134STATEMENT OF THE ISSUE

138Whether the application of Respondent Gulf County (County)

146for permit to install a beach access road, constructed of oyster

157shell or dolomite, at the stumphole area on Cape San Blas should

171PRELIMINARY STATEMENT

173This matter began August 17, 1996, when Petitioner Michael

182Paulsson requested formal administrative proceedings with regard

189to issuance of a field permit for a beach access road to the

202County by Respondent Department of Environmental Protection

209(DEP).

210Subsequently, the Petition For Administrative Hearing was

217referred to the Division of Administrative Hearings for conduct

226of formal proceedings.

229Final hearing was convened on April 18, 1997, at which

239Respondents jointly presented the testimony of two witnesses and

248three exhibits which were admitted into evidence. Petitioner

256testified in his own behalf and presented one composite exhibit

266which was admitted into evidence. No transcript of the final

276hearing was provided.

279The parties’ proposed recommended orders have been reviewed

287and utilized in the preparation of this recommended order.

296FINDINGS OF FACT

2991. On April 11, 1996, th e County applied for a permit from

312DEP to install a beach access road constructed of oyster shell or

324dolomite over an area 275 feet in length by 12 feet wide at the

338stumphole area on Cape San Blas. The County owned the property

349at the site where a crude road bed to the beach already existed.

3622. On that same date, County Manager Donald Butler met with

373a DEP field engineer, William Fokes, on the site to determine the

385linear footage that would be necessary for the access road at the

397stumphole area. Fokes then issued the field permit for the

407access road to be constructed of oyster shell or dolomite over an

419area 275 feet in length by 12 feet wide.

4283. Since beach driving is permitted by the County in the

439area, the access road aids in preventing illegal crossing of

449beach dunes by motorists to get to the beach. Prior to issuance

461of the field permit and construction of the access road, the only

473legal motorist access to the beach was seven miles away.

4834. Permits to drive on the beach are issued by the County .

496DEP rules require that all applicants proposing to conduct

505permitted activities on a beach use a designated beach access.

515This road will allow access to conduct permitted activities,

524thereby preserving and enhancing public beach access.

5315. DEP will not permit a project that is expected to

542adversely impact the beach dune system. Although seaward of the

552Coastal Construction Control Line (CCCL) in the County, the area

562which is the subject of this field permit contained no dunes or

574vegetation since Hurricane Opal had flattened the area.

5826. Such a project cannot be permitted if the project will

593adversely impact existing upland property or property of others.

602In the instant case, neither the Petitioner’s property, which is

612located two miles away from the project site, or property of

623other owners in the area will be adversely impacted.

6327. The road is designed to be a non-rigid, pervious

642structure which causes less impact to any existing dune system.

652The road site is located on County property and provides logical

663and appropriate access.

6668. The construction of the road did not violate DEP

676prohibitions on permitting activities having adverse impact to

684marine turtles since the construction permit expired prior to the

694turtle nesting season.

6979. A requirement of field permit issuance is that the

707applicant and the DEP area engineer meet on site and review the

719project. This event occurred on April 11, 1996, when Butler and

730Fokes met on the site. Fokes determined that the project was

741within field permitting guidelines and issued the permit.

74910. Fokes was authorized to issue the field permit because

759the project fell in DEP’s category of a driveway or similar

770activity. Expected impacts of construction of the access road

779and a driveway are deemed similar by DEP.

78711. Subsequent review by DEP staff of Fokes’ issuance of

797the field permit determined that sufficient information had been

806provided to him for issuance of the permit, that the project

817falls in the category of minor activity and that no adverse

828impact to dunes, property of others, beach access or nesting

838marine turtles is expected.

842CONCLUSIONS OF LAW

84512. The Division of Administrative Hearings has

852jurisdiction over this subject matter and the parties to this

862action pursuant to Section 120.57(1), Florida Statutes.

86913. The County, as applicant for the permit, has the

879ultimate burden of proof in demonstrating entitlement to subject

888permit. Department of Transportation v. J.W.C. Company, Inc. ,

896396 So. 2d 778 (Fla. 1 st DCA 1981).

90514. Permits are required for construction seaward of the

914CCL. Section 161.053, Florida Statutes.

91915. The applicant has demonstrated compliance with special

927siting and design criteria contained in Section 161.053, Florida

936Statutes, and Rule 62B-33.005, Florida Administrative Code,

943requiring that the project ensure protection of the beach dune

953system, proposed or existing structures, adjacent properties and

961preservation of public beach access.

966RECOMMENDATION

967Based upon the foregoing findings of fact and the

976conclusions of law, it is,

981RECOMMENDED:

982That a final order be entered confirming the grant of the

993field permit which is the subject of this proceeding.
