97This cause came on to be heard pursuant to Section 766.304,

108Florida Statutes, upon the stipulation and joint petition of the

118parties, filed April 26, 2001, for the entry of an order

129approving the resolution of a formal claim for compensation

138benefits heretofore filed in this cause in accordance with the

148provisions of Chapter 766, Florida Statutes, and a resolution of

158the exclusive remedy otherwise available as outlined in Chapter

167766, Florida Statutes.

170By the terms of their stipulation, the parties have agreed

180that Petitioners, Josie Brunot Cothiere and Joseph Cothiere, are

189the parents and Co-Personal Representatives of the Estate of

198Joshua Brunot Cothiere (Joshua), a deceased minor; that Joshua

207was born a live infant on January 27, 1996, at Holy Cross

219Hospital, a hospital located in Broward County, Florida; and that

229his birth weight was in excess of 2,500 grams. The parties have

242further agreed that the physician delivering obstetrical services

250during the birth of Joshua was Javier Lugo-Janer, M.D., who was,

261at all times material hereto, a participating physician in the

271Florida Birth-Related Neurological Injury Compensation Plan, as

278defined by Section 766.302(7), Florida Statutes. Finally, by

286their stipulation, the parties have agreed that Joshua suffered a

"296birth-related neurological injury," as that term is defined by

305Section 766.302(2), Florida Statutes.

309After due consideration of the interests of all parties, and

319being otherwise fully advised in the premises, it is

328ORDERED that:

3301. The stipulation of the parties, filed of record

339April 26, 2001, is hereby approved, and the parties are directed

350to comply with the provisions thereof.

3562. The Petitioners, Josie Brunot Cothiere and

363Joseph Cothiere, as the parents of Joshua Brunot Cothiere, a

373deceased minor, are accorded a lump sum award of One hundred

384thousand dollars ($100,000.00).

3883. Upon payment of the lump sum award of One hundred

399thousand dollars ($100,000.00) to the parents (claimants),

407attorney's fees and other expenses of Twelve thousand five

416hundred dollars ($12,500.00) incurred in pursuing the subject

425claim, and payment of past expenses, the claims of the

435Petitioners (claimants) shall be deemed fully satisfied and

443extinguished.

4444. The Division of Administrative Hearings retains

451jurisdiction over this matter to resolve any dispute as to the

462interpretation of any provision of the parties' stipulation and

471to resolve any disputes, should they arise, regarding the

480parties' compliance with the terms of such stipulation.
