 2016, JSCH submitted ano th er application for approval as a

199leve l II trauma center ("2016 Application").

208On April 28, 2016, after conducting a provisional review of JSCH's 2016

220Application , th e Department determined that JSCH's 2016 Application met the critical

232elements for opera ting as a provisional le vel II trauma center and granted JSCH a

248license to operate as a provisional le ve l II trauma center. JSCH began operating as a

265provisional leve l II traum a center on May 1, 2016. JSCH is located in trauma service

282area 19 ("TSA 19").

288On May 27, 2016, Kendall filed Intervenor's Motion to Dismiss Jackson South's

300Petition as Moot, arguing that the submission of the 2016 Application and the granting

314of a provisional trauma center license to JSCH renders this case moot.

326On June 3, 2016, JSCH filed a response to the motion , arguing that there is

341continuing controversy despite the Department's decision to grant a provisional trauma

352center license to JSCH based on the 2016 Application.

361CONCLUSIONS OF LAW

3641. Section 395-4025, Florida Statutes, provides for the yea rly application

375process for approving designated trauma centers. Under the statute, the applications

386are reviewed in three stages. Acute care hospitals seeking trauma center designation

398must submit an application to the Department by April1 of each yea r and the

413Department conducts a provisional review of the application for the purpose of

425determining if the hospital meets the critical elements requir e d for operating a trauma

440center. See section 395-4025(2)(c), Florida Statutes. Applicants found acceptable based

450on the provisional review are eligible to operate as a provisional trauma center. See

464section 395-4025(3), Florida Statutes. The second review stage occurs between May 1

476and October 1 of each year, when the Department conducts an in-depth review of all

491applications found acceptable during the provisional review. See section 395-4025(4),

501Florida Statutes. In the final review stage, a review team assembled b y the Department

516conducts onsite visits. See section 395-4025(5), Florida Statutes. Based on the

527recommendations from th e review team , the Department shaii · select verified trauma

540centers b y Jul y 1. See section 395-4025(6) , Florida Statutes .

5522. Any hospital that wishes to protest a decision made b y the Department

566based on the Department's preliminary or in-depth review of applications or on the

579recommendations of the site visit review team shall proceed as provided in chapter 120,

593Florida Statutes. See section 395-4025(7), Florida Statutes. Thus, at each of the three

606decision points in the application process, any hospital may challenge the Department's

618decision concerning the hospital's own application or concerning another hospital ' s

630application.

6313. This matter concerned the Department's denial of JSCH's 2015

641Application for designation as a provisional level II trauma center after a provisional

654review was conducted, the first decision point in the application process. On or about

668April1, 2016, JSCH submitted the 2016 Application, abandoning the 2015 Application.

679The Department's decision to grant provisional trauma center status to JSCH is based

692on the 2016 Application and the 2016 Application is the operative application for the in­

707depth review und er section 395-4025(4), Florida Statutes.

7154· Mootness has been defined as the doctrine of standing set in a time frame:

730The requisite personal interest that must exist at the commencement of litigation

742(standing) must continue throughout its existence. Montgomery v. Dep't of Health &

754Rehabilitative Servs., 468 So. 2d 1014, 1016 (Fla. 1 s t DCA 1985) (internal citations

769omitted) . Mootness occurs when the issues presented are no longer live and the parties

784lack a legally cognizable interest in the outcome. !d. A case is moot when the issues

800have ceased to exist. See A . G . v. Dep't of Children and Family Servs. , 932 So. 2d 311,

820313 (Fla. 2d DCA 2006) . Because JSCH has been granted what it seeks, a license to

837operate as a provisional level II trauma center, the issues in this proceeding have ceased

852to exist.

8545. JSCH argues that a controversy remains in this proceeding because only

866one slot for a verified trauma center remains in TSA 19. JSCH argues that Aventura

881Hospital & Medical Center ( " Aventura") was granted provisional trauma center status

894during the 2015 application cycle and will soon be granted a li ce nse to operate as a

912verified tr a uma center, taking the final slot in TSA 19. JSCH arg u es that granting

930JSCH's 2015 Application will trigger the tiebreaking procedure under Florida

940Administrative Code Rule 64J-2.016(11), and allow JSCH to go head-to-head with

951Aventura in competition for the one remaining slot in TSA 19. JSCH argues that

965granting the 2016 Application will not trigger the tiebreaking pro ce dure.

9776 . Florida Administrative Code Rule 64J-2 . 016(11) describes criteria that

989shall be applied if the number of provisional trauma centers in a give n TSA exceeds the

1006number p er mitted. The rule does not indicate th a t trauma centers can only engage in

1024head-to-head competition if provisional status was granted during the same application

1035year.

10367· How the tiebreaking procedure operates was not an issue or contro versy in

1050this matter. The decision to grant Aventura a license to operate as a provisional trauma

1065center, and any future decision to grant Aventura verified trauma center status was not

1079an issue or controversy in this proceeding. The only issue in this proceeding was JSCH's

1094Petition for hearing challenging the Department's decision to den y JSCH's 2015

1106Application for operation as a provisional trauma center.

11148. A generally recognized exception precluding dismissal of an otherwise

1124moot case occurs in situations where collateral l ega l consequ ences affecting the rights of

1140a party may flow from the issues decided. Se e Lund v. Dep't of H ea lth, 708 So. 2d 645,

1161646 (Fla. 1st DCA 1998). There are no collateral legal consequ e nces to JSCH that flow

1178from the issues decided in this matter. Regardle ss of which application is operative, the

11932015 Application or the 2016 Application, JSCH will still be required to go through the

1208in-depth application review and the onsite review as outlined in section 395-4025,

1220Florida Statutes. Regardless of which application is operative, JSCH has the right to

1233challenge the Department's decision related to granting a verified license to Aventura

1245and has the opportunity to challenge the future decisions related to JSCH's application

1258under section 395-4025(7), Florida Statutes .

12649. Because the Department has granted provisional trauma center status to

1275JSCH based on the 2016 Application, the 2015 Application is moot and the controversy

1289in this proceeding has ceased to exist. Any future Department decision as a result of the

1305in-depth review of JSCH's application or based on recommendations from the site

1317review team were not at issue in this proceeding . There is no further case or controversy

1334in this matter and JSCH's Petition for Formal Administrative Hearing to Contest the

1347Decision to Deny JSCH's Application to Operate a Provisional Level II Trauma Center is

1361moot and should be dismissed.

1366ORDER

1367Based on the foregoing, JSCH's 2015 Application is no longer operative and

1379JSCH's Petition for Formal Administrative Hearing to Contest the Decision to Deny

1391JSCH's Application to Operate a Provisional Level II Trauma Center is dismissed as

1404moot. JSCH has been approved to operate a provisional level II trauma center based on

1419the 2016 Application . This proceeding, the Department's exceptions and Aventura's

1430exceptions are dismissed as moot.
