114STATEMENT OF THE ISSUE

118Whether Petitioner is entitled to benefits as a "joint

127annuitant" for the deceased, Gloria Cromartie.

133PRELIMINARY STATEMENT

135This case began on September 11, 1997, when the Division of

146Retirement advised the Petitioner, Latonia Faye Cromartie, that

154her request to be deemed a "joint annuitant" had been denied.

165More specifically, the notice advised Petitioner that she had

174failed to provide documentation to show that the deceased,

183Petitioner's mother, had provided at least half of her financial

193support for the year immediately prior to the member's death.

203Thereafter, the Petitioner timely requested an administrative

210hearing to contest the agency decision, and the matter was

220forwarded to the Division of Administrative Hearings for formal

229proceedings on October 15, 1997.

234At the hearing, Petitioner testified in her own behalf and

244presented witnesses Kimberly Golden and Darlene Harriet Gibson.

252Petitioner's Exhibits marked for identification A through T have

261been admitted into evidence, except for Exhibit Q to which an

272objection was sustained.

275The Respondent offered testimony from Stanley Colvin, the

283Retirement Administrator for the Survivor Benefits Section at the

292Division of Retirement. The Respondent's Exhibits numbered 1

300and 2 have also been received into evidence.

308The transcript of the proceeding was filed on

316December 1, 1998. By stipulation of the parties the proposed

326recommended orders were due on or before December 31, 1998. They

337have been considered in the preparation of this order.

346FINDINGS OF FACT

3491. The Petitioner, Latonia Faye Cromartie, is the adult

358daughter and sole legal heir of the deceased, Gloria Cromartie, a

369vested member of the Florida Retirement System (FRS).

3772. The Respondent is the state agency charged with the

387responsibility of managing the FRS.

3923. Gloria Cromartie died on August 9, 1995. Ms. Cromartie

402was a long-term employee of the Broward County Public School

412District and resided in that county. At the time of her death

424she had designated Mattie Cromartie as the beneficiary of her FRS

435benefits. Mattie Cromartie predeceased the member.

4414. As Ms. Cromartie was not survived by the designated

451beneficiary or a spouse, the Petitioner sought FRS benefits as

461the member's sole surviving heir. As such, Petitioner claimed

470she was entitled to a FRS benefit as a "joint annuitant."

4815. The Respondent denied Petitioner's claim and maintained

489that she had not demonstrated she was financially dependent on

499the deceased member for the year prior to the member's death

510(August 1994 through July 1995).

5156. For the relevant period of time, the deceased member had

526not claimed Petitioner on her income tax return as a dependent.

5377. Petitioner did not reside with the deceased member. At

547all times material to this case, Petitioner resided in Georgia.

5578 The deceased member was a generous parent who assisted

567Petitioner financially on numerous occasions. It is accepted

575that these financial contributions greatly assisted Petitioner.

582The deceased made payments on Petitioner's credit debt and

591supplemented her income for rent purposes.

5979. Nevertheless, the documentation submitted by Petitioner

604does not demonstrate the deceased member provided at least

613one-half of Petitioner's financial support for the period August

6221994 through July 1995.

626CONCLUSIONS OF LAW

62910. The Division of Administrative Hearings has

636jurisdiction over the parties to, and the subject matter of,

646these proceedings.

64811. The Petitioner bears the burden of proof to establish

658she is entitled to benefits as a "joint annuitant," one who was

670dependent on the deceased for her financial support.

67812. Rule 60S-6.001(34), Florida Administrative Code,

684defines "joint annuitant" as:

688(34) JOINT ANNUITANT -- Means:

693(a) the spouse; or

697(b) a natural or legally adopted child who

705is either under 25 or physically or mentally

713disabled and incapable of self-support,

718regardless of age, or any other person under

72625 for whom the member is the legal guardian

735and who is financially dependent for no less

743than one-half of his or her support from the

752member at retirement or at the time of death

761of such member, whichever occurs first; or

768(c) a parent or grandparent, or a person

776age 25 or older for whom the member is the

786legal guardian, provided that such parent,

792grandparent, or other person is financially

798dependent for no less than one-half of his or

807her support from the deceased member at

814retirement or at time of the death of such

823member, whichever occurs first. See also 60S-

8304.011(5)(c).

83113. The Respondent's interpretation and application of the

839foregoing "joint annuitant" policy was applicable to the period

848at issue in this proceeding.

85314. In this case, Petitioner has failed to establish she is

864entitled to FRS benefits as a "joint annuitant." Petitioner's

873description of cash gifts made to her by the deceased, which are

885not documented by the evidence presented, has not been deemed

895persuasive in this matter. Bank records demonstrating and

903supporting the cash trail alleged from the deceased to the

913Petitioner have not been produced. The weight of the credible

923evidence presented in the cause has not established Petitioner as

933a "joint annuitant." Consequently, Petitioner's claim must fail.

941RECOMMENDATION

942Based on the foregoing Findings of Fact and Conclusions of

952Law, it is RECOMMENDED that the Division of Retirement enter a

963Final Order denying Petitioner's request for benefits as the

972deceased member's "joint annuitant" and reimbursing Petitioner

979for the deceased's contributions to the FRS.
