71This cause came on to be heard pursuant to Section 766.304,

82Florida Statutes, upon the stipulation and joint petition of the

92parties, filed March 26, 2001, for the entry of an order

103approving the resolution of a formal claim for compensation

112benefits heretofore filed in this cause in accordance with the

122provisions of Chapter 766, Florida Statutes, and a resolution of

132the exclusive remedy otherwise available as outlined in Chapter

141766, Florida Statutes.

144By the terms of their stipulation, the parties have agreed

154that Petitioner, Lisa Renee Ellen, is the parent and Co-Personal

164Representative of the Estate of Brandon M. Ellen (Brandon), a

174deceased minor; that Brandon was born a live infant on

184September 25, 2000, at Columbia Doctors Hospital of Sarasota, a

194hospital located in Sarasota, Florida; and that his birth weight

204exceeded 2,500 grams. The parties have further agreed that the

215physician delivering obstetrical services during the birth of

223Brandon was Joseph C. Corcoran, D.O.; who was, at all times

234material hereto, a participating physician in the Florida Birth-

243Related Neurological Injury Compensation Plan, as defined by

251Section 766.302(7), Florida Statutes. Finally, by their

258stipulation, the parties have agreed that Brandon suffered a

"267birth-related neurological injury," as that term is defined by

276Section 766.302(2), Florida Statutes.

280After due consideration of the interests of all parties, and

290being otherwise fully advised in the premises, it is

299ORDERED that:

3011. The stipulation of the parties, filed of record

310March 26, 20 01, is hereby approved, and the parties are directed

322to comply with the provisions thereof.

3282. Petitioner, Lisa Renee Ellen, as the mother of

337Brandon M. Ellen, a deceased minor, is accorded a lump sum award

349of Ninety eight thousand dollars ($98,000.00).

3563. Upon payment of the lump sum award of Ninety eight

367thousand dollars ($98,000.00) to the mother, attorney's fees and

377other expenses of Ten thousand dollars ($10,000.00) incurred in

387pursuing the subject claim, and payment of past expenses, the

397claims of the Petitioner (claimant) shall be deemed fully

406satisfied and extinguished.

4094. The Division of Administrative Hearings retains

416jurisdiction over this matter to resolve any dispute as to the

427interpretation of any provision of the parties' stipulation and

436to resolve any disputes, should they arise, regarding the

445parties' compliance with the terms of such stipulation.

453DONE AND ORDERED this 29th day of March, 2001, in
