213STATEMENT OF THE ISSUE

217The issue in this case is whether an Application to the

228South Florida Water Management District for Authority to Utilize

237Works or Land of the District filed by Respondents, Joint

247Facilities Board of River Oaks H.O.A. and Little Oaks H.O.A.,

257should be approved by the South Florida Water Management

266District.

267PRELIMINARY STATEMENT

269Respondents, Joint Facilities Board of River Oaks H.O.A.

277and Little Oaks H.O.A. filed an Application to the South Florida

288Water Management District for Authority to Utilize Works or Land

298of the District. The application was designated Right of Way

308Occupancy Permit Application Number 94-1005-2. After review of

316the application, the South Florida Water Management District

324proposed to approve the application and issue the right of way

335occupancy permit sought by the Joint Facilities Board.

343On or about February 9, 1996, Petitioners in case number

35396-0870, Arthur Pivirotto and Ann H. Pivirotto, filed a Petition

363for Formal Proceedings per 40E-1.521, F1. Admin. Code and 120.57

373F.S. On or about the same date, Petitioners in case number 96-

3850871, Larry Viens, Deborah Viens and The Loxahatchee Landing

394Property Owners Association, Inc., filed a Petition for formal

403Proceedings per 40E-1.521 F. Admin. Code and 120.57 F.S. Both

413petitions challenged the decision to grant the application.

421The South Florida Water Management District filed both

429petitions with the Division of Administrative Hearings on

437February 20, 1996. The petition filed by the Pivirottos was

447designated case number 96-0870. The petition filed by the Viens

457and The Loxahatchee Landing Property Owners Association, Inc.,

465was designated case number 96-0871. Both case were assigned to

475Hearing Officer Joyous D. Parrish.

480By Order of Consolidation entered March 13, 1996, Hearing

489Officer Parrish consolidated the two cases. By Amended Notice

498of Hearing, Hearing Officer Parrish scheduled the final hearing

507of these case for June 27, 1996.

514Both cases were transferred to the undersigned on June 24,

5241996.

525On June 19, 1996, the parties in case number 96-0870 filed

536a Parties' Joint Prehearing Statement. The parties included a

545Statement of Controversy, a Statement of Basic Positions, a list

555of proposed exhibits, a list of witnesses, and a request that

566official recognition of Chapter 373, Florida Statutes, and

574Chapters 40E-6 and 40E-62, Florida Administrative Code, be

582taken. The request for official recognition was granted.

590The parties also stipulated in the Parties' Joint

598Prehearing Statement to the issues of law and fact which the

609parties were in agreement on and the issues of law and fact

621which were in dispute.

625At the commencement of the formal hearing, a Stipulation

634for Settlement was filed in case number 96-0871. Pursuant to

644the Stipulation, the parties in case number 96-0871 resolved

653their dispute. The Stipulation is to take effect "upon adoption

663by and execution on behalf of the Governing Board of the

674District . . . ." The Stipulation is to be submitted to the

687'District's Governing Board . . . at its regulatory meeting

697scheduled for August 15, 1996 (or the next regularly scheduled

707meeting, after the Division of Administrative Hearings

714relinquishes jurisdiction for Governing Board consideration of

721this Stipulation)." The South Florida Water Management District

729requested that jurisdiction over case number 96-0871 be

737relinquished at the same time that this Recommended Order is

747entered. Jurisdiction over case number 96-0871 will be

755relinquished simultaneously with the entry of this Recommended

763Order.

764Both the South Florida Water Management District and the

773Joint Facilities Board filed a Motion to Strike and Motion in

784Limine just prior to the formal hearing. These motions were

794provided to the undersigned at the commencement of the formal

804hearing. The motions suggested that issues of law and fact

814which the parties stipulated remained in dispute involved

822matters over which the South Florida Water Management District,

831and, thus, the Division of Administrative Hearings, had no

840jurisdiction. Respondents requested that those issues and

847disputed facts be struck. After hearing argument of the parties

857on the motions, the motions were granted.

864Following the ruling on the motions to strike and motions

874in limine, Petitioners in case number 96-0870 proffered ten

883exhibits. The South Florida Water Management District proffered

891one exhibit. Petitioners offered no other evidence.

898Prior to the commencement of the formal hearing,

906Respondents, Joint Facilities Board of River Oaks H.O.A., and

915Little Oaks H.O.A., filed a Motion for Attorney's Fees, seeking

925attorney fees from Petitioners. Petitioners filed a Motion for

934Attorney's Fees seeking attorney fees from the Joint Facilities

943Board. After consideration of the motions, they are both

952denied.

953A transcript of the formal hearing was filed on July 17,

9641996. Petitioners and the South Florida Water Management

972District filed proposed orders on or before July 17, 1996.

982Petitioners' proposed order does not contain any proposed

990findings of fact. The South Florida Water Management District's

999proposed order contains two proposed findings of fact. Both

1008proposed findings are hereby accepted.

1013FINDINGS OF FACT

10161. Petitioners, Arthur Pivirotto and Ann H. Pivirotto

1024presented no evidence in this matter.

10302. Petitioners have, therefore, failed to meet their

1038burden of proof that Right of Way Occupancy Permit Application

1048Number 94-1005-2 should not be granted.

1054CONCLUSIONS OF LAW

10573. The Division of Administrative Hearings has

1064jurisdiction of the parties to and the subject matter of this

1075proceeding. Section 120.57, Florida Statutes (1995).

10814. Section 373.085, Florida Statutes, authorizes water

1088management district governing boards to prescribe the manner in

1097which the works and lands of the water management district may

1108be used by others and the issuance of permits therefore. The

1119criteria for such use have been established by the South Florida

1130Water Management District in Rule 40E-6.091, Florida

1137Administrative Code.

11395. The conditions for obtaining a right of way permit of

1150the kind sought by the Joint Facilities Board of River Oaks

1161H.O.A. and Little Oaks H.O.A. have been established in Rule 40E-

11726.301, Florida Administrative Code.

11766. Mr. and Ms. Pivirotto had the burden of proving in this

1188proceeding that the South Florida Water Management District's

1196decision to issue a right of way permit was contrary to the

1208statutes and/or rules governing the issuance of right of way

1218permits and the use of works and lands of the South Florida

1230Water Management District. See Rule 40E-1.544, Florida

1237Administrative Code. See also, Florida Department of

1244Transportation v. J.W.C. Inc. , 396 So. 2d 778 (Fla. 1st DCA

12551981).

12567. The issues raised by Mr. and Ms. Pivirotto in the

1267Parties' Joint Prehearing Statement involved matters and issues

1275which the South Florida Water Management District is not

1284required or authorized to consider pursuant to Chapter 373,

1293Florida Statutes, or Chapters 40E-6 or 40E-62, Florida

1301Administrative Code.

13038. No proof was offered by Mr. and Ms. Pivirotto to

1314support a finding that the decision to issue the right of way

1326permit in this matter is not consistent with the statues and

1337rules governing its issuance and governing the use of works and

1348lands of the South Florida Water Management District.

1356RECOMMENDATION

1357Based upon the foregoing Findings of Fact and Conclusions

1366of Law, it is

1370RECOMMENDED that the South Florida Water Management

1377District enter a Final Order in case number 96-0870 dismissing

1387the Petition for Formal Proceedings Per 40E-1.521 Fl. Admin.

1396Code and 120.57 F.S.

1400DONE and ENTERED this 2nd day of August, 1996, in
