139STATEMENT OF THE ISSUES

143Whether Petitioner should be granted a license for a private airport some

155four miles east of Dundee, Florida.

161PRELIMINARY STATEMENT

163Following completion of inspections of the site and a public hearing, the

175Department of Transportation issued Site Approval Order 89-13 to Frank J.

186Drewniany to operate a private airport at Latitude 28 -00'-40" North, Longitude

19881 -31'-40" West, and published notice of this approval and intent to issue a

212license. Intervenor's Pritchard and Hirt, by letters dated June 30 and July 6,

2251989, protested the granting of the site permit and license and requested a

238hearing. This request was forwarded to the Division of Administrative Hearings,

249and these proceedings followed.

253At the hearing, the Applicant called two witnesses, Respondent called no

264additional witnesses, Intervenor called one witness and 9 exhibits were admitted

275into evidence.

277Proposed findings have been submitted by Petitioner. As there is no basic

289dispute as to the operative facts here involved, those proposed findings are

301accepted. Those not included in the findings below were deemed unnecessary to

313the conclusions reached.

316FINDINGS OF FACT

3191. Frank J. Drewniany, Petitioner, is the owner of 153 acres of

331undeveloped land some 4 miles east of Dundee, Florida, which he proposes to

344develop and on which he proposes to operate a private airport.

3552. On October 28, 1988, Petitioner applied for a site permit and license

368for a private airport (Exhibit 1). The application provided the information

379required by statute and the rules of the Department of Transportation (DOT),

391Respondent. This information included evidence of Applicant's right to so use

402the property, a list of airports within 15 miles of the proposed facility,

415mailing addresses of all landowners within 1000 feet of the proposed facility,

427FAA airspace approval and the prescribed fees.

4343. The proposed site was inspected by John Roeller, the Florida DOT

446airport program administrator in the district office having jurisdiction over

456the area. This inspection revealed the site to be adequate for the proposed

469airport; the airport, if constructed, would conform to minimum standards of

480safety; the local zoning was appropriate for the airport; the Applicant had

492provided a list of all airports and municipalities within 15 miles of the

505proposed airport and all property owners within 1000 feet of the proposed

517airport; and that safe air traffic patterns can be worked out for the proposed

531airport.

5324. Following this inspection Roeller, on October 31, 1988, executed the

543prescribed certification that the site is feasible for the proposed use and can

556meet the requirements set forth in Chapter 14-60, Florida Administrative Code

567(Exhibit 5).

5695. By letter dated August 22, 1988, the Federal Aviation Administration

580(Exhibit 6) determined the proposed airport would not adversely affect the safe

592and efficient use of airspace by aircraft if operations are conducted in VFR

605weather conditions and the landing area is limited to private use.

6166. By Notice of Intent to issue site approval dated March 22, 1989

629(Exhibit 7), the DOT published the intent to issue the requested permit and

642advised protestors would be allowed to air their views at a public meeting on

656May 10, 1989.

6597. Following this public meeting, Site Approval Order 89-13 (Exhibit 8)

670was issued, a hearing was requested to contest the issuance of the requested

683license and these proceedings followed.

6888. Intervenors presented evidence of a general concern for the safety of

700residents living in the vicinity of the airport and hearsay evidence regarding

712crashes of private planes in various areas of the United States. No evidence

725was presented by Intervenors to rebut the evidence that the Applicant had

737complied with the requirements for site approval and licensure contained in

748Chapter 14-60, Florida Administrative Code.

753CONCLUSIONS OF LAW

7569. The Division of Administrative Hearings has jurisdiction over the

766parties to, and the subject matter of, these proceedings.

77510. Chapter 330, Florida Statutes (1987), provides, inter alia, for the

786regulation of airports by DOT. Section 330.29(2) directs the department to

797establish minimum standards for airport sites and airports under its licensing

808jurisdiction.

80911. These DOT rules are contained in Chapter 14-60, Florida Administrative

820Code. Rule 14-60.005 establishes rules for airport site approval and general

831licensing requirements. Subsection (8) provides in part:

838(a) Prior to receiving site approval, an

845applicant shall:

8471. Demonstrate that the site is

853adequate for the proposed

857airport.

8582. Demonstrate that the proposed

863airport, if constructed and

867established, will conform to

871minimum standards of safety.

8753. Include documentation evidencing

879local zoning approval by the

884appropriate governmental agency.

887Where there is no local zoning,

893a statement to that fact from an

900official of the appropriate

904governmental agency shall be

908submitted.

9094. Provide the Department a list of

916all airports and municipalities

920within 15 miles of the proposed

926airport and all property owners

931within 1000 feet of the proposed

937airport.

9385. Demonstrate that safe air traffic

944patterns could be worked out for

950the proposed airport.

953(b) All airport sites must be inspected by a

962representative of the Department and a

968written report containing a recommendation

973filed with the Department.

9771. If the inspection shows that the

984site is feasible and can meet the

991requirements set forth in Rule

99614-60.005(8)(a) 1-5 above, the

1000Department shall issue a notice

1005of intent. (emphasis supplied)

100912. Subsection (8) goes on to provide for the public meeting that was held

1023and if, after the public meeting, the Department determines that the proposed

1035airport can comply with the standards set forth in Rule 14-60.005(8)(a) 1-5 and

1048if the Applicant has obtained airspace approval from FAA, the Department shall

1060issue a site approval order.

106513. Here the Applicant has met all of the requirements established by

1077Chapter 14-60, Florida Administrative Code, for site approval for a private

1088airport.

108914. Rule 14-60.006(1), Florida Administrative Code, provides:

1096Upon compliance with all conditions

1101enumerated in the site approval order,

1107a satisfactory final inspection by a

1113representative of the Department, and

1118payment of the required license fee, an

1125airport license shall be issued subject

1131to any conditions deemed necessary to

1137protect the public health, safety, or

1143welfare. (emphasis added)

114615. Petitioner has met all of these requirements.

1154RECOMMENDATION

1155It is recommended that a Final Order be entered granting Frank J. Drewniany

1168a license to operate a private airport at Latitude 28 -00'-40" North and

1181Longitude 81 -31'40" West, subject to restrictions established by the FAA and

1193DOT to insure safe air patterns are established for the proposed private

1205airport.
