93Whether the Department of Insurance, Division of State Fire

102Marshal, should revoke Respondent's Firefighter Certificate

115PRELIMINARY STATEMENT

117On October 2, 2000, Petitioner filed an administrative

125complaint against Respondent. Petitioner charged Respondent with

132violating Section 633.351, Florida Statutes. Respondent, on

139October 23, 2000, disputed the allegations of fact in the

149administrative complaint and requested a formal hearing. On

157January 17, 2001, Petitioner referred the matter to the Division

167of Administrative Hearings.

170At the hearing, Petitioner presented the testimony of one

179witness and offered three exhibits which were accepted into

188evidence. Respondent did not appear personally or through

196counsel at the final hearing.

201No transcript was filed. Petitioner timely filed a Proposed

210Recommended Order. The Respondent did not.

216FINDINGS OF FACT

2191. Respondent is currently certified as a firefighter in

228the State of Florida by the Department of Insurance, Division of

239State Fire Marshal.

2422. Respondent was initially certified as a firefighter in

251the State of Florida while employed by the Palatka Fire

261Department.

2623. On or about January 12, 1991, Respondent resigned from

272the Palatka Fire Department and went to work for the Gainesville,

283Florida Fire Department.

2864. On August 29, 2000, Respondent was convicted by a jury

297of the felony of aggravated fleeing and attempting to elude in

308violation of Section 316.193(5), Florida Statutes. Adjudication

315was withheld. The conviction occurred in the Circuit Court of

325the Eighth Judicial Circuit in and for Bradford County, Florida.

3355. Respondent was placed on community control for two

344years, to be followed by probation for a period of three years.

356CONCLUSIONS OF LAW

3596. The Division of Administrative Hearings has jurisdiction

367over the subject matter. Section 120.57(1), Florida Statutes.

3757. Pursuant to Chapter 633 and Section 20.13, Florida

384Statutes, the Department of Insurance, Division of State Fire

393Marshal, has jurisdiction over Respondent's certification as a

401firefighter.

4028. The material allegations set forth in the administrative

411complaint must be proven by Petitioner by clear and convincing

421evidence. Department of Banking and Finance v. Osborne Stern and

431Company, Inc. , 670 So. 2d 932 (Fla. 1996) and Ferris v.

442Turlington , 510 So. 2d 292 (Fla. 1987).

4499. Section 633.351(2), Florida Statutes, provides as

456follows:

457(2 ) The certification of a firefighter who is

466convicted of a felony, or who is convicted of a

476misdemeanor relating to misleading or false

482statements, or who pleads nolo contendere to

489any charge of a felony shall be revoked until

498the firefighter complies with s. 112.011(2)(b).

504However, if sentence upon such felony or such

512misdemeanor charge is suspended or adjudication

518is withheld, the fire fighter's certification

524shall be revoked until she or he completes any

533probation.

53410. The facts adduced at the hearing demonstrated by clear

544and convincing evidence that Respondent, while a certified fire

553fighter, was found guilty of a felony.

560RECOMMENDATION

561Based upon the Findings of Fact and Conclusions of Law, it

572is

573RECOMMENDED:

574That the Insurance Commissioner and Treasurer enter a Final

583Order revoking Respondent's Certificate as a Firefighter until

591such time as his probation is completed.
