108STATEMENT OF THE ISSUE

112The issue for determination is whether Petitioner's foster

120parent application for adoption of the minor child, S. J., should

131be granted.

133PRELIMINARY STATEMENT

135By letter dated April 13, 1998, Respondent's representative

143informed Petitioner that Petitioner's foster parent application

150to adopt a foster child in Petitioner's care was denied.

160Respondent subs equently requested a formal administrative

167hearing and the matter was transferred to the Division of

177Administrative Hearings to conduct a formal hearing pursuant to

186Section 120.57(1), Florida Statutes.

190At the hearing, Petitioner presented the testimony of 7

199witnesses and 26 exhibits of which 20 were admitted into

209evidence. Respondent presented testimony of 6 witnesses and 7

218exhibits.

219No transcript of the final hearing was provided.

227Additionally the parties did not file proposed recommended orders

236within the required time frames and none had been received at the

248time of preparation of this Recommended Order.

255FINDINGS OF FACT

2581. S.J. was abandoned at birth. Moses and Juanita

267Pitchford served as foster parents of the child from the age of

279two days until March 30, 1998, when the child was over two years

292old.

2932. S.J. was observed by several of Respondent's employees

302as not behaving like other children her age. She had a flat

314effect, not laughing, playing or verbalizing as other children

323who visited Respondent's offices did. Subsequent evaluations of

331the child established that S.J. was developmentally delayed in

340speech,

341physical, and cognitive skills. S.J. was then referred to Easter

351Seals for services to assist her in the speech, physical, and

362cognitive skills areas.

3653. The Pitchfords' care had never been criticized in any of

376the Respondent's home evaluation forms completed by Gwen Tennant,

385the home care counselor employed by Respondent. Only when

394Juanita Pitchford applied to adopt S.J. did Tennant assert that

404Juanita Pitchford was not providing adequate care for the child.

4144. Tennant's concern was based on the fact that S.J. was

425not receiving the maximum exposure to an Easter Seals program for

436which she had qualified. The Pitchfords were never formally

445informed of this or any other deficiency. The evidence

454establishes that the Pitchfords presented S.J. at the program

463four days per week out of the total five days for which she was

477eligible.

4785. Following Respondent's denial by letter dated April 13,

4871998, of Petitioner's foster parent application for adoption,

495Respondent has continued to place foster children, including

503infants, in the Pitchford home.

5086. The rights of the child's biological parents were

517terminated by court order dated June 17, 1997, due to their

528abandonment of the child. The court noted in its order that:

539Testimony adduced revealed that the child can

546and has formed a significant relationship

552with the parental substitute as has been

559established in her current foster care

565placement. The foster parents are the only

572parents she has ever known.

5777. The court's order also stated:

583[T]he child is currently being given

589excellent care by foster parents who love and

597care for [S.J.], and consider [S.J.] to be

605their child.

6078. On March 30, 1998, S.J. was removed to the home of Betty

620Allen, another foster parent. Allen is not married, cares for

630six other foster children under the age of six years, and works

642at a full-time job outside the home. Consequently, S.J. is

652delivered to day care on a regular basis for five days each week.

665During four of those days, she is later taken to the Easter Seals

678program by day care personnel for four and one-half hours. Allen

689cares for the foster children in her home from approximately

6995:30 p.m. until 8:30 p.m. in the evening. She drops the children

711at day care before 8:00 a.m. each day. In contrast, Petitioner

722is not employed outside the home, remains there throughout the

732day, and is able to provide intense daily interaction with S.J.

743CONCLUSIONS OF LAW

7469. The Division of Administrative Hearings has jurisdiction

754over the parties and the subject matter. Section 120.57(1),

763Florida Statutes

76510. Rule 65C-16.002(7)(a)1.-5., Florida Administrative

770Code, promulgated by Respondent, states that the first adoption

779placement of choice in situations like this present proceeding is

789with the foster parents with whom the child is residing. The

800rule sets forth five exceptions to such placement: (1) when the

811child does not want to be adopted by the foster parents; (2) the

824foster parents do not want to adopt the child; (3) the foster

836parents are willing to adopt the child, but none of its siblings;

848(4) the health status of the foster parents jeopardizes the

858child's security from loss or separation; and (5) the foster

868parents have withheld information that jeopardizes the permanency

876of the child's placement with them.

88211. When it is considered that S.J. is receiving no more

893exposure to the Easter Seals program than she did when she was in

906Petitioner's home, Respondent's argument, that S.J. was not

914receiving maximum exposure to that program from Petitioner and

923should not be adopted by Petitioner, is unpersuasive. Absent a

933showing by Respondent that one of the five conditions set forth

944in Rule 65C-16.002(7)(a)1.-5., Florida Administrative Code,

950exists with regard to Petitioner, Petitioner's application should

958be granted by Respondent and adoption placement with Petitioner

967considered to be in the child's best interest as required by Rule

97965C-16.002(8), Florida Administrative Code.

983RECOMMENDATION

984Based on the foregoing, it is hereby

991RECOMMENDED that a Final Order be entered approving the

1000application of Petitioner.
