174Whether Petitioners are entitled to permit exemption with

182regard to proposed dredging of an existing canal.

190PRELIMINARY STATEMENT

192This matter began on May 21, 1996, whe n Petitioner James

203Bunch requested formal administrative proceedings with regard to

211Respondent's denial of the application for permit exemption filed

220by Petitioner Santa Rosa County.

225Subsequently, the Petition For Administrative Hearing was

232referred to the Division of Administrative Hearings for conduct

241of formal proceedings.

244Final hearing was convened on October 25, 1996, at which

254time counsel for Petitioner Bunch (Bunch) sought, in concert with

264counsel for the Board of County Commissioners of Santa Rosa

274County (County), to amend the initial Petition to include the

284County as a party petitioner. The motion for amendment was

294granted.

295At the final hearing, Petitioners jointly presented the

303testimony of nine witnesses and 16 exhibits of which 15 were

314admitted into evidence. Respondent presented testimony of two

322witnesses and four exhibits, all of which were admitted. A

332transcript of the final hearing was filed with the Division of

343Administrative Hearings on December 3, 1996.

349The parties requested and were granted leave to file

358posthearing submissions more than 10 days after the filing of the

369transcript, and in accordance with Rule 60Q-2.031, Florida

377Administrative Code, waived provisions of Rule 28-5.402, Florida

385Administrative Code.

387The parties’ proposed recommended orders have been reviewed

395and utilized in the preparation of this recommended order.

404FINDINGS OF FACT

4071. Bunch owns a house on a lot leased from the County. The

420lot is located on Navarre Beach Finger Canal Number 2. Bunch

431purchased the house, in part, to use the canal for access to

443Santa Rosa Sound in his pursuit of recreational boating

452activities. If permitted, the opening of the canal will allow

462Bunch to have easier access to his house with his boat. Denial

474of the maintenance dredging exemption to date has impaired

483Bunch’s full use of the property.

4892. The County applied for a permit to dredge and perform

500certain activities to enhance navigability of Navarre Beach

508Finger Canal Number 2 on March 5, 1996. The application was

519submitted by the County on behalf of residents with property

529located on the Canal.

5333. As part of the permit review process, Respondent’s

542personnel determined that the maintenance dredging exemption of

550Section 403.813(2)(f), Florida Statutes was not applicable to the

559requested dredging of a sand bar at the mouth of Navarre Beach

571Finger Canal Number 2.

5754. Navarre Beach Finger Canal Number 2 is a man-made water

586body meeting the definition of the term “canal” contained in

596Rule 62-312.050(3), Florida Administrative Code.

6015. As documented by evidence presented at the final

610hearing, Navarre Beach Finger Canal Number 2 is currently

619navigable and functional. The Canal is accessed and navigated by

629different types of recreational water craft, inclusive of a 23

639foot pleasure craft with a two and a half foot draft, john

651boats, jetskis and a 27 foot Rendezvous Bayliner Boat. The

661average size of recreational residential boats in Florida is 23

671feet. During the 1960’s, the Canal was open and accessed by

682similiar fishing and pleasure boats.

6876. Navarre Beach Finger Canal Number 2 has progressively

696widened and deepened in recent years. Plugged from at least 1970

707until 1992, the Canal was opened by the natural event of

718Hurricane Opal which removed a solid sand dune separating the

728Canal from Santa Rosa Sound. Recent measurements establish that

737the Canal depth is three feet at the mouth where the sand bar is

751located, 12 feet just inside the sand bar, and then varying

762depths ranging between four to seven feet for the length of the

774Canal. At the lowest tide conditions, the depth at the sand bar

786is approximately one and one half feet and increases to four feet

798or more at high tide.

8037. The mouth of Navarre Beach Finger Canal Number 2 since

814Hurricane Opal varies from 40 to 50 feet in width at high tide to

828six to ten feet wide at the lowest tide conditions.

8388. Water depths in Santa Rosa Sound and connected waters

848vary with tide stage and time of year. Average water depth in

860the Sound in the area of Navarre Beach Finger Canal Number 2 is

873five to six feet. Sometimes, on a winter low tide, one can walk

886100 feet out into the Sound and still be on dry land. During a

900four to five consecutive day period in August of 1996, mid (not

912high or low) tide yielded a depth of three feet at the sand bar

926across an area of 10-20 feet at the mouth of the Canal.

938Extremely low tide conditions were observed by Respondent’s

946employee on an October 14, 1996 inspection of the area which

957revealed an estimated depth of one and a half feet at the mouth

970of the Canal across an area of approximately six feet. Under

981average conditions, the mouth of the Canal corresponds to the

991August 1996 measurements with a 10 to 20 width and a three foot

1004depth at the sand bar.

10099. Navarre Beach Finger Canal Number 2 is not presently

1019closed and regularly exchanges water with Santa Rosa Sound.

102810. Constructed sometime between 1962 and 1964, Navarre

1036Beach Finger Canal Number 2 was originally dredged all the way

1047to Santa Rosa Sound. There was no sand bar at the mouth. The

1060Canal was fully navigable and freely accessed by fishing and

1070pleasure boats from the Sound. Historical plats, engineering

1078drawings, plats and survey drawings corroborate testimony of

1086witnesses at the final hearing that the Canal was open and

1097functional in the 1960’s and 70’s and was maintained.

110611. Between 1972 and 1984, sand accumulated at the mouth of

1117Navarre Beach Finger Canal Number 2. There was a periodic flow

1128between the Canal and the waters of Santa Rosa Sound and pumping

1140or dredging of sand took place. Generally, this ongoing

1149maintenance was accomplished informally without permits or

1156written authorization. Boats occasionally went in and out of the

1166Canal. Over the years following 1980, the flow decreased but

1176there was always some water flowing in and out of the Canal in

1189connection with the waters of the Sound.

119612. In the early to mid 1980’s approximately 900 feet of

1207the sides and bottom of Navarre Beach Finger Canal Number 2 were

1219dredged, but sand at the mouth of the Canal was left alone. A

1232permit exemption for the purpose of maintenance dredging of the

1242Canal was previously granted in 1980.

124813. Barrier island shorelines, such as Santa Rosa Island,

1257change frequently and are considered to be “dynamic areas”. If

1267considered to be maintenance dredging, the removal of the sand

1277bar at the mouth of Navarre Beach Finger Canal Number 2

1288qualifies as a typical, routine type of maintenance common in

1298this type of coastal setting.

130314. Petitioners maintain that the proposed maintenance

1310dredging activity will be conducted so that all the spoil

1320material will be placed on an upland disposal site without any

1331discharge of materials into waters of the State of Florida; will

1342be accomplished only to the extent necessary to restore Navarre

1352Beach Finger Canal Number 2 to it’s previously dredged design and

1363without any dredging below five feet of the mean low water line;

1375will have no adverse effect on fish and wildlife conservation,

1385including endangered or threatened species; will not adversely

1393affect navigation or flow of water; will not cause harmful

1403shoaling or erosion results; will not affect fishing,

1411recreational values or marine productivity in the vicinity; will

1420have permanent results with regard to functionality of the Canal;

1430and will not adversely affect significant historical or

1438archaeological resources or the current condition in relative

1446value of functions being performed in the areas affected by the

1457proposed activity.

145915. Petitioners’ application for exemption from the

1466dredging permit process addressed matters other than the

1474maintenance exemption sought in this proceeding. As established

1482by testimony at the final hearing, those activities will not be

1493conducted as part of the proposed maintenance dredging exemption.

150216. Dan Garlick, Petitioners’ expert in water quality,

1510coastal ecology, and marine contracting, supervised the

1517preparation of a December 8, 1995 report of the hydrographic

1527conditions at Navarre Beach Finger Canal Number 2. The purpose

1537of the report was to estimate the flushing potential of the Canal

1549when opened. By comparing present conditions in the adjacent and

1559similar Navarre Beach Finger Canal Number 1 to anticipated post

1569dredge conditions in Navarre Beach Finger Canal Number 2, a

1579“worst case scenario” documented in the report shows a flushing

1589time of 5.9 hours for Navarre Beach Finger Canal Number 2. This

1601is an exceptional flushing time.

160617. 1995 and 1996 water quality sampling in Navarre Beach

1616Finger Canal Number 2 reveals that the Canal water generally

1626exceeds applicable class III standards. Bacteria counts in Santa

1635Rosa Sound have exceeded those found in the Canal.

164418. Removal of the remainder of the sand barrier at the

1655mouth of Navarre Beach Finger Canal Number 2 will result in a

1667water quality as good as that in nearby Navarre Beach Finger

1678Canal Number 1--a quality that meets all applicable state

1687standards. Degradation of water quality of waters of the State

1697of Florida will not result from opening of Navarre Beach Finer

1708Canal Number 2.

171119. Sailmaker Cove Canal is situated approximately 3 miles

1720from Navarre Beach Finger Canal Number 2 and opens into Santa

1731Rosa Sound. From 1989 until the permitting of maintenance

1740dredging in 1993 or 1994, there was no exchange of water between

1752Sailmaker Cove Canal and Santa Rosa Sound. In that instance,

1762Respondent’s personnel determined that a maintenance dredging

1769exemption was appropriate.

177220. Petitioner James Bunch is included in the list of

1782affected property owners whose names and addresses were included

1791with the application to Respondent for permission to conduct the

1801dredging activity which is the subject of this proceeding.

1810Petitioner Bunch and Petitioner Santa Rosa County Commission have

1819standing to bring this proceeding.

1824CONCLUSIONS OF LAW

182721. The Division of Administrative Hearings has

1834jurisdiction over this subject matter and the parties to this

1844action pursuant to Section 120.57(1), Florida Statutes.

185122. Bunch, as an owner of a residence on Navarre Beach

1862Finger Canal Number 2 with substantial interests which may be

1872affected by Respondent’s agency action with regard to the pending

1882application for permit dredging exemption, and Petitioner Santa

1890Rosa County Commission have standing to bring this proceeding.

189923. Navarre Beach Finger Canal Number 2 is presently

1908navigable and functional as evidenced by current usage of the

1918Canal by watercraft of various sizes. Respondent argues that

1927granting the requested permit will allow dredging for restoration

1936as opposed to maintenance of the Canal. Respondent has not

1946defined the term “restoration” in its administrative rules.

1954Respondent’s argument would be more persuasive absent the

1962intervention of natural forces which have opened the Canal to

1972navigation. The Canal’s present navigability is well documented

1980by the proof presented at the final hearing.

198824. The determination of applicability of the maintenance

1996dredge exemption depends upon the functionality of the canal at

2006issue. This determination is made on a case-by-case basis.

205125. The requisite facts necessary to obtain the proposed

2060maintenance dredging exemption available pursuant to Rule 62-

2068312.050(1)(e), Florida Administrative Code, are established.

2074Navarre Beach Finger Canal Number 2 was dredged prior to 1970; is

2086of artificial construction; only a small portion of the Canal at

2097the mouth requires maintenance dredging at present; spoil

2105material will be removed and deposited on a self-contained upland

2115spoil site; dredging will be limited to the rule’s requirements;

2125and pollutant discharges into waters of the State will be

2135prevented during dredging.

2138RECOMMENDATION

2139Based upon the foregoing findings of fact and the

2148conclusions of law, it is,

2153RECOMMENDED :

2155That a final order be entered granting the requested

2164maintenance dredging exemption.
