116STATEMENT OF THE ISSUES
120The issues are whether Respondent has been found guilty of
130crimes directly relating to the practice of public accounting, in
140violation of Section 473.323(1)(d), Florida Statutes; has
147performed a fraudulent act while licensed to practice public
156accounting, in violation of Section 473.323(1)(k), Florida
163Statutes; has failed to maintain good moral character, in
172violation of Section 473.323(l)(m), Florida Statutes; all as
180charged in the Administrative Complaint dated May 23, 2000, and
190if so what penalty should be imposed.
197PRELIMINARY STATEMENT
199By Administrative Complaint dated May 23, 2000, Petitioner
207alleged that, on May 5, 1998, Respondent was found guilty of
218numerous charges arising out of his participation in the
227kidnapping and attempted murder of one Marcello Schiller.
235Respondent was convicted of crimes which involve forcing Schiller
244to sign blank checks which were later deposited into the
254Respondent's operating and escrow accounts. Other documents
261which Schiller was forced to sign were forged, fraudulently
270notarized, or uttered by Respondent to other parties.
278The Administrative Complaint alleges that the charges of
286which Respondent was convicted directly relate to the practice of
296public accounting or the ability to practice public accounting,
305in violation of Section 473.323(1)(d), Florida Statutes.
312Further, the Administrative Complaint alleges that these crimes
320constitute the performance of a fraudulent act while licensed to
330practice public accounting, in violation of Section
337473.323(1)(k), Florida Statutes, and that they further
344demonstrate a failure to maintain good moral character in
353violation of Section 473.323(l), Florida Statutes.
359Resp ondent timely requested a formal hearing.
366At the hearing, Petitioner offered one exhibit, which was
375received in evidence without objection. Respondent does not
383dispute any of the material facts of this case.
392The transcript was filed on December 6, 2000. Proposed
401recommended orders were timely filed by the parties and have been
412carefully considered in the preparation of this Recommended
420Order.
421FINDINGS OF FACT
4241. At all material times, Respondent, John C. Mese ( Mese)
435has been licensed as a certified public accountant, holding
444license number AC000247000. The record reveals no prior
452discipline.
4532. Mese is presently incarcerated in the Dade Correctional
462Institute, having been convicted on May 5, 1998, in the Circuit
473Court of the 11th Judicial Circuit of attempted first degree
483murder; kidnapping, robbery and extortion with a firearm; nine
492counts of money laundering; and 18 counts relating to forgery or
503the uttering of forged instrument(s).
5083. Mese was convicted of additional charges which were the
518subject of a judgment notwithstanding the verdict entered by the
528trial court on July 20, 1998.
5344. Mese's appeal of the foregoing charges is, as of this
545writing, pending in the Third District Court of Appeal.
5545. From the time of his arrest through the present, Mese
565maintains his innocence of all charges.
571CONCLUSIONS OF LAW
5746. The Division of Administrative Hearings has jurisdiction
582over the subject matter. Section 120.57(1), Florida Statutes.
5907. Section 473.323(3), Florida Statutes (2000), authorizes
597Petitioner to discipline licensees or registrants in the State of
607Florida and provides, in pertinent part, as follows:
615(2) when the Board finds any licensee guilty
623of any of the grounds set forth in subsection
632(1), it may enter an order imposing one or
641more of the following penalties: (a) Denial
648of an application for licensure. (b)
654Revocation or suspension of a license. (c)
661Imposition of an administrative fine not to
668exceed $5000 for each count or separate
675offense. (d) Issuance of a reprimand. (e)
682Placement of the licensee on probation for a
690period of time and subject to such conditions
698as the board may specify, including requiring
705the licensee to attend continuing education
711courses or to work under the supervision of
719another licensee. (f) Restriction of the
725authorized scope of practice by the certified
732public accountant.
7348. Section 473.323(1), Florida Statutes (2000), provides in
742pertinent part, that the following acts constitute grounds for
751which the disciplinary actions in subsection (3) may be taken:
761(d) being convicted or found guilty of, or
769entering a plea of nolo contendere to,
776regardless of adjudication, a crime in any
783jurisdiction which directly relates to the
789practice of public accounting or the ability
796to practice public accounting.
800(k) performing a fraudulent act while
806holding a license to practice public
812accounting.
813(l) failing to maintain a good moral
820character as provided in Section 473.306.
8269. A jury verdict of guilty constitutes a "conviction"
835within the meaning of Section 473.323(1)(d), Florida Statutes.
84310. Rule 61H1-36.004, Florida Administrative Code, sets the
851penalty guidelines for the violations charged, which include
859imposition of a $5,000 fine per offense, and revocation of
870license.
87111. Because Petitioner seeks to revoke Mese's license, it
880must prove the material allegations by clear and convincing
889evidence. Department of Banking and Finance v. Osborne Stern and
899Company, Inc. , 670 So. 2d 932 (Fla. 1996); Ferris v. Turlington ,
910510 So. 2nd 292 (Fla. 1987).
91612. Petitioner has proved by c lear and convincing evidence
926violations of Sections 473.323(1)(d), (k), and (l).
93313. While admitting that he stands convicted of crimes
942which constitute the violations charged in the Administrative
950Complaint, Mese urges that the Petitioner stay its disciplinary
959proceedings during the pendency of his appeal(s). He argues that
969the District Court of Appeal may reverse his conviction, a hope
980bolstered, in his mind, by the fact that the trial court entered
992a judgment notwithstanding the verdict in his favor on several of
1003the counts upon which the jury convicted.
101014. The law is to the contrary.
101715. Petitioner's proof, and Mese's admission, that he
1025stands convicted of serious felonies, is ample justification to
1034take action against Mese's license. Ashe v. Department of
1043Professional Regulation, Board of Accountancy , 467 So. 2d 814
1052(Fla. 5th DCA 1985); Greenwald v. Department of Professional
1061Regulation , 501 So. 2d 740 (Fla. 3d DCA 1987); Rife v. Department
1073of Professional Regulation , 638 So. 2d 542 (Fla. 2d DCA 1994);
1084Department of Professional Regulation, Board of Accountancy v.
1092Leider , DOAH Case No. 90-6424; and Brogan v. Smith , DOAH Case
1103No. 94-6356 (Recommended Order December 26, 1997). It could not
1113be seriously argued that the crimes for which Mese is imprisoned
1124are unrelated to the practice of public accounting. Many of the
1135charges on which Mese was convicted constitute fraud, and each
1145charge belies good moral character.
115016. Mese also suggested that the undersigned should review
1159the criminal trial record and make an independent determination
1168as to his guilt. Mese has not submitted the trial record, making
1180de novo review impossible. More to the point, the undersigned is
1191without power to "go behind" the jury's determination of guilt.

1262RECOMMENDATION
1263Based on the foregoing Findings of Fact and Conclusions of
1273Law, it is
1276RECOMMENDED that the Board of Accountancy enter a final
1285order finding Respondent guilty of violating the provisions of
1294Chapter 473.323(1), Florida Statutes (1994), as alleged in
1302Counts I, II, III, and IV of the Administrative Complaint; impose
1313a administrative fine of $5000; and revoke Respondent's license
1322with leave to reapply in the event his conviction is reversed or
1334the criminal charges are otherwise disposed of in Mese's favor.
