101Whether Petitioner is entitled to claim her late husband's pension benefits

112under the Florida Retirement System.

117PRELIMINARY STATEMENT

119A petition for administrative hearing was filed by Petitioner, Pamela

129Eaves, dated November 11, 1995, requesting that the State of Florida, Department

141of Management Services, through the Division of Retirement, pay Petitioner the

152pension benefits of her late husband, Billy Eaves, under the Florida Retirement

164System. The Department had denied Petitioner those benefits based on its

175decision that Petitioner was not a beneficiary designated by her late husband

187prior to his death and was not otherwise a joint annuitant entitled to receive

201those benefits.

203The Petition for Formal Hearing was forwarded to the Division of

214Administrative Hearings.

216At the hearing, Petitioner testified in her own behalf and introduced the

228testimony of one additional witness. Petitioner also introduced 4 exhibits into

239evidence. Respondent did not call any witnesses, but offered 24 exhibits into

251evidence.

252After the hearing, Petitioner and Respondent submitted their Proposed

261Recommended Orders on August 13, 1996 and August 7, 1996, respectively. The

273parties' proposed findings of fact have been considered and utilized in the

285preparation of this Recommended Order except where such proposals were not

296supported by the evidence or were immaterial, cumulative or subordinate.

306FINDINGS OF FACT

3091. Petitioner, Pamela Eaves, was married to Billy Eaves at the time of his

323death on November 23, 1993. They had been married since November 20, 1983.

3362. Billy Eaves Had been employed by various employers in the Florida

348Retirement System and had in excess of 10 years of creditable service as a

362regular class member of the Florida Retirement System. At the time of his death

376in 1993 Billy Eaves was employed by the Leon County School Board, had

389accumulated 24.04 years of service and was vested in the Florida Retirement

401System.

4023. Upon his initial enrollment in the Florida Retirement System, Mr.

413Eaves, on September 29, 1972, designated JoAnn Eaves, his then wife, as his

426primary beneficiary and Elizabeth and Judy Hardage, his mother and sister,

437respectively, as his contingent beneficiaries. On January 9, 1978, Mr. Eaves

448filed a second designation of beneficiary form, naming JoAnn Eaves as his

460primary beneficiary with no provision for a contingent beneficiary. On June 10,

4721983, prior to meeting Petitioner, Mr. Eaves filed his last designation of

484beneficiary form, naming Peggy Eaves, his sister, as the primary beneficiary

495with Elizabeth and Judy Hardage as the contingent beneficiaries.

5044. After the filing of the last beneficiary designation form, Billy Eaves

516met Pamela Eaves and later married her.

5235. During the 10 years of their marriage, Billy Eaves did not file a new

538designation of beneficiary form even though he assured Petitioner that she would

550receive everything he had. However, the evidence demonstrated that Billy Eaves

561was very much aware of his financial circumstances and the steps necessary to

574ensure his assets would pass to Petitioner. For unknown reasons, Billy Eaves

586failed to take such steps in relation to his pension and some other assets he

601owned.

6026. Billy Eaves died a few month prior to the time he had decided to

617formally retire. He never received any of his retirement benefits. At the time

630of his death none of the beneficiaries Billy Eaves had designated were

642financially dependent on him as is required under Florida law. Therefore, those

654beneficiaries did not receive any of Mr. Eaves retirement benefits.

6647. After his death, Petitioner learned that her husband had not designated

676her as the beneficiary of his pension benefits and that she was not entitled to

691those benefits or a refund of those benefits unless the designated beneficiaries

703disclaimed their rights. To date, even though they cannot receive any of Billy

716Eaves pension benefits, the designated beneficiaries have refused to disclaim

726their rights unless Petitioner pays them a substantial some of money.

737CONCLUSIONS OF LAW

7408. The Division of Administrative Hearings has jurisdiction over the

750parties to and the subject matter of this proceeding. Sections 120.57, Florida

762Statutes.

7639. The Florida Retirement System is governed by Chapter 121, Florida

774Statutes. Section 121.091(8), Florida Statutes, states in part:

782Each member may, on a form provided for

790that purpose, signed and filed with the

797division, designate a choice of one or more

805persons, named sequentially or jointly, as

811his beneficiary who shall receive the

817benefits, if any, which may be payable in

825the event of his death pursuant to the

833provisions of this chapter. If no

839beneficiary designated by the member

844survives him, the beneficiary shall be the

851spouse of the deceased, if living. If the

859member's spouse is not alive at his death,

867the beneficiary shall be the living children

874of the member. If no children survive, the

882beneficiary shall be the member's father or

889mother, if living; otherwise, the bene-

895ficiary shall be the member's estate. The

902beneficiary most recently designated by a

908member on a form or letter filed with the

917division shall be the beneficiary entitled

923to any benefits payable at the time of the

932member's death, except (conditions not

937herein applicable).

93910. Section 121.091(7)(b), Florida Statutes did provide for death benefits

949for members of FRS and stated in part as follows:

959If the employment of an active member who

967may or may not have applied for retirement

975is terminated by reason of his death

982subsequent to the completion of 10 years of

990creditable service and prior to his effective

997retirement date or retirement, if established,

1003it shall be assumed that the member retired

1011as of his date of death in accordance with

1020(subsections of the law). Benefits payable

1026to the designated beneficiary shall be as

1033follows:

10341. For a beneficiary who qualifies as

1041a joint annuitant, the optional form of

1048payment to (section cited).

10522. For a beneficiary who does not qualify

1060as a joint annuitant, no continuing monthly

1067benefit shall be paid and the beneficiary

1074shall be entitled to the return of the

1082member's personal contributions.

108511. Section 60S-4.011(1), Florida Administrative Code, provides as

1093follows:

1094A member may designate a beneficiary, .

1101. . , to receive the benefits which may be

1110payable pursuant to these rules in the event

1118of the member's death. No designation of

1125beneficiary shall be effective unless it has

1132been filed with the Division.

113712. Under Florida law, there is no requirement that a person must

1149designate a spouse as a beneficiary of pension benefits. In fact, a person may

1163designate any person as his or her beneficiary. The sole responsibility for

1175naming or changing beneficiaries of pension benefits rests with the member of

1187the Florida Retirement System.

119113. In this case, Billy Eaves did not designate Petitioner as his

1203beneficiary, but for a period of 10 years permitted his sisters and mother to

1217remain as his beneficiaries. The Department has no authority to substitute

1228another beneficiary before or after the death of the member where that member

1241has not instructed the Department to make such a change. Therefore, Petitioner

1253is not entitled to claim Billy Eaves's pension benefits or a refund thereof.

1320RECOMMENDATION

1321Based on the foregoing findings of fact and conclusions of law, it is

1334RECOMMENDED that the Division enter a final order denying Petitioner's

1344claim to her late husband's pension.
