138STATEMENT OF THE ISSUE
142The issue presented is whether the application of Respondent
151Robbie's Safe Harbor Marine Enterprises, Inc., for a general
160permit to construct and operate a solid waste transfer station
170should be granted.
173PRELIMINARY STATEMENT
175Respondent Robbie's Safe Harbor Marine Enterprises, Inc.,
182applied to the Department of Environmental Protection for a solid
192waste transfer station general permit and published notice of
201that application. Petitioner Safe Harbor Enterprises, Inc.,
208timely objected to the issuance of a general permit, requesting
218an evidentiary proceeding. This cause was thereafter transferred
226to the Division of Administrative Hearings to conduct the
235proceeding.
236The Respondents presented the testimony of Sandra Walters,
244Ghaus Minhaj, Robert Reckwerdt, and James T. Edds, Jr. The
254Petitioner presented the testimony of Miriam Bernstein, Ray
262Gonzalez, and James T. Edds, Jr. Additionally, Petitioner's
270Exhibits numbered 1-3, 5, and 6 and Respondents' Exhibits
279numbered 1 and 2 were admitted in evidence.
287Only Petitioner and Respondent Robbie's Safe Harbor Marine
295Enterprises, Inc., filed proposed recommended orders post
302hearing. Those documents have been considered in the entry of
312this Recommended Order. The transcript of proceedings was not
321filed.
322FINDINGS OF FACT
3251. In April 1998 Respondent Robbie's Safe Harbor Marine
334Enterprises, Inc., filed an application with Respondent
341Department of Environmental Protection, seeking a general permit
349to construct and operate a solid waste transfer station at the
360end of Shrimp Road on Stock Island in Monroe County, Florida.
371The application was accompanied by the required supporting
379documentation, including a site plan and an engineering report.
3882. The site plan submitted with the application depicted
397access to the transfer station by using Shrimp Road. The access
408road was also designated as a private road.
4163. What the site plan and remainder of the application did
427not reveal is that Shrimp Road, the private road providing access
438from the public road system to the proposed solid waste transfer
449station, is not owned by Robbie's. Rather, the road is owned by
461the adjoining property owner, Petitioner Safe Harbor Enterprises,
469Inc. Robbie's is the holder of an easement allowing use of
480Shrimp Road.
4824. Robbie's published notice of its application for a
491general permit to construct and operate a solid waste transfer
501station. As a result of that notice, the adjoining property
511owner, Safe Harbor Enterprises, Inc., filed the petition
519initiating the instant proceeding, objecting to the issuance of a
529general permit to Robbie's.
5335. On February 2, 1998, prior to Robbie's filing its
543application for a general permit to construct and operate its
553solid waste transfer station, Robbie's entered into a Consent
562Order with the Department which resolved the Department's
570allegations that Robbie's had been operating a solid waste
579transfer facility without a permit.
584CONCLUSIONS OF LAW
5876. The Division of Administrative Hearings has jurisdiction
595over the subject matter hereof and the parties hereto. Sections
605120.569 and 120.57(1), Florida Statutes.
6107. Section 403.087, Florida Statutes, requires a permit for
619any stationary installation reasonably expected to be a source of
629pollution, unless exempted by Department rule, and authorizes the
638Department to promulgate rules for the issuance of permits.
647Pursuant thereto, the Department has promulgated Rule 62-701.801,
655Florida Administrative Code, allowing the issuance of general
663permits for solid waste transfer stations.
6698. Petitioner Safe Harbor Enterprises, Inc., objects to the
678issuance of a general permit to Robbie's for three reasons:
688(a) Robbie's has operated an illegal and unlicensed solid waste
698transfer facility; (b) There is no need for Robbie's facility;
708and (c) Robbie's has no access since the proposed facility would
719expand the intended use of Robbie's limited easement. The first
729two arguments are without merit.
7349. Rule 62-701.320(3), Florida Administrative Code,
740requires the Department to consider prior violations of
748applicable statutes and rules relating to the operation of a
758solid waste management facility if the applicant is
"766irresponsible" as that term is defined. The only evidence
775offered in this proceeding as to whether Robbie's is an
785irresponsible applicant was twofold: a copy of the Consent Order
795which recites that Robbie's has neither admitted nor denied the
805Department's allegations, and the testimony of Robbie's president
813that a lessee, not Robbie's, operated the illegal facility. Such
823evidence falls far short of proving Robbie's to be an
833irresponsible applicant.
83510. Petitioner also argues that there is no need for
845Robbie's facility. However, no authority has been cited, and
854none has been found, which would support the argument that the
865Department should consider whether the facility is needed.
87311. Petitioner's argument regarding the lack of access to
882the proposed facility is persuasive. Rule 62-701.801(2), Florida
890Administrative Code, requires that an application for a general
899permit for a solid waste transfer station include a site plan
910which must show entrances, exits, on-site roadways, and access
919roads. Robbie's application reflected Shrimp Road to be the
928private road which would provide access between the proposed
937facility and the public road system. The evidence is
946uncontroverted that Robbie's alleged private road is only an
955easement and that the owner of the property on which the easement
967is located objects to the use of the easement for the purpose of
980providing access to a solid waste transfer station.
98812. Petitioner offered both evidence and argument that the
997easement when created was intended to be limited in use and that
1009Robbie's proposed expansion of that use to carry vehicles of the
1020size and weight required for operation of the proposed solid
1030waste transfer facility is not permitted. See Crutchfield v.
1039F. A. Sebring Realty Co ., 69 So. 2d 328 (Fla. 1954); Walters,
1052et al. v. McCall , 450 So. 2d 1139 (Fla. 1st Dist. 1984). The
1065parties to this proceeding agree that any use or restriction of
1076the easement can only be adjudicated by a circuit court and
1087cannot be resolved in this proceeding.
109313. Rule 62-701.801, Florida Administrative Code, requires
1100that the site plan show both the on-site roadways and the access
1112roads. Robbie's application complies on its face by showing the
1122easement and labeling it a private road. However, once the owner
1133of the property disputed the availability of the easement for
1143access to the proposed facility, it was incumbent upon Robbie's,
1153if it wished to demonstrate compliance with all requirements for
1163obtaining a general permit, to resolve the dispute surrounding
1172the use of the easement. Since the use of the easement is not
1185resolved, then Robbie's cannot show that it has access roads so
1196that the facility can be accessed. Accordingly, Robbie's has not
1206demonstrated reasonable assurance of compliance with all the
1214conditions precedent to the issuance of a general permit for a
1225solid waste transfer station, and Robbie's application must be
1234denied.
1235RECOMMENDATION
1236Based on the foregoing Findings of Fact and Conclusions of
1246Law, it is
1249RECOMMENDED that a final order be entered denying Robbie's
1258Safe Harbor Marine Enterprises, Inc.'s, application for a general
1267permit to construct and operate a solid waste transfer station.
