114PRELIMINARY STATEMENT

116On August 21, 2000, Tom Gallagher, as the Commissioner of

126Education (Petitioner), filed an Administrative Complaint

132alleging that Costa Lempesis (Respondent), had violated various

140Sections of Chapter 231, Florida Statutes. Respondent is alleged

149to have failed to disclose, when he executed his sworn

159application for a Florida teacher's certificate on November 26,

1681996, that he had previously pled guilty to a charge of assault

180and battery and disturbing schools on or about March 18, 1996.

191Petitioner contends that the failure to disclose by Respondent is

201tantamount to receiving a teacher's certificate by fraudulent

209means, a violation of Section 231.2615, Florida Statutes, and

218constitutes gross immorality by Respondent, reducing his

225effectiveness as a teacher. Additionally, Respondent is deemed

233to have violated Section 231.17, Florida Statutes, as a result of

244failure to exhibit good moral character. These violations are

253also considered violative of the Principles of Professional

261Conduct for the education profession.

266Respondent subsequently requested a formal administrative

272hearing. The matter was then transferred to the Division of

282Administrative Hearings to conduct formal proceedings pursuant to

290Section 120.57(1), Florida Statutes.

294At the hearing, Petitioner presented six exhibits.

301Respondent did not appear and no evidence or testimony was

311presented on his behalf. No transcript of the final hearing was

322provided.

323Petitioner filed a Proposed Recommended Order on December

33115, 2000. Respondent did not file any post-hearing submissions.

340The Proposed Recommended Order submitted by Petitioner has

348been duly considered in the preparation of this Recommended

357Order.

358FINDINGS OF FACT

3611. Respondent holds Florida Education Certificate

367No. 460644, covering the areas of Educational Leadership and

376Social Science. The license is valid through June 30, 2001.

3862. At all times material to this proceeding, Resp ondent was

397employed as a substitute teacher at Marathon High School in the

408Monroe County School District.

4123. On or about November 26, 1996, Respondent submitted an

422application for renewal of a Professional Florida Educator's

430Certificate to Petitioner's Bureau of Teacher Certification. On

438the application, Respondent checked "no" in response to the

447following question:

449Have you ever been convicted of a crime,

457found guilty, or entered a plea of nolo

465contendre or had adjudication withheld in a

472criminal proceeding; or are there any

478criminal charges now pending against you.

484Failure to answer this question accurately

490could cause denial of certification.

4954. By indictment of the grand jury convened in Pickens

505County, South Carolina, on June 22, 1995, Respondent was charged

515with "Assault and Battery of a High and Aggravated Nature" and

526with the offense of "Disturbing Schools." Respondent pled guilty

535to the charge of Disturbing Schools and the lesser charge of

"546Simple Assault and Battery" on March 18, 1996. He received a

557sentence of a $200 fine and a suspended 90 days jail sentence.

5695. On or about October 6, 2000, Petitioner submitted its

579First Request for Admissions to Respondent. Respondent failed to

588answer, admit, or deny the truth of the matters asserted in the

600request; namely, that Respondent submitted the application for

608renewal of a Professional Florida Educator's Certificate in the

617manner and form described in paragraph 3, above, and that he pled

629guilty to the criminal charges described in paragraph 4, above.

639Pursuant to Rule 1.370(b), Fla. R. Civ. P., the truth of the

651matters asserted in the request is conclusively established.

659CONCLUSIONS OF LAW

6626. The Division of Administrative Hearings has jurisdiction

670over this subject matter and the parties to this action pursuant

681to Section 120.57(1), Florida Statutes.

6867. The Petitioner bears the burden of proof in this

696proceeding. The evidence must be clear and convincing. Ferris

705v. Turlington , 510 So. 2d 292 (Fla. 1987).

7138. Pursuant to Section 231.2615(1), Florida Statutes, the

721Education Practices Commission is empowered to take punitive

729action against the holder of a Florida teaching certificate based

739upon the grounds enumerated in the statute. The disciplinary

748actions, which may be imposed by the Commission, range from

758probation to revocation of certification.

7639. The evidence clearly and convincingly demonstrates that

771Respondent fraudulently obtained his teaching certificate through

778failure to disclose his criminal past in the course of the

789application process. Such fraud is one of the proscribed actions

799for which discipline pursuant to Section 231.2615(1), Florida

807Statutes, may be imposed.

81110. An examination of the Principles of Professional

819Conduct for the Education Profession as set forth in Rule Chapter

8306B-1.006, Florida Administrative Code, also reveals that

837Respondent has violated Rule 6B-1.006(5)(i) of that Chapter,

845proscribing fraudulent action such as that indulged in by

854Respondent in this case.

85811. Petitioner has met its burden in this case and

868justifiably requests that Respondent's teaching certificate be

875revoked for a period of three years.

882RECOMMENDATION

883Based upon the findings of fact and conclusions of law, it

894is

895RECOMMENDED that a final order be entered revoking

903Respondent's teaching certificate for a period of three years.
