106STATEMENT OF THE ISSUE
110Whether Respondent should grant Petitioner's application for certification
118as a correctional probation officer.
123PRELIMINARY STATEMENT
125By letter dated August 6, 1993, Respondent's representative informed
134Petitioner that Petitioner's application for certification as a correctional
143probation officer was denied. Petitioner requested a formal administrative
152hearing with regard to Respondent's denial of the application and the matter was
165forwarded to the Division of Administrative Hearings for conduct of further
176proceedings.
177At the formal hearing, Petitioner presented the testimony of one witness,
188herself. Respondent presented no testimony. The parties stipulated to the
198admission of three joint exhibits.
203A final transcript of the proceedings was filed with the Division of
215Administrative Hearings on September 8, 1994. Rulings on proposed findings of
226fact submitted by the parties are set forth in the Appendix to this Recommended
240Order.
241FINDINGS OF FACT
2441. Respondent's Criminal Justice Standards And Training Commission (CJSTC)
253is the governmental agency responsible for the promulgation and implementation
263of uniform training standards and requirements for the position of corrections
274probation officer (CPO). Neither Respondent nor CJSTC is an employer of
285Petitioner.
2862. Minimum curriculum requirements of any training academy are created and
297enforced by CJSTC. One of the minimum curriculum requirements that CPO training
309academies must teach is the Defensive Tactics course. Further, anyone seeking
320certification as a CPO must successfully complete this course. To successfully
331complete the course, the certification applicant must demonstrate proficiency in
341all the high liability skill areas.
3473. CJSTC has created minimum performance requirements within each high
357liability skill area. As authorized by rule, the CJSTC-6 checklist form serves
369as an index and lists the proficiency requirements within each required
380defensive tactic high liability skill area. Every student must successfully
390demonstrate every technique as directed in the curriculum in order to complete
402the Defensive Tactics course.
4064. Petitioner enrolled in a CJSTC-certified basic training academy for
416CPOs. By stipulation of the parties, Petitioner admits that she has not
428successfully demonstrated every high liability defensive tactic skill as
437required by Rules 11B-35.0024, and 11B-35.0022, Florida Administrative Code.
446Petitioner maintains she is unable to demonstrate the required proficiency
456because she has a partial hip and leg bone replacement prosthesis, complicated
468by obesity.
4705. Petitioner did complete all other basic training academy requirements
480and is currently employed as a temporary CPO with the Florida Department of
493Corrections.
494CONCLUSIONS OF LAW
4976. The Division of Administrative Hearings has jurisdiction over this
507matter. Section 120.57(1), Florida Statutes.
5127. Petitioner has the burden of proving by a preponderance of the evidence
525her entitlement to the certification sought in this proceeding. Florida
535Department of Transportation v. J. W. C. Company, Inc., 396 So.2d 778 (Fla. 1st
549DCA 1981).
5518. Section 943.12(17), Florida Statutes, provides CJSTC with exclusive
560authority to:
562Promulgate rules for the certification and
568discipline of officers who engage in those
575specialized areas found to present a high
582risk of harm to the officer or the public at
592large and which would in turn increase the
600potential liability of an employing agency.
6069. Section 943.13(9), Florida Statutes, provides that all applicants for
616certification as a correctional probation officer complete a CJSTC approved
626basic recruit training program.
63010. Requirements of Rules 11B-35.0024, and 11B-35.0022, Florida
638Administrative Code, are unequivocal; successful demonstration of every required
647defensive tactics high liability skill is necessary for certification. By her
658own stipulation and admission, Petitioner fails to meet this requirement.
66811. The gravamen of Petitioner's response to Respondent's denial of
678certification is that Respondent, as a result of following its rules, has failed
691to make accommodation for Petitioner's handicap in the certification process.
70112. Petitioner's argument is more appropriate for consideration within the
711confines of a challenge to an agency's administrative rules, a proceeding
722conducted pursuant to Section 120.56, Florida Statutes, where the Hearing
732Officer exercises final authority. In the instant Section 120.57 proceeding,
742consideration of the merit of Petitioner's application and subsequent
751recommendation to the referring agency is limited to a determination of whether
763the rules were properly applied; not whether the rules are infirm.
77413. Based on the foregoing findings of fact, it is concluded that
786Petitioner has not established her entitlement to certification as a
796correctional probation officer.
799RECOMMENDATION
800Based upon the foregoing Findings of Fact and Conclusions of Law, it is
813recommended that a Final Order be entered denying Petitioner's application for
824certification as a correctional probation officer.
