31ORDER GRANTING MOTION FOR FINAL SUMMARY JUDGEMENT
38AND DENYING MOTION FOR SANCTIONS
43Respondent moved for final summary judgement in this
51cause. Petitioner moved for sanctions based upon denial of
60access for Petitioner to the hearing site at Lake Correctional
70Institution. Testimony was taken on Respondent's motion. A
78record of the circumstances surrounding Petitioner's exclusion
85from hearing are contained in the transcript of the first
95day's proceeding.
97I find that the policies being challenged were being
106applied as unpromulgated rules, and are now in the process of
117being adopted as duly promulgated rules.
123Respondent's motion for summary judgement was based upon
131the Secretary of the Department of Corrections having
139withdrawn the policies which were challenged by Petitioner,
147and initiating the rule-making process with regard to them.
156The record reveals that some of these policies have been
166withdrawn and others of the policies have been incorporated in
176Institutional Operating Procedures (IOP) developed at the
183individual institutions. Therefore, the challenge to the
190policies which the Department has withdrawn is moot, and the
200portions of the challenged policies which are retained in
209IOPs, are valid pursuant to the authority contained in the
219existing rules 1 authorizing warden's to adopt local policies.
228Pursuant to Rule 120.54(1)(a)1.C., Florida Statutes, the
235adoption of these policies by the wardens, who are authorized
245to adopt procedures locally, would not be an impediment to
255their adoption as a duly promulgated rule. Respondent's
263motion for summary judgement is granted.
269Petitioner's Motion for Sanctions was based upon the
277denial of access to the proceedings on the first day of the
289scheduled hearing. Petitioner's motion is denied because the
297costs incurred by the Petitioner were related to the actual
307proceeding, not discovery. While sanctions maybe imposed upon
315proper motion for violation of the discovery rules, imposition
324of costs in actual proceedings is limited to those cases in
335which the Petitioner is the prevailing party. However,
343Petitioner's motion will be treated as a motion for taxing
353costs, for although inartfully phrases, Petitioner seeks
360relief for her expenses.
364Notwithstanding the withdrawal of these policies
370voluntarily, I conclude that Petitioner successfully
376challenged policies causing them to be withdrawn until
384properly adopted. 2
387Although attorneys' fees and lost wages are not
395applicable, Petitioner may recover the costs of copying and
404service of process and subpoenas. Petitioner may present
412these costs by affidavit to be filed within 30 days.
422Petitioner's petition is dismissed; jurisdiction to award
429costs as outlined above is retained; and all other relief is
440denied.

5011 / Chapter 33-601.701 Visiting--Authority of the Secretary
509(1) The Secretary has authorized each warden to adopt
518policies stating the conditions and circumstances under which
526visits may be conducted, including:
531(a) The regular visiting hours of the institution;
539(b) The items which visitors may take in or out of an
551institution, and what items are contraband;
557(c) What persons or groups may visit, and in what
567numbers; and
569(d) The specific standards of conduct which shall prevail
578during such visits.
581(2) Wardens are authorized to make exceptions to any
590provision of this rule on an individual, case-by-case basis,
599based on the vested interests of the inmate, the security and
610welfare of the Department or both. The exceptions shall not
620be more restrictive than the provisions of these rules.
629(3) All visiting policies promulgated by the wardens
637shall be subject to approval by the Secretary or designee.
6472 / One of the issues of concern to Petitioner is the future
660effect of disciplinary actions taken under the challenged
668procedures prior to their withdrawal. Although these are
676properly the subject of a formal hearing pursuant to Section
686120.57, Florida Statutes, if they become an issue, counsel for
696the Department of Corrections represented at hearing that
704those actions had been set aside, and would not be considered
715a past violation in any future proceedings.
