147STATEMENT OF THE ISSUE
151To be resolved are any existing disputes regarding actual
160expenses, the amount and manner of payment of an award to the
172legal guardian, and the reasonable expenses incurred in
180connection with the filing of the claim, including reasonable
189attorney's fees.
191PRELIMINARY STATEMENT
193By Final Order rendered March 15, 2001, it was resolved that
204Alexandria LeCrenier (Alexandria), a minor, was a covered infant
213under the provisions of Section 766.301 et seq ., Florida
223Statutes, the "Florida Birth-Related Neurological Injury
229Compensation Plan" (the Plan). Consequently, it was ordered
237that:
2381. The claim for compensation filed by Renee
246LeCrenier, the maternal grandmother and legal
252guardian of Alexandria LeCrenier, be and the
259same is hereby approved.
2632. NICA shall make immediate payment of all
271expenses previously incurred, and shall make
277payment for future expenses as incurred.
2833. The parties are accorded 30 days from the
292date of this order to resolve, subject to the
301approval of the administrative law judge, any
308existing dispute regarding actual expenses,
313the amount and manner of payment of an award
322to the parents or legal guardians, and the
330reasonable expenses incurred in connection
335with the filing of the claim, including
342reasonable attorney's fees. If not resolved
348within such period, the parties will so
355advise the administrative law judge, and a
362hearing will be scheduled to resolve such
369issues . . . .
374Following entry of the Final Order, the parties requested
383that a hearing be held to resolve any disputes regarding actual
394expenses, the amount and manner of payment of an award to the
406legal guardian, and the reasonable expenses incurred in
414connection with the filing of the claim, including reasonable
423attorney's fees. Such a hearing was duly-noticed and held on
433May 25, 2001.
436At hearing, Petitioner and Respondent stipulated to the
444matters set forth in paragraphs 1 and 2 of the Findings of Fact
457and, post-hearing, stipulated to the matters set forth in
466paragraph 3 of the Findings of Fact. No witnesses were called
477and no other evidence was offered.
483FINDINGS OF FACT
4861. With regard to expenses previously incurred, the parties
495are unaware of any existing dispute regarding any such expenses;
505however, consistent with Section 766.31(1)(a), Florida Statutes,
512NICA agrees to pay all actual expenses previously incurred that
522may remain unpaid, as well as future expenses as incurred.
5322. With regard to an award to the legal guardian and
543primary custodian, Renee LeCrenier, the parties are in agreement
552that an award of $100,000 is appropriate, and that the award be
565paid at the rate of $1,000 a month retroactive to Alexandria's
577birth. The parties also agree that the award shall be used to
589offset transportation expenses, living expenses, and other
596expenses not covered under Section 766.31(1)(a), Florida
603Statutes. Finally, the parties agree that absent a change in the
614custodial arrangement or further order of the administrative law
623judge that this award shall continue to be paid to Renee
634LeCrenier at the rate of $1,000 per month until the full award of
648$100,000 has been paid.
6533. With regard to an award for reasonable expenses incurred
663in connection with the filing of the claim, including reasonable
673attorney's fees, the parties have agreed that NICA will pay and
684Petitioner shall accept the sum of $10,000 for attorney's fees
695and $1,500 for costs, as the reasonable expenses incurred in
706connection with the filing of the claim.
7134. The parties' agreement with regard to actual expenses,
722the amount and manner of payment of an award to the legal
734guardian, and the amount to be paid in connection with the filing
746of the claim is reasonable, and is approved.
754CONCLUSIONS OF LAW
7575. The Division of Administrative Hearings has jurisdiction
765over the parties to, and the subject matter of, these
775proceedings. Section 766.301, et seq. , Florida Statutes.
7826. Pertinent to this case, Section 766.31(1), Florida
790Statutes, provides that where, as here, a claim for compensation
800has been approved, the claimant is entitled to an award providing
811compensation for "actual expenses," an award to the legal
820guardian not to exceed $100,000, and an award for reasonable
831expenses incurred in connection with the filing of the claim.
8417. Here, the parties have stipulated to such award, as
851heretofore noted in the Findings of Fact, and the parties'
861agreement has been approved.
865CONCLUSION
866Based on the foregoing Findings of Fact and Conclusions of
876Law, it is
879ORDERED that:
8811. NICA shall make immediate payment of all actual
890expenses, as defined by Section 766.31(1)(a), Florida Statutes,
898previously incurred and not paid, and shall make payment for
908future expenses as incurred.
9122. Pursuant to Section 766.31(1)(b), Florida Statutes, an
920award of $100,000 is made. Such award shall be paid periodically
932at the rate of $1,000 per month to Alexandria's legal guardian,
944Renee LeCrenier, retroactive to Alexandria's birth, and shall be
953used to offset transportation expenses, living expenses, and
961other expenses not otherwise covered under Section 766.31(1)(a),
969Florida Statutes. Absent a change in the custodial arrangement
978or further order of the administrative law judge, the award shall
989continue to be paid to Renee LeCrenier at the rate of $1,000 per
1003month until the full award of $100,000 has been paid.
10143. Pursuant to Section 766.31(1)(c), Florida Statutes,
1021Petitioner is awarded $11,500, as reasonable expenses incurred in
1031connection with the filing of the claim, including reasonable
1040attorney's fees.
1042DONE AND ORDERED this 15th day of June, 2001, in
