121STATEMENT OF THE ISSUES

125The issues for disposition are whether BJM Associates, Inc.

134is required to apply for and obtain a drainage connection permit

145pursuant to rule 14-86, Florida Administrative Code, and if so,

155whether BJM Associates, Inc., has failed to obtain that permit.

165PRELIMINARY STATEMENT

167On November 17, 1995, Petitioner, Department of

174Transportation (DOT), issued a notice of violation and notice to

184show cause to Rosetta Villas, c/o BJM Associates, Inc., Winter

194Park, Florida, alleging that the named respondent was required to

204have a drainage connection permit, but had not applied for one.

215Rosetta Villas, through BJM Associates, Inc., requested a formal

224administrative hearing and the case was referred to the Division

234of Administrative Hearings on April 26 1996.

241At the hearing DOT presented the following witnesses:

249Richard Bell, George Merrick and Tony Bryan. DOT offered no

259exhibits.

260Respondent, BJM Associates, Inc., presented the testimony of

268Bernard Martin, Larry Roberts, Larry Smith and Vicki Lee Parker.

278Respondent’s exhibits nos. 1-10 and 12-23 have been received in

288evidence. Respondent’s exhibit no. 24, a videotape of the site

298and Mr. Martin’s explanation, is also received in evidence, over

308Petitioner’s objection. (While viewing this exhibit, the Judge

316accidentally deleted a couple of minutes of the opening. There

326is ample portion left to portray the site, however.)

335On January 4, 1997, Respondent sent to the Administrative

344Law Judge a letter with an accompanying sketch of a ditch, with

356copies to opposing counsel as was appropriate. In response, Ms.

366Ffolkes filed an objection to the sketch and reopening the

376evidence. The sketch, which purports to depict dimensions of the

386ditch at the south perimeter of Rose Pointe, is irrelevant to the

398issue of whether Respondent needs a drainage connection permit,

407and is rejected for that reason. The size of the ditch is not

420controverted in this proceeding.

424The transcript of hearing was filed on January 13, 1997;

434Respondent filed a proposed recommended order on January 27,

4431997.

444FINDINGS OF FACT

4471. Respondent, BJM Associates, Inc. (BJM) is the owner and

457developer of Rosetta Villas Subdivision, located in Orange

465County, Florida, (Respondent’s prehearing Statement)

4702. Petitioner, Department of Transportation (D0T)

476purchased an adjacent parcel, including a retention pond, “Pond

485A”, in 1991, in anticipation of a road-improvement or extension

495project for Maitland Boulevard. The pond was purchased from Rose

505Industrial Park, a permitted development also adjacent to the

514pond.

5153. Rosetta Villas Subdivision received Orange County

522subdivision approval in 1986 and 1988, and a St. John’s River

533Water Management District permit for stormwater facilities in

5411991. Lots have been platted, streets have been constructed and

551homes have been sold.

5554. Rosetta Villas Subdivision includes a water retention

563pond on-site, built in 1995. There is a pipe from that pond

575which discharges water into a ditch that is partially within the

586DOT right of way. The ditch has a 30-inch concrete pipe which

598discharges into DOT’s Pond A.

6035. There is some indication in the record that a diversion

614ditch was part of an over-all permit for the Rose Industrial Park

626development prior to DOT’s purchase of Pond A. The diversion

636ditch was intended to convey stormwater around, and not into Pond

647A. The diversion ditch south of Rosetta Villas and north of Pond

659A does not convey Rosetta Villas’ run off around Pond A. Instead

671the 30-inch concrete pipe conveys Rosetta Villas’ overflow water

680into Pond A.

6836. The 30-inch concrete pipe was constructed by BJM in

6931995 after an existing, much smaller, pipe became clogged. BJM

703contends that the pipe was replaced at the direction of someone

714from DOT. While that contention is not disputed, nothing in this

725record supports any suggestion that DOT is now estopped from

735requiring a drainage connection permit. At hearing BJM’s own

744expert witness opined that the 30-inch pipe which now discharges

754into Pond A requires a connection permit. (Transcript, p. 130)

7647. BJM does not have that permit and, after meetings and

775extensive discussion with DOT staff, has not applied for the

785permit.

786CONCLUSIONS OF LAW

7898. The Division of Administrative Hearings has

796jurisdiction in this matter pursuant to section 120.57(1),

804Florida Statutes.

8069. Rule Chapter 14-86, Florida Administrative Code,

813governs DOT’s requirements for drainage connection permits. Rule

82114-86.001 provides:

82314-86.001 Purpose . The purpose of this

830rule chapter is to ensure safe conditions and

838the integrity of the Department’s

843transportation facilities and to prevent an

849unreasonable burden on lower properties by

855providing standards and procedures for

860drainage connections from the properties

865adjacent to the Department’s right-of-way.

870All Department actions taken pursuant to this

877rule chapter shall be in accordance with

884Section 120, Florida Statutes.

88810. “Drainage Connection” is defined in rule 14-86.002(4),

896Florida Administrative Code,:

900(4) “Drainage Connection” means any

905structure, pipe, culvert, device, paved or

911unpaved area, swale, ditch, canal, or other

918feature whether natural or created which is

925used or functions as a link or otherwise

933conveys stormwater runoff or other surface

939water discharge from the adjacent property to

946the Department’s facility.

94911. “Improvement” is defined in rule 14-86.002(8), Florida

957Administrative Code,:

960(8) “Improvement” means any man-made

965change to property adjacent to the

971Department’s right-of-way made after the

976effective date of this rule chapter.

982[11/12/86]

98312. Improvements that are not exempted in rule 14-

99286.003(1), Florida Administrative Code, must have a drainage

1000connection permit as provided in rule 14-86.003(2), Florida

1008Administrative Code. Exemptions include single family

1014residential improvements that are not part of a larger common

1024plan of improvement or sale; agricultural or silviculture

1032improvements; and other plans of improvement, subject to

1040requirements as to maximum impervious area, no work in a DOT

1051right of way and location in a watershed which has a positive

1063outlet. BJM has failed to prove its entitlement to any of the

1075exemptions; DOT has proved that a permit is required and has not

1087been obtained.

108913. DOT will accept surface water permits that are issued

1099by a water management district or delegated local government

1108provided that the existing permit is based on requirements equal

1118to or more stringent than those described in DOT’s rule 14-

112986.003, Florida Administrative Code. (See rule 14-86.004(6),

1136Florida Administrative Code.)

113914. BJM has presented in this proceeding detailed drawings,

1148engineering calculations, maps and documents regarding its

1155existing permits and permits issued to Rose Industrial Park prior

1165to DOT’s purchase of Pond A. That data and evidence are relevant

1177to conditions for the required permit, but not whether a permit

1188is required. BJM’s representative needs to apply for the permit,

1198and if the permit is denied or granted with conditions, BJM will

1210be given a new “point of entry” to contest that agency action or

1223request a waiver or variance, pursuant to Chapter 120, Florida

1233Statutes (1996). 1/

1236RECOMMENDATION

1237Based on the foregoing, it is hereby, RECOMMENDED:

1245that the Department of Transportation issue its Final Order

1254requiring BJM to apply for a drainage connection permit pursuant

1264to chapter 14-86, Florida Administrative Code.
