91STATEMENT OF THE ISSUES
95Whether Respondent violated Rule 64E-6.003, Florida
101Administrative Code, by repairing a septic tank and/or
109drainfield without a permit and, if so, what penalty should
119be imposed on him.
123PRELIMINARY STATEMENT
125On May 18, 1999, the Pasco County Health Department
134issued a citation to Respondent, Shane Whitfield, for
142installing and/or repairing a septic tank and/or drainfield
150without a permit. The citation indicated that on April 16,
1601999, an initial notice of violation had been issued to
170Respondent directing him to abate a sanitary nuisance.
178Respondent contested the citation and requested a hearing.
186On June 14, 1999, the matter was forwarded to the Division
197of Administrative Hearings for assignment of an
204Administrative Law Judge to conduct the hearing.
211At hearing, Petitioner, the Department of Health
218presented the testimony of one witness, Gregory Crumpton, an
227Environmental Specialist with the Pasco County Health
234Department and offered and had three exhibits received into
243evidence. Respondent failed to appear at hearing and no
252testimony or documentary evidence was presented on his
260behalf.
261The proceeding was recorded but was not transcribed.
269The Department timely filed a Proposed Recommended Order.
277No post-hearing submittal was filed by or on behalf of
287Respondent.
288FINDINGS OF FACT
2911. Petitioner, the Department of Health (Department),
298is the state agency charged with administering and enforcing
307laws and rules relating to sanitation. Section 381.0011(4),
315Florida Statutes.
3172. Respondent failed to appear at the duly- appointed
326time and place for the administrative hearing in this
335matter.
3363. On April 22, 1999, Gregory Crumpton, Environmental
344Specialist with the Pasco County Health Department,
351responded to a sanitary nuisance complaint regarding
358Respondent's property located at 7111 Lofty Drive, Port
366Richey, Florida. Based on that complaint, on April 22,
3751999, Mr. Crumpton inspected Respondent's property. His
382inspection revealed the presence of untreated or improperly
390treated human waste from an improperly maintained septic
398tank.
3994. Based on his April 22, 1999, inspection of
408Respondent's property and his determination that the
415condition existing on Respondent's property constituted a
422sanitary nuisance, Mr. Crumpton issued an Official Notice to
431Abate a Sanitary Nuisance. The notice was left on
440Respondent's property. Moreover, on April 22, 1999, a copy
449of the notice was mailed to Respondent by certified mail.
459Respondent signed the return receipt acknowledging that he
467had received the notice.
4715. On April 26, 1999, Mr. Crumpton received a second
481complaint from a neighbor of Respondent who reported that
490Respondent's septic tank was being repaired without a
498permit. Upon inspecting Respondent's property on April 27,
5061999, Mr. Crumpton observed that repair work was being
515performed on Respondent's septic tank without a permit.
5236. On April 27, 1999, Mr. Crumpton met with
532Respondent regarding the inspection and issued to Respondent
540a second Official Notice to Abate a Sanitary Nuisance, which
550was sent by certified mail. This notice was issued to
560Respondent because of the installation and/or repair to
568septic tank and/or drainfield without a permit.
5757. The April 27, 1999, notice advised Respondent that
584his failure to secure a septic tank repair permit could
594result in his being fined up to $500.00 per day until he
606obtained the required permit.
6108. Although Respondent was advised that he could be
619fined up to $500.00 per day for failing to secure a permit
631to repair his septic tank, as of May 18, 1999, Respondent
642had not secured the permit.
6479. On May 18, 1999, Mr. Crumpton issued a citation
657alleging that Respondent had installed and/or repaired a
665septic tank and/or drainfield without a permit.
67210. As of the date of the final hearing in this
683matter, October 19, 1999, Respondent had failed to secure a
693septic tank repair permit.
697CONCLUSIONS OF LAW
70011. The Division of Administrative Hearings has
707jurisdiction over the parties and subject matter of this
716proceeding pursuant to Section 120.57(1), Florida Statutes.
72312. Petitioner, the Department of Health, is the state
732agency charged with administering and enforcing laws and
740rules relating to sanitation. Section 381.0011(4), Florida
747Statutes.
74813. Pursuant to its authority, the Department is
756required to promulgate rules and to issue permits associated
765with the repair of on-site sewage treatment and disposal
774systems. Section 381.0065(3), Florida Statutes. That
780section provides in relevant part the following:
787(3) DUTIES AND POWERS OF THE DEPARTMENT
794OF HEALTH.--The department shall:
798(a) Adopt rules to administer ss.
804381.0065-381.0067.
805(b) Perform application reviews and
810site evaluations, issue permits, and
815conduct inspections and complaint
819investigations associated with the
823construction, installation, maintenance,
826modification, abandonment, or repair of
831an onsite sewage treatment and disposal
837system for a residence or establishment
843with an estimated domestic sewage flow
849of 10,000 gallons or less per day, or an
859estimated commercial sewage flow of
8645,000 gallons or less per day, which is
873not currently regulated under chapter
878403.
87914. Consistent with its rulemaking authority, the
886Department promulgated Rule 64E-6.003(1), Florida
891Administrative Code, which provides that no portion of an
900on-site sewage treatment and disposal system shall be
908installed, repaired, altered, modified, abandoned, or
914replaced until an "Onsite Sewage Treatment and Disposal
922System Construction Permit" has been issued on Form DH4016.
93115. Section 381.0065(5)(b), Florida Statutes,
936authorizes the Department to issue citations that contain an
945order to correct or an order to pay a fine or both for
958violations of laws and rules related to the operation and
968maintenance of sewage treatment and disposal systems. That
976section provides in pertinent part the following:
983(b)1. The department may issue
988citations that may contain an order of
995correction or an order to pay a fine, or
1004both, for violations of ss. 381.0065-
1010831.0067, part I of chapter 386, or part
1018III or chapter 489 or the rules adopted
1026by the department, when a violation of
1033these sections or rules is enforceable
1039by an administrative or civil remedy, or
1046when a violation of these sections or
1053rules is a misdemeanor of the second
1060degree. A citation issued under ss.
1066381.0065-381.0067, part I of chapter
1071386, or part III of chapter 489
1078constitutes a notice of proposed agency
1084action.
10852. A citation must be in writing and
1093must describe the particular nature of
1099the violation, including specific
1103reference to the provisions of law or
1110rule allegedly violated.
11133. The fines imposed by a citation
1120issued by the department may not exceed
1127$500 for each violation. Each day the
1134violation exists constitutes a separate
1139violation for which a citation may be
1146issued.
114716. In the instant case, the Department has
1155established by clear and convincing evidence that Respondent
1163made or attempted to make repairs to his septic tank without
1174first obtaining a permit for such repair.
118117. The undisputed evidence also established that the
1189although the Department issued a citation to Respondent
1197advising him of the violation and allowing him time to
1207secure a permit, he failed to comply.
121418. Furthermore, the evidence established that the
1221Department properly issued a second citation to Respondent
1229after he failed to secure a septic tank permit.
1238Nonetheless, as of the date of the final hearing in this
1249matter, Respondent had failed to obtain the required permit.
1258RECOMMENDATION
1259Based upon the foregoing Findings of Fact and
1267Conclusions of Law, it is, therefore:
1273RECOMMENDED that the Respondent be ordered to pay a
1282fine in the amount of $500.00, obtain a septic tank repair
1293permit, and effect repairs.
