86STATEMENT OF THE ISSUE

90The issue in this case is whether the Department of

100Transportation should revoke the certification of ACS-Associated

107Contractual Services, Inc. (ACS), as a disadvantaged business

115enterprise ( DBE) under Chapter 339, Florida Statutes (1997), and

125Florida Administrative Code Chapter 14-78.

130PRELIMINARY STATEMENT

132By letter dated October 31, 1997, the Department g ave notice

143of intent to revoke the ACS's DBE certification, and ACS timely

154requested an informal hearing. For reasons not clear from the

164record, the Department retained jurisdiction until September 14,

1721998, when it referred the matter to the Division of

182Administrative Hearings (DOAH) for a formal proceeding under

190Section 120.57(1), Florida Statutes. The referral misidentified

197the issue as being whether ACS's application for DBE

206certification should be granted; accordingly, the referral named

214ACS as the Petitioner and the Department as the Respondent.

224After the Department's Response to Initial Order, the case was

234scheduled for final hearing on November 9, 1998.

242ACS did not appear at final hearing. The Department called

252one witness and had Respondent's Exhibits A, B, and C admitted in

264evidence.

265FINDINGS OF FACT

2681. ACS-Associated Contractual Services, Inc. (ACS), held a

276one-year certificate as a disadvantaged business enterprise ( DBE)

285under Chapter 339, Florida Statutes (1997), and Florida

293Administrative Code Chapter 14-78, effective May 22, 1997,

301through May 21, 1998.

3052. From the time of ACS's application for DBE

314certification, John Scribner had been ACS's President, primary

322contact with the Department, and one-third owner. By letter

331dated October 10, 1997, Scribner advised the Department that he

341had become the majority owner and that his company no longer

352qualified for DBE certification.

3563. ACS did not apply to renew its DBE certificate prior to

368its expiration on May 21, 1998, and has not appl ied for

380certification since. Ordinarily, these facts would moot a

388revocation proceeding, but the Department's Minority Program

395Office Manager testified that the Department has a curious policy

405under which it has been maintaining ACS's DBE certification until

415the resolution of these proceedings notwithstanding its earlier

423expiration.

424CONCLUSIONS OF LAW

4274. DBE certification is governed by Chapter 339, Florida

436Statutes (1997), and Florida Administrative Code Chapter 14-78.

444Florida Administrative Code Rule 14-78.005(7)(b) requires that a

452DBE be at least 51 percent owned by one or more "disadvantaged

464individuals." When a change occurs, and "disadvantaged

471individuals" no longer own at least 51 percent of the DBE, the

483Department must revoke the DBE's certificate. Section

490339.0805(2), Florida Statutes (1997); Florida Administrative Code

497Rule 14-78.008(1)(a).

499RECOMMENDATION

500Based upon the foregoing Findings of Fact and Conclusions of

510Law, it is

513RECOMMENDED that the Department of Transportation enter a

521final order revoking ACS's certification as a disadvantaged

529business enterprise ( DBE) under Chapter 339, Florida Statutes

538(1997), and Florida Administrative Code Chapter 14-78.
