173Whether the application of Martin Memorial Medical Center,

181Inc., to establish a 15-bed hospital-based skilled nursing unit

190meets the criteria for the issuance of a certificate of need.

201PRELIMINARY STATEMENT

203In April 1997, the Agency for Health Care Administration

212(AHCA) published a need for 15 hospital-based skilled nursing

221beds in District 9, Subdistrict 2, for Martin County. In

231response, Martin Memorial Medical Center (Martin Memorial), the

239only acute care hospital in the C ounty, filed certificate of need

251(CON) application number 8847. If issued the CON, Martin

260Memorial will establish the 15-bed SNU at its northern and larger

271campus in the City of Stuart.

277AHCA preliminarily denied the issuance of CON 8847 because

286Martin Memorial failed to include in its proposal the conversion

296of at least the same number of acute care beds to accommodate the

309SNU beds. After reviewing Martin Memorial's occupancy data by

318department, AHCA filed a notice that it had changed its position

329and, at the final hearing, supported the approval of Martin

339Memorial's CON application.

342In two separate proceedings, Integrated Health Services of

350Central Florida, Inc., d/b/a Integrated Health Services of Vero

359Beach (IHS) and Healthsouth of Treasure Coast, Inc., d/b/a

368Healthsouth Treasure Coast Rehabilitation Hospital (Healthsouth),

374filed petitions supporting the preliminary action of AHCA, the

383denial of CON 8847. Martin Memorial filed a Motion in Opposition

394to the petitions and a Motion to Consolidate the separate cases

405into one proceeding. After a hearing on the motions, the cases

416were consolidated, and the Petitions for Formal Administrative

424Hearings were treated as petitions to intervene and were both

434granted on December 16, 1997. Prior to the final hearing, IHS

445voluntarily dismissed its petition.

449In the Prehearing Stipulation, Martin Memorial withdrew its

457Motion to Dismiss IHS, and its Request for Official Recognition

467and Notice of Intention to Seek Sanctions against IHS, but not

478against Healthsouth. Martin Memorial requested official

484recognition of various petitions filed by Healthsouth in other

493DOAH Cases. Martin Memorial also argued that Healthsouth has no

503standing because it is licensed as a comprehensive medical

512rehabilitation (CMR) hospital, not a SNU. Martin Memorial noted

521that the need methodology applicable to CMR beds is different

531from that for SNU beds. Martin Memorial also denied

540Healthsouth's claim that it will suffer a substantial injury-in-

549fact if Martin Memorial establishes a 15-bed SNU. In a response

560filed on January 12, 1998, Healthsouth argued that differences in

570licensure and need methodology are not determinative of standing,

579and that it will suffer an injury-in-fact if CON 8847 is issued.

591AHCA agreed with Healthsouth that it should have an opportunity,

601despite licensure and need methodology differences, to

608demonstrate at hearing that it has standing. Therefore, ruling

617was reserved on Martin Memorial's Motion to Dismiss Healthsouth

626for lack of standing until factual issues related to an injury-

637in-fact were resolved, and on Martin Memorial's Request for

646Official Recognition and Notice of Intention to Seek Sanctions.

655Healthsouth also filed, on January 12, 1998, a Motion for

665Summary Recommended Order dismissing Martin Memorial, alleging

672that AHCA's publication of a 15-bed fixed need pool was invalid

683and should have been zero. According to Healthsouth, AHCA used a

694proposed rule which included a provision that it would not apply

705to a batching cycle until after the effective date of the rule.

717The proposed rule was also apparently being challenged by

726National Healthcare, L.D., according to Healthsouth, and it was

735expected that Healthsouth would file a Motion to Consolidate that

745case with this one, but it did not.

905Healthsouth's Motion for Official Recognition presented

911disputed legal but not factual issues, and based on the case law,

923the motion is granted. See e.g. Department of Legal Affairs v.

934District Court of Appeal, 5th District , 434 So. 2d 310

944(Fla.Sup.Ct. 1983), and Daoud v. Matz , 73 So. 2d 51 (Fla.Sup.Ct.

9551954).

956In the Prehearing Stipulation, the parties agreed that the

965disputed issues of fact in this proceeding are those in the

976following statutory and rule criteria: Subsections

982408.035(1)(a), (b), (d), and (l), and (2)(a)-(c), all generally

991related to need, alternatives and adverse impact; Subsections

999408.035(1)(h) and (n) -- related to accessibility for all

1008residents and past and proposed Medicaid services; Subsections

1016408.035(1)(m) and Chapter 59A-3 -- on construction methods and

1025code requirements; and Subsection 408.035(1)(o) -- on a

1033multilevel continuum of care.

1037At the final hearing, Martin Memorial presented the

1045testimony of Gary Uber, who is responsible for social services

1055and discharge planning at Martin Memorial; Joseph Edward Witek,

1064expert in health care finance; Edward L. Hengtgen, Jr., expert in

1075health care architecture; Christopher Coffey, expert in health

1083care planning; and Judith L. Horowitz, expert in health care

1093planning and health care finance. Martin Memorial's Exhibits 1

1102through 30 were received into evidence.

1108AHCA presented the testimony of Elfie Stamm, expert in

1117health care planning. AHCA Exhibits 1 through 3 were received in

1128evidence. By deposition, submitted after the formal hearing,

1136AHCA also presented the testimony of Charles L. Alby, an

1146architect. With the agreement of the parties, the Alby

1155deposition was accepted as AHCA Exhibit 4.

1162Healthsouth presented the testimony of Denise McGrath,

1169expert in nursing and rehabilitation hospital administration;

1176Armand Balsano, expert in health care planning and health care

1186finance; and Rick Knapp, expert in health care finance and health

1197care accounting. Healthsouth proffered, in view of the objection

1206by Martin Memorial, the testimony and resume (as its Exhibit 10)

1217of Luis Vivar, an expert in health care architecture, who was not

1229listed on Healthsouth's witness list. Ruling was reserved on the

1239admissibility of the proffered testimony. Healthsouth's Exhibits

12461 through 18, 20, and 21 were received into evidence.

1256The transcript of the final hearing was filed on February 2,

12671998. Proposed recommended orders were filed on February 12,

12761998.

1277FINDINGS OF FACT

12801. The Agency for Healthcare Administration (AHCA) is the

1289state agency which administers the certificate of need (CON)

1298program for health care services and facilities in Florida. On

1308April 18, 1997, AHCA published a need for a 15-bed hospital-based

1319skilled nursing unit (SNU) in District 9, Subdistrict 2, for

1329Martin County. Because the beds will be in a hospital, they will

1341be licensed under Chapter 395, Florida Statutes. By contrast,

1350freestanding, nursing facilities are licensed, pursuant to the

1358provisions in Chapter 400, Florida Statutes.

13642. Since it is the only acute care hospital in the C ounty,

1377Martin Memorial Medical Center, Inc., d/b/a Martin Memorial

1385Medical Center (Martin Memorial) applied for the CON to establish

1395the 15-bed hospital-based SNU. Martin Memorial has 336 beds

1404located on two separate campuses in Martin County. A satellite

1414facility which has 100 beds, Martin Memorial South, is located in

1425Port Salerno. Port Salerno is approximately 10 to 12 miles south

1436of the City of Stuart. Martin Memorial also owns a 120-bed

1447nursing home on the Port Salerno campus, Martin Nursing and

1457Restorative Care Center (Martin Nursing Center). The facility

1465includes a 40-bed subacute unit. Martin Nursing Center is

1474operated by a long-term care company, Eden Park Management, Inc.

1484Martin Memorial North, the larger, 236-bed hospital in Stuart, is

1494the proposed location of the SNU. The SNU renovation project

1504will cost approximately $242,000, and will occupy space which is

1515currently used for outpatient services.

15203. AHCA preliminarily denied the CON application due to

1529Martin Memorial's failure to propose to delicense and convert

1538acute care beds to establish the SNU. AHCA withdrew its

1548objection to the issuance of CON 8847 after reviewing occupancy

1558levels by department at Martin Memorial.

15644. AHCA published the applicable fixed need pool in

1573April 1997 1 , which was calculated using proposed Rule 59C-1.036,

1583published on February 7, 1997. 2 Notice was given of the only

1595challenge to the proposed rule which was filed by National

1605Healthcare, L.P. 3 and subsequently dismissed. No motion to

1614consolidate that case with this one was ever filed.

16235. Healthsouth of Treasure Coast, Inc., d/b/a Healthsouth

1631Treasure Coast Rehabilitation Hospital (Healthsouth) is a 90-bed

1639rehabilitation hospital in Vero Beach, Indian River County,

1647approximately 60 miles north of Martin Memorial North.

1655Healthsouth is also in AHCA, District 9, but not in

1665Subdistrict 2. In District 9, St. Lucie County is on the east

1677coast, adjacent to Indian River County to the north, Martin

1687County to the south, and Okeechobee County to the west. The four

1699counties in District 9 are north of Palm Beach County, the only

1711other county in the D istrict.

17176. The hospital-based SNUs in the four northern counties in

1727District 9 are:

1730Port St. Lucie Hospital, in St. Lucie County,

1738which has 150 beds and a 15-bed SNU, with CON

1748approval for 9 more SNU beds;

1754Lawnwood Regional Medical Center, also in St.

1761Lucie County, which has 260 beds and a 33-bed

1770SNU;

1771Indian River Memorial Hospital, located

1776within a mile of Healthsouth in Indian River

1784County which has approximately 320 beds and a

179220-bed SNU and approval for 8 more SNU beds;

1801Sebastian Hospital, in Indian River County,

1807which has between 100 and 150 beds and has

1816recently been approved for 9 SNU beds; and

1824Raulerson Hospital, in Okeechobee County,

1829which has 101 beds including SNU.

18357. Healthsouth identifies its primary service areas as

1843Indian River, St. Lucie, and Martin Counties. Healthsouth

1851generally attracts 60 percent of its patients from Indian River

1861County, 20 percent from St. Lucie, and 15 percent from Martin

1872County. Patients are referred from both Martin Memorial North

1881and South. Healthsouth asserted that a 15-bed SNU at Martin

1891Memorial will compete with Healthsouth, resulting in a loss of

1901patients in sufficient numbers to cause a substantial adverse

1910impact on Healthsouth.

19138. Healthsouth's expert in health care planning and finance

1922examined national acute care discharges as compared to the

1931percentage of those cases which typically have follow-up subacute

1940care. Using discharge data by Diagnostic Related Group (DRG),

1949the expert quantified the percentages of subacute cases which can

1959receive services in either a CMR hospital or a skilled nursing

1970facility. Based on an estimate that 75 to 90 percent of the

1982overlapping DRGs would be redirected to Martin Memorial,

1990Healthsouth projected a loss ranging from 55 to 66 cases when

2001applied to 1997 annualized data.

20069. The three largest categories of referrals from Martin

2015Memorial are stroke, orthopedics, and rehabilitation, which

2022account for 85 percent of total admissions to Healthsouth. The

2032payer group from the three categories was used to determine the

2043financial impact, using the midpoint of the projected loss of 60

2054cases or 900 patient days. The financial loss per case is the

2066difference between net revenue per patient day of $458 and the

2077variable expenses per patient day of $295, or $163. Given an

2088incremental net income per adjusted patient day of approximately

2097$163, the projected loss of 900 patient days a year, and an

2109assumed 15-day average length of stay, Healthsouth projects a

2118loss of approximately $150,000 a year in revenues if a 15-bed SNU

2131is established at Martin Memorial.

213610. In 1995, the only hospital-based SNU in Healthsouth's

2145service area was at Lawnwood. The SNU at Raulerson opened in

2156April 1996, followed by Port St. Lucie in November 1996, and

2167Indian River Memorial in May 1997. In addition, the new CMR

2178program was developed at Lawnwood, while the unit at St. Mary's

2189Hospital in West Palm Beach was expanded during 1997. By January

22001998, Healthsouth reached full capacity, or an average daily

2209census in the range of 84 to 89 patients in 90 beds.

2221Healthsouth's medical director believes that it would have

2229reached full capacity much sooner after its 20-bed expansion in

2239mid-August 1997, but for the competition from the hospital-based

2248SNUs. The expansion of Healthsouth has accomplished the

2256objective of eliminating a 15-to-20 person waiting list which

2265existed when it was a 70-bed facility.

227211. The average daily census (ADC) at Lawnwood, in 1995,

2282was 31.1 patients in 33 beds. By the end of 1995, the average

2295daily census at Healthsouth was 69.9 patients in 70 beds. From

2306January 1996 to July 1997, the ADC in Raulerson's 12-bed SNU

2317increased from 5.6 patients to 8.1. After Raulerson's SNU beds

2327became available, the ADC of Healthsouth continued in the 68 to

233869 range in 70 beds, indicating that Healthsouth was full. When

2349Port St. Lucie's 15 SNU beds opened during the last two months of

23621996, its ADC of 3.9 patients in 1996 increased to 13.5 for the

2375first seven months of 1997. From the time Port St. Lucie's SNU

2387became operational through the end of 1997, the ADC at

2397Healthsouth ranged from a low of 67.2 in 70 beds in June 1997, to

2411a high of 81.9 in 90 beds in November 1997, approximately three

2423months after its expansion. Indian River Memorial, the largest

2432referral source and the closest SNU to Healthsouth, opened a

244220-bed SNU, in May 1997. Healthsouth failed to show any adverse

2453impact as a result of the opening of any of existing SNUs in the

2467District. All of the SNUs in the four-county area have filled

2478relatively quickly when opened. At the same time, utilization of

2488CMR services has also steadily increased.

249412. In 1996, Martin Memorial North referred 181 patients to

2504Healthsouth; 134 were actually admitted. For the first eleven

2513months of 1997, Martin Memorial North referred 147 patients (160

2523annualized) resulting in 109 admissions (119 annualized). The

2531percentage of referrals which became admissions was the same,

254074 percent, for both years. Martin Memorial South referred

254927 patients with 22 of those admitted in 1996, and referred 33 of

2562which 25 were admitted, based on actual data for the first eleven

2574months of 1997 annualized for the entire year. Healthsouth notes

2584that Martin Memorial North's referrals declined 12 percent, and

2593the admissions declined by 11 percent comparing 1996 to 1997.

2603Martin Memorial reported total discharges to Healthsouth of 155

2612patients in 1995, 155 in 1996 and 149 in 1997. Healthsouth's

2623total admissions for 1996 and 1997, respectively, were 1463 and

26331455.

263413. Assuming, that Healthsouth reasonably expects to lose

2642$150,000 a year in pre-tax revenues as a result of the

2654establishment of Martin Memorial's 15-bed SNU, that level of

2663impact is not substantial, as compared to Healthsouth's revenues

2672in excess of expenses, or profits of approximately $3.8 million

2682in 1996.

268414. Considering the distance between Healthsouth and Martin

2692Memorial, the differences in the intensity of the services they

2702offer, and the historical absence of any substantial adverse

2711impact on Healthsouth when closer referral hospitals established

2719SNUs, Healthsouth has failed to establish that it will suffer an

2730injury-in-fact if Martin Memorial initiates skilled nursing

2737services in a 15-bed unit.

274215. Healthsouth failed to establish the reasonableness of

2750the loss it projects, given the evidence that the average length

2761of stay and number of cases likely to be redirected are

2772overestimated. Assuming, nevertheless, the accuracy of

2778Healthsouth's projections, the projected loss does not constitute

2786a substantial adverse impact. Therefore, Healthsouth has failed

2794to establish the facts necessary to support its claim of standing

2805in this proceeding.

2808CONCLUSIONS OF LAW

281116. Pursuant to Subsections 408.039(5) and 120.57(1),

2818Florida Statutes, the Division of Administrative Hearings has

2826jurisdiction over the parties and subject matter of this

2835proceeding.

283617. Healthsouth, the Intervenor, must demonstrate standing

2843by meeting the requirements of Subsection 408.039(5), Florida

2851Statutes, and the two prong test of Agrico Chemical Company v.

2862Department of Environmental Regulation , 406 So. 2d 478 (Fla. 2nd

2872DCA 1981), rev. denied , 415 So. 2d 1361 (Fla. 1982).

288218. As required by Subsection 408.039(5), Healthsouth

2889alleges that it has standing to intervene because its

2898. . . established program will be

2905substantially affected by the issuance of any

2912certificate of need to a competing proposed

2919facility or program within the same district.

2926Healthsouth contends that a hospital-based SNU will compete with

2935CMR services. Healthsouth has a specific CON licensed program as

2945required by the decision in St. Joseph Hospital of Charlotte,

2955Florida, Inc. v. DHRS , 559 So. 2d 595 (Fla. 1st DCA 1990).

2967Healthsouth also demonstrated a potential adverse impact on the

2976provision of the CON regulated health service due to an overlap

2987in the services provided by CMR hospitals and hospital-based

2996SNUs, despite the differences in rule methodologies and licenses.

3005See e.g. Charter Medical-Jacksonville, Inc. v. State, DHRS ,

3013503 So. 2d 381 (Fla. 1st DCA 1987), relying on Psychiatric

3024Institute of America, Inc. v. DHRS , 491 So. 2d 1199 (Fla. 1st DCA

30371986). The claims asserted by Healthsouth are, therefore,

3045cognizable within the zone of interest protected by Subsection

3054408.039(5), Florida Statutes, and meet the first prong of the

3064Agrico test.

306619. Healthsouth failed to demonstrate that it will suffer

3075an injury-in-fact and therefore, failed to meet the second prong

3085of the Agrico test. The injury alleged by Healthsouth is not

3096supported by the facts adduced at hearing. Assuming, arguendo ,

3105that Healthsouth will suffer the injury it alleged, Healthsouth

3114failed to show that the impact on Healthsouth is reasonably

3124expected to be substantial.

312820. Healthsouth failed to establish its standing to

3136initiate or intervene in opposition to Martin Memorial's proposal

3145to establish a 15-bed SNU.

315021. Because it is unnecessary to the disposition of this

3160proceeding, no ruling is made on Martin Memorial's Motion for

3170Official Recognition of various petitions filed by Healthsouth in

3179various cases, and Notice of Intention to Seek Sanctions. No

3189ruling is made on Healthsouth's Motion for Summary Recommended

3198Order Dismissing Martin Memorial because Healthsouth lacks

3205standing to participate as a party to this proceeding.

3214RECOMMENDATION

3215Based on the foregoing Findings of Fact and Conclusions of

3225Law, it is RECOMMENDED that the Agency for Health Care

3235Administration enter a final order granting Martin Memorial's

3243Motion to Dismiss the Petition to Intervene, filed by Healthsouth

3253of Treasure Coast, Inc., d/b/a Healthsouth Treasure Coast

3261Rehabilitation, and granting Certificate of Need No. 8847 to

3270establish a 15-bed skilled nursing unit at Martin Memorial

3279Medical Center, Stuart, Florida.
