97Whether the Department of Transportation (DOT) properly denied Petitioner
106continued participation in the Logo Sign Program.
113PRELIMINARY STATEMENT
115The DOT was advised in writing by Jimmie's Firestone that their posted
127hours of operation had been shortened to less than 16 hours per day, seven days
142per week. By letter dated October 31, 1990, the DOT advised Jimmie's Firestone
155that to be eligible for the Logo Sign Program, a business had to remain open no
171less than 16 hours per day, seven days per week, and that they would be dropped
187as participants in the program. The Department's letter also advised Jimmie's
198Firestone of the right to a formal administrative hearing, which was requested.
210DOT forwarded the case to the Division of Administrative Hearing by letter dated
223November 27, 1990. Notice of the formal hearing was provided on December 12,
2361990 for January 28, 1991; however, Jimmie's requested a continuance until April
2488, 1991 which was granted. The hearing was held on April 8, 1991, pursuant to
263amended notice.
265Although denominated the Petitioner, Jimmie's Firestone already
272participates in the Logo Sign Program, and this hearing is to determine if the
286Department is properly seeking to revoke that privilege. Therefore, the burden
297of proof and persuasion are upon the DOT. The style has not been changed
311because neither party raised the matter before hearing, and it would be
323potentially confusing to alter the style at this point in the proceedings.
335The DOT requested and received an extension of the time to file its
348proposed findings from April 18 until April 30, 1991. The Department timely
360filed its proposed findings which were read and considered. The Appendix
371attached hereto and by reference incorporated herein states which findings were
382adopted and which were rejected and why.
389FINDINGS OF FACT
3921. The Logo Sign Program is a privilege granted to vendors of lodging,
405food, and gasoline in rural areas to advertise on DOT constructed road side
418panels their services on interstate highways. The DOT has established rules in
430accordance with federal guidelines for permitting businesses to advertise their
440services by placing a sign of regulated and uniform size (a logo) on the
454Department's roadside panel (mother board).
4592. Jimmie's Firestone is located in 1the vicinity of the interchange of 1-
47210 and State Road 53, where its logo sign, a red and white Firestone Tire sign,
488is attached to the DOT's gasoline mother board. See Jimmie's Late Filed
500Exhibit, Aerial Photograph of Interchange of 1-10 and SR 53.
5103. Prior to August 20, 1990, Jimmie's Firestone was open not less than 16
524hours per day, seven days per week. Because of a downturn in the economy,
538Jimmie's altered its hours of operation to 8:00 A.M. to 6:00 P.M., or less than
55316 hours per day.
5574. Jimmie's continues to provide "on call" road service 24 hours per day
570through other gasoline vendors at the intersection; one of which is owned by the
584Ragans. "On call" means that Jimmie's Firestone would reopen between 6:00 P.M.
596and 8:00 A.M. to provide tire sales and repair and to sell gasoline, if needed.
611CONCLUSIONS OF LAW
6145. The Division of Administrative Hearings has jurisdiction of the parties
625and subject matter of this dispute; and this order is entered pursuant to
638Section 120.57(1), Florida Statutes. Section 14-85.008(2)(a)(2), Florida
645Administrative Code, provides in pertinent part as follows:
6536. "To be eligible to display a "Gas" logo panel, a business shall 2.
667Operate year-round at least 16 hours per day, seven days a week."
6797. "Operate" is not defined in the rule, but should be given its commonly-
693accepted, everyday meaning. Webster's New World Dictionary, Second College
702Edition, defines "operate" as, "to conduct the affairs of a business" or "to be
716in action so as to produce an effect." The rules provide that a participant in
731the gasoline logo program must provide unleaded gasoline, one or more modern
743restrooms, drinkable water, a public telephone, and an on-premise attendant.
7538. "Operate" in the context of the rule would mandate the availability of
766these services and facilities 16 hours per day, seven days per week. None of
780the aforementioned services or facilities are immediately available as required
790by the rule when the business is "on call." The rule's intent is stymied when
805services and facilities are not immediately available.
8129. Jimmie's Firestone does not meet the minimum requirement to participate
823in the Department's Logo Sign Program.
829RECOMMENDATION
830Based upon the foregoing findings of fact and conclusions of law, it is
843recommended that the permit to participate in the gasoline logo sign program
855issued to Jimmie's Firestone be revoked and its logo removed from the
867Department's roadside panel.
