106STATEMENT OF THE ISSUES
110The issues are whether Respondent is guilty of making or
120filing a false report signed in the capacity of a licensed
131chiropractic physician, in violation of Section 460.413(1)(j),
138Florida Statutes, and, if so, the penalty.
145PRELIMINARY STATEMENT
147By Amended Administrative Complaint dated February 1, 2001,
155Petitioner alleged that Respondent is a licensed chiropractor in
164Florida, holding license number CH 0002696.
170The Amended Administrative Complaint alleges that, on
177April 7, 19 99, Respondent completed Petitioner's "Mandatory
185Practitioner Profile Questionnaire." The Amended Administrative
191Complaint alleges that Respondent's signature on the
198questionnaire affirms that his responses to the questions were
207true and correct.
210The Ame nded Administrative Complaint alleges that
217Respondent falsely answered "no" to the question asking, "Have
226you ever been convicted or found guilty, regardless of whether
236adjudication of guilt was withheld, or pled guilty or nolo
246contendere to a criminal misdemeanor or felony in any
255jurisdiction."
256The Amended Administrative Complaint alleges that, on
263September 20, 1996, the Pinellas County Circuit Court found
272Respondent guilty of two counts of uttering a check with forged
283endorsements, one count of aggravated stalking, and one count of
293intercepting oral communication--all felonies. The Amended
299Administrative Complaint alleges that the court sentenced
306Respondent to one year's imprisonment, with credit for time
315served, and Respondent was released from jail on February 11,
3251997.
326The Amended Administrative Complaint alleges that
332Respondent thus violated Section 460.413(1)(i), Florida
338Statutes, by failing to perform a statutory or legal obligation
348placed on a licensed chiropractic physician. The Amended
356Administrative Complaint alleges three such obligations :
363Section 455.624(1)(v) [now Section 456.072(1)(v)], Florida
369Statutes, which prohibits "making misleading, untrue, deceptive,
376or fraudulent representations on a profile"; Section
383460.413(1)(j), Florida Statutes, which prohibits the "[m]aking
390or filing a report which the licensee knows to be false"; and
402Section 460.413(1)(k), Florida Statutes, which prohibits
"408[m]aking misleading, deceptive, untrue, or fraudulent
414representations in the practice of medicine." In its proposed
423recommended order, Petitioner abandons the alleged violation of
431Section 460.413(1)(k), Florida Statutes.
435At the hearing, Petitioner called one witness and offered
444into evidence seven exhibits : Petitioner Exhibits 1-7.
452Respondent called two witnesses and offered into evidence six
461exhibits : Respondent Exhibits 1-6. All exhibits were admitted
470except Petitioner Exhibits 3 and 5, which were proffered.
479Respondent never filed Respondent Exhibits 2 and 6, so they are
490deemed withdrawn.
492The cou rt reporter filed the transcript on May 21, 2001.
503FINDINGS OF FACT
5061. Respondent has been a licensed chiropractor in Florida
515since 1978, holding license number CH0002696.
5212. Petitioner requires licensed chiropractors to file
528Mandatory Practitioner Profile Questionnaire Packets (Profiles).
534The subject Profile was due on or before April 15, 1999. The
546Profile asks the licensee to supply various items of information
556and answer several questions.
5603. Section II of the Profile requires information
568concerning "medical education." In response to the question of
577what medical school Respondent attended, he wrote: "Logan
585'Quack Con-Artist' School of Chiropractic." In response to the
594type of his degree, Respondent wrote: "Quack Con-Artist
602Chiropractic Degree."
6044. In response to questions concerning medical training,
612Respondent answered: "'Fraudulent' Automobile Personal Injury
618Cases (Robbing Insurance Companies)" and "'Fraudulent' Workers
625Compensation Cases (Robbing Insurance Companies)." Respondent
631also added to these responses, as well as the responses cited in
643the preceding paragraph, the following: "Caveat : see letter
652dated April 7, 1999 sent to Gloria Henderson, Division
661Director)."
6625. Section VIII of the Profile requires information
670concerning criminal offenses. This section asks: "have you
678ever been convicted or found guilty, regardless of whether
687adjudication of guilt was withheld, or pled guilty or nolo
697contendere to a criminal misdemeanor or felony in any
706jurisdiction?" The question then states: "If "YES," briefly
714describe the offense(s), indicate whether the conviction is
722under appeal, and attach copy of notice of appeal." The form
733supplies three lines for each of these items of information.
7436. Respondent answered "no" to the first question in
752Section VIII and left the remainder of the section blank.
7627. The Profile concludes, immediately above the signature
770line: "I affirm these statements are true and correct and
780recognize that providing false information may result in
788disciplinary action against my license or criminal penalties
796pursuant to Sections 455.624, 458.327, 458.331, 459.013,
803459.015, 460.413, 461.013, 775.082, 775.083 and 775.084, Florida
811Statutes."
8128. Respondent signed on the signature line and added the
822date of April 7, 1999. Immediately beneath the signature line,
832Respondent added: "Notice : Signed under caveat--see letter
840dated April 7, 1999 sent to Gloria Henderson, Division
849Director."
8509. Respondent's four-page letter to Gloria Henderson dated
858April 7, 1999, references the Profile, notifies Ms. Henderson
867and Petitioner of Respondent's intent to sue, and demands that
877Petitioner omit Respondent's listing from a website of
885chiropractors because, in part, "I do NOT accept their
894' valueless treatment' known as an "adjustment" (it is a waste of
906money and time ), and because I practice health care from an
"918Allopathic" (medical approach) point of view, including but not
927limited to, surgery, drug prescription, physical therapy . . .."
937Respondent states in the letter that the Petitioner's failure to
947incorporate his comments in all computer files listing him as a
958chiropractor will result in his filing a federal action under
968tort and constitutional law seeking $1 million plus punitive
977damages.
97810. The final caveat in the April 7 letter states:
988My (Roy A. Day) signature on the instant
996letter, and the associated completed
1001questionnaire, reflects the denial of Roy A.
1008Day to have meaningful access to so-called
"1015licensed attorney" courts of law, and the
1022associated denials of each and all
1028discovery, and trial by jury, and the right
1036to each and all appeals, and the denial to
1045write a brief on appeals, and each and all
1054associated "railroading" of Roy A. Day, with
1061the overlay for "licensed attorney" courts
1067of law to deny the law, facts and evidence
1076existed when they pertained to Roy A. Day,
1084since Roy A. Day is not represented by a
1093so -called "licensed attorney" at $300.00 per
1100hour in artificial-monopolistic legal fees.
1105In addition, the signature reflects each and
1112all associated "forced and coerced" action,
1118specifically, Roy A. Day has been denied
"1125due process and equal protection of the
1132law."
113311. On February 6, 1995, Pinellas County Circuit Court
1142entered an Order of Probation. The Order states that Respondent
1152pleaded guilty to aggravated stalking, interception of oral
1160communication, and uttering a check with a forged endorsement.
1169The Order withholds adjudication and places Respondent on
1177probation for two years.
118112. As a result of Respondent's violation of the
1190conditions of probation, on September 20, 1996, Pinellas County
1199Circuit Court entered a judgment finding Respondent guilty of
1208two counts of the third-degree felony of uttering a check with a
1220forged endorsement, in violation of Section 831.02, Florida
1228Statutes. The checks totaled approximately $20,000, and,
1236sometime between March 13 and May 5, 1993, Respondent passed
1246each check knowing that the signature of his brother, Donald
1256Day, was forged. For each count, the court sentenced Respondent
1266to one year in jail with credit for 130 days he had already
1279served in jail, and the sentences ran concurrently.
128713. As a result of Respondent's violation of the
1296conditions of probation, on September 20, 1996, Pinellas County
1305Circuit Court entered a judgment finding Respondent guilty of
1314the third-degree felony of aggravated stalking, in violation of
1323Section 784.048(3), Florida Statutes. The stalking consisted of
1331repeated and harassing telephone calls that Respondent made to
1340the house of a person who had, at one time, expressed interest
1352in purchasing a home in which Respondent had an interest, but
1363later decided not to pursue the purchase. The court sentenced
1373Respondent to one year in jail with credit for 133 days that he
1386had already served in jail, and this sentence ran concurrently
1396with the sentences for uttering a check with a forged
1406endorsement.
140714. Petitioner lacked a copy of a judgment concerning the
1417interception of oral communications. This offense arose out of
1426Respondent's surreptitious recording of a conversation that he
1434had with a police officer who was investigating the stalking
1444charges. Absent a copy of the judgment, however, insufficient
1453evidence of this conviction exists for the purpose of this
1463disciplinary case.
146515. At the final hearing, Respondent explained that he did
1475not disclose these criminal convictions on the Profile because
1484doing so would somehow implicate him as a "co -conspirator" in
1495the injustices perpetrated upon him by the authorities involved
1504in prosecuting these offenses.
150816. Respondent falsely failed to disclose on the Profile
1517his convictions for aggravated stalking and uttering a check
1526with a forged instrument. His failure to disclose this
1535information constitutes fraudulent concealment of these criminal
1542offenses.
154317. In a fairly straightforward case, Respondent has filed
1552nearly 250 pleadings containing thousands of pages. He also
1561abused the subpoena power of this tribunal by subpoenaing judges
1571and court officials from every level of the federal and state
1582judiciaries. Last but not least, Respondent has defamed and
1591discredited numerous persons without apparent reason, although
1598some question exists whether Respondent is capable of exercising
1607consistent control over the impulses leading to at least some of
1618these utterances.
162018. The crimes of which Respondent was convicted may have
1630arisen out of family disagreements, possibly concerning the sale
1639of a family home. Respondent may be obsessively preoccupied
1648with actual or perceived injustices that he suffered as a result
1659of this transaction. Undoubtedly, Respondent compulsively
1665litigates everything that has the most remote bearing upon this
1675transaction, using court files as archives for materials that he
1685believes will vindicate him, despite an ardent and often-
1694expressed repulsion for judges, lawyers, and others connected
1702with the legal system.
170619. No penalty but revocation is suitable under the
1715circumstances, absent a showing by Respondent that he has
1724commenced or is continuing therapy and that the prognosis is
1734reasonably good. The record lacks such evidence.
174120. Respondent is not unintelligent, nor is he entirely
1750devoid of insight. His thinking, although at times disordered,
1759is capable of impressive organizational efforts, as best
1767revealed by his meticulous organization in his proposed
1775recommended order of what otherwise seemed to be a bewildering
1785variety of materials that Respondent has seen fit to file in
1796this case. Although his behavior seems at times compulsive,
1805Respondent was capable of a certain level of self-restraint, at
1815least during the hearing and when not directly confronting the
1825underlying transaction or crimes. If they occur at some point
1835in the future, successful diagnosis and treatment of Respondent
1844should inform Petitioner's interpretation of the events and
1852behaviors described in this Recommended Order, if Respondent
1860seeks relicensure as a chiropractor.
1865CONCLUSIONS OF LAW
186821. The Division of Administrative Hearings has
1875jurisdiction over the subject matter. Section 120.57(1),
1882Florida Statutes. (All references to Sections are to Florida
1891Statutes.)
189222. Section 460.413(1)( i) and (j) provides:
1899The following acts shall constitute grounds
1905for which the disciplinary actions specified
1911in subsection (2) may be taken:
1917(i ) Failing to perform any statutory or
1925legal obligation placed upon a licensed
1931chiropractic physician.
1933(j ) Making or filing a report which the
1942licensee knows to be false, intentionally or
1949negligently failing to file a report or
1956record required by state or federal law,
1963willfully impeding or obstructing such
1968filing or inducing another person to do so.
1976Such reports or records shall include only
1983those which are signed in the capacity of a
1992licensed chiropractic physician.
199523. Section 460.413(2) authorizes the Board of
2002Chiropractic Medicine to revoke the license of a chiropractor
2011guilty of any violation described in Section 460.413(1).
2019Section 460.413(3) adds:
2022In determining what action is appropriate,
2028the board must first consider what sanctions
2035are necessary to protect the public or to
2043compensate the patient. Only after those
2049sanctions have been imposed may the
2055disciplining authority consider and include
2060in the order requirements designed to
2066rehabilitate the chiropractic physician.
207024. Petitioner must prove the material allegations by
2078clear and convincing evidence. Department of Banking and
2086Finance v. Osborne Stern and Company, Inc. , 670 So. 2d 932 (Fla.
20981996) and Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987).
210925. Petitioner has proved by clear and convincing evidence
2118that Respondent's concealment of his criminal convictions from
2126the Profile was the making or filing of a report that he knew to
2140be false and that he signed in the capacity of a licensed
2152chiropractic physician. At present, protection of the public
2160safety compels the revocation of his license.
2167RECOMMENDATION
2168It is
2170RECOMMENDED that the Board of Chiropractic Medicine enter a
2179final order finding Respondent guilty of violating Section
2187460.413(1)(j), Florida Statutes, and revoking his license.
