181PRELIMINARY STATEMENT

183On December 8, 2014, the City of Tampa (City), filed an

194application with the Department of Transportation (Department)

201for a permit to open a public highway - rail grade crossing within

214the City of Tampa over a rail spur owned by CSX Transportation,

226Inc. (CSX) , as part of a planned extension of Bridge Street

237terminating at Tyson Avenue. On September 30, 2015, the

246Department issued a Notice of Intent to Permit the crossing . CSX

258timely filed a Petition for Formal Administrative H earing

267challenging the proposed highway - rail grade crossing .

276On November 18, 2015, the Department referred the petition

285to the Division of Administrative Hearings (DOAH) for assignment

294of an Administrative Law Judge to conduct a disputed - fact

305hearing . On November 23, 2015, New Port Tamp a Bay CDD Holdings,

318LLC , and New Port Tampa Bay CDD (collectively referred to as

329New Port) intervened in the proceeding as the owner of the

340property to be served by the proposed highway - rail grade

351crossing .

353CSX presented the testimony of Thomas Beck Danie l, the

363corporate representative for New Port, and Jacob Smith, the

372corporate representative for CSX. CSX also presented the

380testimony of Richard Ryabik, an expert in traffic engineering.

389CSX Exhibits 1 through 6 were admitted into evidence. Joint

399Exhibi ts 1 through 5 were also admitted into evidence.

409The Department presented the testimony of Calvin Thornton,

417an engineer with the City of Tampa , and Laura Regalado, the

428DepartmentÓs representative and rail specialist. The

434DepartmentÓs Exhibit 1, containing sixteen photographs, was

441a dmitted into evidence.

445New Port presented the testimony of Randy Coen, an expert in

456traffic planning , and Thomas Beck Daniel, its corporate

464representative. New PortÓs E xhibit s 1 through 26 were accepted

475into evidence. New PortÓ s Exhibits 17 through 25 consist of

486train movement videos that are stored on a single flash drive.

497The T ranscript of the disputed - fact hearing was filed with

509DOAH on Marc h 21, 2016. The parties filed P roposed R ecommended

522O rders which were considered by the undersigned.

530FINDING S OF FACT

5341. The Department has authority over public highway -

543railroad grade crossings in Florida, including the authority to

552issue permits for the opening and closing of crossings in

562accordance with s ection 335.141(1)(a), Florid a Statutes (2015), 1/

572and r ule 14 - 57.012.

5782. New Port owns a 52 - acre waterfront parcel (New Port

590parcel) in Tampa, Florida, bordered to the North by Gandy

600Boulevard, the east by Westshore Boulevard, to the south by Tyson

611Avenue and to the west by Tampa Bay , in an area known as

624Rattlesnake Point.

6263. In 2007, the City of Tampa amended its comprehensive

636plan to encourage the redevelopment of Rattlesnake Point from

645i ndustrial to a r esidential/ c ommercial m ixed - u se w aterfront

660c ommunity. The City re - zoned the Ne w Port parcel through PD - A

676Zoning 07 - 48 to authorize redevelopment of the parcel in a manner

689consistent with the comprehensive plan , which include s

697residential, office, commercial , and hotel uses.

7034. CSX owns and operates a rail spur that crosses over

714Ty son Avenue, just west of Westshore Boulevard and then runs

725parallel to the north side of Tyson Avenue (the Henry Spur). CSX

737operates trains, averaging five cars in length, along the Henry

747Spur transporting goods to and from the two remaining industrial

757us ers located on Rattlesnake Point. The trains generally travel

767between 11 p . m . and 5 a . m . , Sunday through Thursday , at a speed

785between five and ten miles per hour. Vehicular traffic is

795stopped by automatic crossbars for approximately one and one - half

806minu tes when the train crosses the intersection at Westshore and

817Tyson.

8185. The Henry Spur prevents public access to the New Port

829parcel from the south at Tyson Avenue. Two private highway - rail

841grade crossings over the Henry Spur allowed construction

849equipme nt to access the New Port parcel from the south during

861land clearing.

8636. As a condition of the New Port re - zoning, the City

876required that Bridge Street, a north - south road located in the

888northern portion of the parcel, be extended to provide a north -

900south corridor through the entire parcel beginning at Gandy

909Boulevard and terminating at Tyson Avenue. PD - A z oning 07 - 48

923provide s, at item 32 , that Ð[t]he property Owner/Developer shall,

933at no cost to the City, construct/reconstruct and extend Bridge

943Street fr om Gandy Boulevard to Tyson Avenue as part of the

955redevelopment of the site.Ñ The re - zoning further provide s that

967Bridge Street would be a public right - of - way, deeded to the City,

982and after obtaining certificates of occupancies for retail,

990office, residen tial and hotel space, Ðthe developer will be

1000required to connect Bridge Street, from Price Avenue to Tyson

1010Avenue, with Transportation approval, across CSX property, at the

1019developerÓs sole expense.Ñ

10227. In 2007, CSX, the Department, the City of Tampa, New

1033Port Tampa Bay CDD, and Ecoventure New Port II, LLC, entered into

1045a Stipulation of Parties (Stipulation) to allow a new public

1055highway - rail grade crossing over the Henry Spur at Bridge Street

1067and Tyson Avenue (Crossing) . The Stipulation authorized the

1076Cr ossing upon the permanent closure of the two private highway -

1088rail grade crossings along the Henry spur , and two public

1098highway - rail grade crossings at 5th Avenue and 35th Street in

1110Tampa, Florida. The Stipulation waived all administrat ive

1118hearing rights p rovided that all covenants of the agreement were

1129met within 24 months of execution of the Stipulation .

11398. The two public crossings were closed in accordance with

1149the Stipulation , but due to changes in the Tampa real estate

1160market, the New Port project did not immediately advance. The

1170crossing at Bridge Street and Tyson Avenue was not constructed

1180within 24 months and the S tipulation expired. Ecoventure New

1190Port II, LLC Ós , interest in the New Port parcel was later assumed

1203by New Port Tampa Bay Holdings and interest in the projectÓs

1214development was re - ignited .

12209. On December 18, 2014, the City of Tampa, submitted a

1231Railroad Grade Crossing Application seeking the opening of a

1240highway - rail grade crossing at Bridge Street and Tyson Avenue ,

1251which is the same lo cation previously authorized by the

1261Stipulation. CSX did not agree to an amended stipulation to

1271allow for the opening of the Crossing.

127810. Laura Regalado has managed the DepartmentÓs rail

1286crossing opening - closure program since August 2014. Ms. Regalado

1296received and reviewed the City of Tampa Ós application for the

1307Crossing.

130811. Ms. Regalado , in February 2015, visited the locations

1317referenced in the application and examined Tyson Avenue where the

1327Crossing was proposed and the two private crossings that were to

1338be closed. The private crossings were unfinished, rough surfaces

1347and had no gates, bells, or flashing lights to warn of oncoming

1359trains. The proposed public Crossing would be required to have

1369an active warning system of gates, bells, and flashing lights.

1379Ms. Regalado concluded that although any new crossing presents a

1389potential danger to the traveling public, the overall safety of

1399the area would be improved by the opening of one gated crossing,

1411in exchange for the closing of two public crossings and the

1422closing of the two unsecured private crossings. To further

1431improve safety in the area, the Department required improved

1440signalization at two additional public crossings as a condition

1449of approval of the Notice of Intent to Permit.

145812. Ms. Regala do also examined three side streets to the

1469west of Westshore Avenue for their potential as alternative

1478access routes to the New Port property. The three streets - Î

1490McElroy, Paul and Price - Î currently accommodate apartments,

1499single - family houses , and light i ndustrial uses. They are narrow

1511side streets ranging from 16 to 18 feet wide, with on - street

1524parking and drainage ditches. Ms. Regalado determined that the

1533streets were not adequate alternative routes as they could not

1543adequately support two - way traffic, construction vehicles, and

1552emergency vehicles.

155413. At buildout, the New Port development is anticipated to

1564have an annual average daily traffic (AADT) count of 16,654

1575vehicles entering and exiting the development. Bridge Street at

1584Gandy Boulevard is ex pected to be a primary access point at the

1597northern portion of the New Port parcel. The Gandy Boulevard and

1608Bridge Street intersection was reconstructed after 2008 to

1616provide westbound traffic accessing the New Port parcel a left

1626turn lane onto Bridge Str eet. Eastbound Gandy Boulevard traffic

1636can turn right onto Bridge Street to access the New Port parcel.

1648Vehicles leaving the New Port parcel from Bridge Street are

1658prohibited from turning left (to go west) , but can make a right

1670onto Gandy Boulevard to tra vel east and can then turn at the

1683signalized intersection at Gandy and Westshore to travel north ,

1692south or west (after making a u - turn) .

170214. For City approval of the New Port project, additional

1712access points were required to accommodate westbound traffic and

1721allow for evacuation and traffic flow. Plans approved by the

1731City required Bridge Street be extended across the Henry Spur to

1742Tyson Avenue as the main north - south thoroughfare for the

1753development. Tyson Avenue is a 24 - foot wide east - west roadway

1766des igned for two - way traffic and heavy vehicles. The corner of

1779Tyson and Westshore meets the criteria for signalization, which

1788would allow controlled turns from Tyson onto Westshore. Once

1797northbound on Westshore, vehicles desiring to proceed in a

1806westbound direction can turn left on Gandy Boulevard.

181415. Westshore Boulevard is approximately a half - mile long

1824between Gandy and Tyson, has one north bound lane, one south

1835bound lane , and a center lane. Northbound traffic on Westshore

1845frequently backs up, even in the middle of the day, from Gandy

1857Boulevard past McElroy, Paul and Price Avenues to as far south as

1869Tyson Avenue. To address some of the congestion, the City has

1880designed and budgeted for a dual left turn lane from Westshore

1891onto Gandy Boulevard. The du al turn lanes will extend south of

1903McElroy Avenue.

190516. The City has classified Westshore Boulevard as a failed

1915roadway because it is unable to accommodate traffic volumes that

1925currently exist. Consequently, the City denied the developerÓs

1933initial reques t to have Price Avenue be a gateway to the

1945development as it would generate additional traffic entering

1953directly onto Westshore Boulevard at an already congested point.

196217. Of the current side streets providing access to

1971Westshore Boulevard between Gandy Boulevard and Tyson Avenue,

1979Paul Avenue will not be extended to connect to the New Port

1991parcel and Hendry Street (referred to as Bridge Street on Google

2002maps) cannot provide public access as it is a private drive with

2014lateral parking . As for McElroy Aven ue, only southbound right

2025turns will be allowed onto Westshore Boulevard due to the

2035installation of the dual turn lanes for northbound traffic on

2045Westshore Boulevard. Price Avenue will accommodate southbound

2052traffic making right turns into and out of the New Port parcel,

2064but spacing requirements prevent placement of a traffic signal at

2074Price and Westshore, so northbound vehicles would have difficulty

2083making a left turn onto Price Avenue . Furthermore, the proximity

2094of Price Avenue to Tyson Avenue, and the near chronic congestion

2105on Westshore Boulevard, would make a left turn leaving Price

2115Avenue onto Westshore Boulevard exceptionally dangerous . Without

2123the Crossing at Tyson Avenue, Price Avenue is expected to have a

2135queue of 16.8 cars waiting to access Wes tshore Boulevard during

2146peak morning hours, and a queue of 23.7 cars during peak

2157afternoon hours.

215918. CSX contend s that an entry point , identified as Retail

2170Drive, to the New Port parcel could be an alternative route

2181instead of the connection at Bridge S treet and Tyson. Retail

2192Drive connects to Westshore Boulevard at the southeastern portion

2201of the New Port p arcel . New Port is under contract to develop a

221612 - acre parcel at that location as a multi - family apartment

2229complex. To access the apartment comple x, the plans contemplate

2239Retail Drive as a gated , private driveway connected to Westshore

2249Boulevard . Due to spacing requirements, traffic signals could

2258not be constructed at both the intersections of Westshore

2267Boulevard and Retail Drive and Westshore Boul evard and Tyson

2277Avenue. Tyson Avenue has already met the requirements for a

2287traffic signal at the Westshore Boulevard intersection and is

2296preferred by the City for signalization because it would serve

2306all of the traffic on Rattlesnake Point, instead of a single

2317development. Absent a traffic signal, vehicles leaving Retail

2325Drive are only permitted to make a right turn to head south on

2338Westshore Boulevard. As only ten percent of the traffic leaving

2348the New Port development is expected to travel south, Reta il

2359Drive, if reconstructed as a through road, would not provide an

2370acceptable alternative route for traffic leaving the New Port

2379development.

238019. The Bridge Street extension over the Henry Spur is

2390essential to the CityÓs plan for redevelopment of the New Port

2401development. The Bridge Street extension provides a north - south

2411corridor parallel to Westshore Boulevard that allows traffic to

2420enter onto Gandy Boulevard to the north and Tyson Boulevard to

2431the south.

243320. CSX agreed to the Crossing in 2007, but no w objects and

2446contends that the situation has changed. Specifically, CSX

2454contends that the amount of rail traffic has increased from an

2465estimated five train movements per week to an estimated ten train

2476movements per week. The trains are still of short du ration, with

2488crossings taking approximately a minute and one - half, twice a

2499night, four or five times a week. CSX also indicates it has felt

2512increased pressure from the Federal Railroad Administration (FRA)

2520to decrease its overall number of crossings in Fl orida. CSX has

2532not approached FRA for its position on allowing this particular

2542crossing to open, and the related offset of the closing of four

2554CSX crossings. CSX expressed concern that they could be subject

2564to FRA fines if the number of crossings is not reduced, but

2576offered no credible evidence in support of this contention.

2585CONCLUSIONS OF LAW

258821 . The Division of Administrative Hearings has

2596jurisdiction over the parties and subject matter of this

2605proceeding. §§ 120.569 and 120.57(1), Fla. Stat.

261222 . T he Department bears the burden of proving by a

2624preponderance of the evidence that the Crossing should be

2633allowed. Dep't of Transp. v. J. W. C. Co. , 396 So. 2d 778 (Fla.

26471st DCA 1981); § 120.57(1)(j), Fla. Stat. A preponderance of the

2658evidence is defined as Ð the greater weight of the evidence, Ñ or

2671evidence that Ð more likely than not Ñ tends to prove a certain

2684proposition. Gross v. Lyons , 763 So. 2d 276, 280 n.1 (Fla.

26952000).

269623. The Department has regulatory authority over all public

2705high way - railroad grade crossings under s ection 335.141(1)(a),

2715Florida Statutes, including the authority to issue permits for

2724the opening of any new crossings.

273024. Rule 14 - 57.012(2)(a) provides , in part , as follows :

2741(a) Opening of Public Railroad - Highway Grade

2749Crossings. In c onsidering an application to

2756open a public railroad - highway grade

2763crossing, the following criteria will apply:

27691. Safety.

27712. Necessity for rail and vehicle traffic.

27783. Alternate routes.

27814 . Effect on rail operations and expenses.

27895. Closure of one or more public railroad -

2798highway grade crossings to offset opening a

2805new crossing.

28076. Design of the grade crossing and road

2815approaches.

28167. Presence of multiple tracks and their

2823effect upon railroad and highway operations.

28298. When the estimated highwa y traffic is

283730,000 vehicles or more a day across main

2846line tracks, an engineering and benefit - cost

2854analysis must be performed by the applicant

2861to determine if a grade separation is

2868warranted.

28692 5 . CSX does not c hallenge the DepartmentÓs determination

2880tha t the proposed Crossing meets the criteria under subsections

2890four through seven of r ule 14 - 57.012(2)(a) . The criteria set

2903forth in subsections one, two, and three are the only items in

2915dispute.

29162 6 . The Crossing satisfies the first criteri on concerning

2927Ð safety . Ñ Regarding the issue of Ðsafety,Ñ it is generally

2940accepted that a ny public railroad - highway grade crossing will

2951present a safety hazard, and that the DepartmentÓs obligation in

2961permitting a new crossing is to ensure that it is as safe as

2974possible, within the bounds of reason. CSX Transp . Inc. v. Dep Ó t

2988of Transp . and Manatee Cnty . , Case No. 06 - 1491 ( Fla. DOAH Nov .

300516, 2006 ; Fla. DOT Dec. 18, 2006 ). T he Department has

3017established that the proposed Crossing will be safe. Bridge

3026Street will cross th e rail line at 90 degrees, which is the

3039preferred angle for the best sight distance. The Crossing is

3049required by the Notice of Intent to Permit to be constructed in

3061accordance with Department d esign s tandards to include a concrete

3072surface, c lass III flash ing lights, automatic gates, and

3082pedestrian gates at the sidewalks.

308727 . The Crossing enhances the overall safety of the

3097impacted area. The closing of two ungated , rough surfaced

3106private crossings increases the safety of the Henry rail spur.

3116The Crossing also provides an alternative evacuation route for

3125Rattlesnake Point should Westshore Boulevard become blocked at

3133Tyson Avenue.

313528 . The Crossing increases vehicle safety in the area by

3146facilitating entry onto Westshore Boulevard through a controlled

3154inter section. Lastly, the Crossing increases safety within Tampa

3163Bay by providing for the closing of two public rail crossings and

3175improved signalization at two other crossings.

318129 . The Crossing satisfies the second criteri on concerning

3191Ð necessity. Ñ A parcel does not need to be landlocked before a

3204crossing will be deemed a necessity. As C hief J udge Cohen noted

3217in CSX Transportation, Inc. v. Department of Transportation , a

3226crossing will meet the criteria for necessity where Ð[t]he

3235opening of the rail crossing will alleviate traffic burdens of

3245[the] County, and fits within the CountyÓs transportation plan

3254for traffic flow and emergency operations.Ñ Id. ¶ 44. The

3264Crossing in this case meets that criteria.

32713 0 . The Crossing satisfies the third criterion concern ing

3282Ðalternative routes.Ñ The Department properly determined that

3289the existing alternative routes , as well as the planned

3298alternative route through a private driveway, are in sufficient to

3308meet th e needs of the new development.

331631. The Department has met its burden of demonstrating that

3326the City of TampaÓs application, which seeks a permit to open a

3338public highway - rail grade crossing as part of the planned

3349extension of Bridge Street terminating at Tyson Avenue , meets the

3359applicable criteria and should ther efore be approved.

3367RECOMMENDATION

3368Based on the foregoing Findings of Fact and Conclusions of

3378Law, it is hereby RECOMMENDED that the Department of

3387Transportation enter a final order approving the opening of a

3397public railroad - highway grade crossing at Bridg e Street and Tyson

3409Avenue in Hillsborough County , Florida.
