116STATEMENT OF THE ISSUE
120The issue is whether Respondent violated Sections
127455.227(1)(q), 455.227(1)(f), and 464.018(a)(b), Florida
132Statutes, and Rule 64B9-8.005(1)(b), Florida Administrative
138Code, by a denial of an application in another state.
148PRELIMINARY STATEMENT
150By Administrative Complaint, Petitioner alleged that on
157June 6, 1996, Virginia denied Respondents application for a
166nursing license on the grounds of Respondents alleged
174diversion of controlled substances and unprofessional conduct.
181On this basis, Petitioner sought to discipline Respondents
189Florida nursing license. Respondent denied the material
196allegations and demanded a formal hearing.
202At the hearing, each party called one witness.
210Petitioner offered into evidence two exhibits, which were
218admitted.
219The court reporter filed the transcript on December 24,
2281997.
229FINDINGS OF FACT
2321. At all material times, Respondent has been licensed
241as a registered nurse in Florida, holding license number RN
2511446212. She has been so licensed for 14 years. Her home
262address is in Plattsburg, New York.
2682. For most of her career, Respondent has worked as a
279traveling nurse and is licensed in at least six states. In
290this capacity, Respondent has been employed by an agency and
300assigned to various temporary assignments around the country.
3083. At one point, Respondent worked as a traveling nurse
318in Virginia. Using a temporary nursing license, Respondent
326worked for one week at a Virginia hospital. She had intended
337to work the typical 6-13 weeks. However, she returned home
347prematurely following an incident at the hospital to which she
357had been assigned.
3604. There had been a problem with diverted controlled
369substances at this hospital prior to Respondents arrival.
377After a few days on the job, someone accused Respondent of
388diverting controlled substances, and the hospital
394administration suspended Respondent without pay. Under her
401agency arrangement, Respondent did not have to pay her lodging
411expenses. However, as a result of the suspension, she was
421left with this expense and no income to pay it, so she readily
434returned home and, at some point, accepted another assignment.
443She never learned of any adverse action taken against her in
454Virginia for the alleged incident at the hospital.
4625. Unknown to Respondent, her application for a
470temporary license in Virginia automatically constituted an
477application for a permanent license. Although Respondent
484received no prior notice of the Virginia nursing boards
493action, the board eventually denied her licensure on the basis
503of the alleged incident at the hospital.
5106. Petitioner presented this case on the basis of the
520license denial of the Virginia board of nursing. The evidence
530in this record does not establish that Respondent committed
539the acts of which she was accused at the Virginia hospital.
550Moreover, the evidence in this record establishes that
558Respondent did not receive notice and an opportunity to be
568heard on the Virginia charges prior to or following the
578Virginia license denial.
581CONCLUSIONS OF LAW
5847. The Division of Administrative Hearings has
591jurisdiction over the subject matter. Section 120.57(1),
598Florida Statutes. (All references to Sections are to Florida
607Statutes. All references to Rules are to the Florida
616Administrative Code.)
6188. Section 455.227(1)(f) authorizes discipline for
624[h ]aving a license to practice nursing revoked, suspended, or
634otherwise acted against, including the denial of licensure, by
643the licensing authority of another state, territory, or
651country.
6529. Rule 64B9-8005(1)(b) provides that the Board of
660Nursing shall impose discipline upon a determination that a
669licensee has had disciplinary action taken against a nursing
678license by another jurisdiction.
68210. Under the Due Process Clause of the Fourteenth
691Amendment to the U.S. Constitution, no state may revoke a
701licensees property right in his or her license without due
711process of law. Section 455.227(1)(f) implicitly requires
718that the adverse action by another jurisdiction comply with
727the requirements of due process, such as notice and an
737opportunity to be heard. Due process is insufficient if it
747merely ensures notice and an opportunity to be heard as to the
759Florida charges, if they are based on another jurisdictions
768disciplinary action, when the licensee shows, as has
776Respondent in this case, that the disciplinary action taken in
786the other jurisdiction did not comply with the requirements of
796due process.
798RECOMMENDATION
799It is
801RECOMMENDED that the Board of Nursing enter a final order
811dismissing the administrative complaint.
