106Whether Respondent violated Sections 943.1395(6), (7), and

113943.13(7), Florida Statutes, and Rules 11B-27.0011(4)(c) and

12011B-20.0012(1)(f), Florida Administrative Code.

124PRELIMINARY STATEMENT

126On December 8, 1997, Petitioner, Department of Law

134Enforcement, Criminal Justice Standards and Training Commission

141(Department), served Respondent, Michelle Mann (Mann), with an

149Administrative Complaint, alleging that Mann engaged in an

157unprofessional relationship with a community controllee in

164violation of Sections 943.1395(6) and (7) and 943.13(7), Florida

173Statutes, and Rules 11B-27.0011(4)(c) and 11B-20.0012(1)(f),

179Florida Administrative Code. Mann filed an Election of Rights

188form, stating that she disputed the allegations contained in the

198Administrative Complaint and requested an administrative hearing.

205The case was forwarded to the Division of Administrative Hearings

215for assignment to an Administrative Law Judge on July 1, 1998.

226The final hearing was scheduled for October 19, 1998. On

236October 14, 1998, Petitioner filed a Motion for Continuance,

245which was granted, and the final hearing was rescheduled for

255January 25, 1999.

258Respondent was provided notice of the final hearing by Order

268Granting Continuance and Rescheduling Hearing dated November 9,

2761998. Neither Respondent nor a representative for Respondent

284appeared at the final hearing.

289At the final hearing, Petitioner called Dorothy Belcher and

298Dwight Williams as its witnesses. Petitioner's Exhibit 1 was

307admitted in evidence.

310The transcript was filed on February 24, 1999. On March 4,

3211999, Petitioner filed its P roposed R ecommended O rder which has

333been considered in rendering this R ecommended O rder. Respondent

343did not file a proposed recommended order.

350FINDINGS OF FACT

3531. Respondent, Michelle Mann (Mann), was certified by the

362Petitioner, Department of Law Enforcement, Criminal Justice

369Standards and Training Commission (Department) on October 11,

3771991, and was issued Correctional Probation Officer Certificate

385Number 122933 and Instructor Certificate Number 595-40-7895.

3922. Mann was employed by the Florida Department of

401Corrections as a correctional probation officer in December 1994

410until her resignation in February 7, 1997.

4173. Dwight Williams, aka Dwight Moment is an inmate with the

428Florida Department of Corrections.

4324. In December 1994, Dwight Williams was on probation with

442the Florida Department of Corrections for the charge of

451conspiracy to traffic cocaine. Mann was assigned as

459Mr. Williams' probation officer on December 18, 1994. This was

469the first time that Mr. Williams and Mann had met.

4795. From December 1994 through December 1996, Mann was

488Mr. Williams' supervising probation officer.

4936. Between December 1994 and November 27, 1996, Mann

502initiated and engaged in a physical relationship with

510Mr. Williams, which included hugging, kissing, and sexual

518relations. During this time, Mann and Mr. Williams went to hotel

529rooms and had sexual relations between fifteen and twenty times.

539CONCLUSIONS OF LAW

5427. The Division of Administrative Hearings has jurisdiction

550over the parties to and the subject matter of this proceeding.

561Section 120.57(1), Florida Statutes.

5658. The Department has the burden to establish the

574allegations in the Administrative Complaint by clear and

582convincing evidence. Ferris v. Turlington , 510 So. 2d 292 (Fla.

5921987).

5939. Section 943.13(7), Florida Statutes, requires that

600correctional officers have good moral character.

60610. Rule 11B-27.0011(4), Florida Administrative Code,

612defines "good moral character" for the purposes of implementation

621of disciplinary action against Florida correctional officers.

628This rule section was in effect at the time the Mann was alleged

641to have had a sexual relationship with Mr. Williams. The rule

652provides:

653(4) For purposes of the Commission's

659implementation of any of the penalties

665specified in Section 943.1395(6) or (7), a

672certified officer's failure to maintain good

678moral character, as required by Section

684943.13(7), is defined as:

688* * *

691(c) The perpetration by the officer of

698an act or conduct which constitutes:

704* * *

7073. Having an unprofessional

711relationship with an inmate, detainee,

716probationer, or parolee, or community

721controlee. An unprofessional relationship is

726defined as:

728* * *

731b. engaging in physical contact which

737is prohibited by law or rule.

74311. Rule 33-4.002, Florida Administrative Code, sets for

751the rules of conduct for Department of Correction employees.

760Subsection (27) provides:

763(27) Employees shall maintain a

768professional relationship with all persons in

774the custody or under the supervision of the

782Department, and their immediate family or

788visitors. No personal or business

793relationships are permitted. Marriages

797between employees and inmates are not

803permitted.

80412. Mann engaged in a personal relationship with

812Mr. Williams which was prohibited by Rule 33-4.002(27), Florida

821Administrative Code. Her relationship was unprofessional as

828defined by Rule 11B-27.0011(4), Florida Administrative Code.

835Petitioner has established by clear and convincing evidence that

844Mann has failed to maintain good moral character within the

854meaning of Section 943.13(7), Florida Statutes, and Rule 11B-

86327.0011(4)(c), Florida Administrative Code.

86713. Rule 11B-20.0012(1)(f), Florida Administrative Code,

873provides that the certification of a criminal justice training

882instructor shall be revoked if the instructor "commits an act or

893acts establishing a 'lack of good moral character' as defined by

904Rule 11B--27.0011(4), F.A.C."

90714. Section 943.1395(7), Florida Statutes, provides:

913(7) Upon a finding by the commission

920that a certified officer has not maintained

927good moral character, the definition of which

934has been adopted by rule and is established

942as a statewide standard, as required by s.

950943.13(7), the commission may enter an order

957imposing one or more of the following

964penalties:

965(a) Revocation of certification.

969(b) Suspension of certification for a

975period not to exceed 2 years.

981(c) Placement on probationary status

986for a period not to exceed 2 years, subject

995to terms and conditions imposed by the

1002commission. Upon the violation of such terms

1009and conditions, the commission may revoke

1015certification or impose additional penalties

1020as enumerated in this subsection.

1025(d) Successful completion by the

1030officer of any basic recruit, advanced, or

1037career development training or such

1042retraining deemed appropriate by the

1047commission.

1048(e) Issuance of a reprimand.

105315. Rule 11B-27.005(5), Florida Administrative Code, sets

1060forth the range of penalties for violations committed by a

1070certified officer. The recommended penalty for a unprofessional

1078conduct with an inmate or probationer is revocation of the

1088officer's certification.

1090RECOMMENDATION

1091Based on the foregoing Findings of Fact and Conclusions of

1101Law, it is RECOMMENDED a Final Order be entered revoking

1111Michelle F. Mann's Correctional Probation Certificate Number

1118122933 and Instructor Certificate Number 595-40-7895.
