95STATEMENT OF THE ISSUES
99The issues in the case are whether the allegations of the
110Administrative Complaint filed by the Petitioner are correct
118and, if so, what penalty should be imposed against the
128Respondent.
129PRELIMINARY STATEMENT
131By Administrative Complaint dated August 24, 2000, the
139Department of Health (Petitioner) alleged that Rodger H.
147Steinem, P.A. (Respondent), violated Section 458.331(1)(x),
153Florida Statutes, by his noncompliance with a lawful order
162previously entered in a disciplinary case by Petitioner,
170directing Respondent's compliance with certain requirements.
176Respondent requested a formal hearing. The matter was
184forwarded to the Division of Administrative Hearings which
192scheduled and conducted the proceeding.
197At the hearing, Petitioner presented the testimony of one
206witness and had Exhibits numbered 1-8 admitted into evidence.
215Respondent did not appear and no evidence was presented on his
226behalf. The Transcript of the hearing was filed on May 10,
2372001. Petitioner filed a Proposed Recommended Order which has
246been reviewed and utilized in the preparation of this
255Recommended Order.
257FINDINGS OF FACT
2601. Petitioner is the state agency charged with regulation
269of physician assistants in the State of Florida.
2772. At all times material to this case, Respondent has
287been licensed as a physician assistant in the State of Florida,
298holding License Number PA 0001550. His last known address is
308366 Magnolia Street, Atlantic Beach, Florida 32233.
3153. On April 30, 1997, a Final Order (Final Order) was
326entered by Petitioner's Board of Medicine imposing discipline
334on Respondent's license as a physician assistant. The Final
343Order was in response to the Recommended Order entered in
353Division of Administrative Hearings (DOAH) Case Number 96-1559,
361where the presiding Administrative Law Judge (ALJ) recommended
369the revocation of Respondent's license for various violations
377of Section 458.331(1), Florida Statutes.
3824. In the Final Order, Petitioner's Board of Medicine
391elected to impose discipline and adopted the findings of fact
401and conclusions of law in the Recommended Order. Discipline
410imposed included a six-month suspension of license and a
419requirement that Respondent complete the Florida Medical
426Association's medical records course, along with completing 10
434hours of continuing education in the area of medical ethics.
444Respondent was also formerly reprimanded and ordered to pay an
454administrative fine of $5,000 within 30 days.
4625. Respondent appealed the Final Order and the First
471District Court of Appeal granted Respondent's Motion For Stay
480on May 21, 1997.
4846. On February 8, 1999, the First District Court of
494Appeal issued a per curiam affirmance of the Final Order of
505Petitioner's Board of Medicine. On June 9, 1999, the Court
515issued its Mandate.
5187. Based upon the terms of discipline in the Final Order,
529Respondent was to pay a $5,000 administrative fine by July 9,
5411999; complete the Florida Medical Association's medical
548records course by December 9, 1999; and complete 10 hours of
559continuing medical education in the area of medical ethics by
569the same date.
5728. Respondent failed to pay the administrative fine by
581July 9, 1999. He also failed to complete either the medical
592records course or the 10 hours of continuing education in the
603area of medical ethics by December 9, 1999.
6119. Notification was provided to Respondent by
618Petitioner's investigator that Respondent had failed to comply
626with the terms of the Final Order. Subsequent testimony of
636Petitioner's compliance officer at the final hearing also
644establishes that Respondent has, to-date, not complied with
652terms of the final order.
65710. Respondent's failure to comply with requirements of
665the Final Order constitutes a violation of a lawful order of
676Petitioner's Board of Medicine.
680CONCLUSIONS OF LAW
68311. The Division of Administrative Hearings has
690jurisdiction over the parties to and subject matter of this
700proceeding. Section 120.57(1), Florida Statutes.
70512. Petitioner, Department of Health, Board of Medicine,
713is responsible for disciplinary proceedings against physician
720assistants licensed in Florida. Chapter 464, Florida Statutes.
72813. Petitioner has the burden of proving the allegations
737against the Respondent by clear and convincing evidence.
745Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987). In this
756case, the burden has been met.
76214. Respondent's behavior in failing to comply with the
771Final Order of Petitioner's Board of Medicine is deemed a
781violation of Section 458.331(1)(x), Florida Statutes, which in
789turn provides that "[v ]iolating any provision of this chapter,
799a rule of the board or department, or a lawful order of the
812board or department previously entered in a disciplinary
820hearing" is a basis for license discipline.
82715. Disciplinary guidelines of Petitioner's Board of
834Medicine set forth in Rule 64B8-8.001, Florida Administrative
842Code, provide that a violation of Section 458.331(1)(x),
850Florida Statutes, subjects a licensee to a range of penalties
860from reprimand to revocation of licensure, plus an
868administrative fine of $250 to $5,000.
87516. Respondent's violation of a prior Final Order and
884failure to respond or appear in this proceeding underscores his
894flagrant disregard for entities with authority over his license
903and supports imposition of the most stringent penalty.
911RECOMMENDATION
912Based on the foregoing Findings of Fact and Conclusions of
922Law, it is recommended that Petitioner enter a final order
932against Respondent, finding that Respondent violated Section
939458.331(1)(x), Florida Statutes, and revoking Respondent's
945license as a physician assistant.
