139STATEMENT OF THE ISSUE

143At issue in this proceeding is whether Jackeline Casco, a

153minor, suffered an injury for which compensation should be

162awarded under the Florida Birth - Related Neurol ogical Injury

172Compensation Plan.

174PRELIMINARY STATEMENT

176On February 5, 2001, Luis Casco and Maria Casco, as parents

187and natural guardians of Jackeline Casco, a minor, filed a

197petition (claim) with the Division of Administrative Hearings

205(DOAH) for compensa tion under the Florida Birth - Related

215Neurological Injury Compensation Plan (Plan).

220DOAH served the Florida Birth - Related Neurological Injury

229Compensation Association (NICA) with a copy of the claim on

239February 7, 2001. NICA reviewed the claim, and on Ap ril 18,

2512001, gave notice that it had "determined that such claim is not

263a 'birth - related neurological injury' within the meaning of

273Section 766.302(2), Florida Statutes," and requested that the

281administrative law judge "enter an order setting a hearing in

291this cause on the issue of the compensability of this claim."

302Such a hearing was duly held on September 14, 2001.

312At hearing, the parties stipulated to the matters set forth

322in paragraphs 1 and 2 of the Findings of Fact, and Petitioners'

334Exhibit 1 (the m edical records filed with DOAH on February 5,

3462001) and Respondent's Exhibit 2 (the deposition of Michael

355Duchowny, M.D., filed with DOAH on July 10, 2001) were received

366into evidence. The hearing transcript was filed on September 27,

3762001, and the partie s waived the opportunity to submit proposed

387final orders.

389FINDINGS OF FACT

3921. Petitioners, Luis Casco and Maria Casco, are the parents

402and natural guardians of Jackeline Casco (Jackeline), a minor.

411Jackeline was born a live infant on June 3, 2000, at Ho ly Cross

425Hospital, a hospital located in Fort Lauderdale, Broward County,

434Florida, and her birth weight was in excess of 2,500 grams.

4462. The physician providing obstetrical services during the

454birth of Jackeline was William Joyner, M.D., who was, at all

465t imes material hereto, a participating physician in the Florida

475Birth - Related Neurological Injury Compensation Plan, as defined

484by Section 766.302(7), Florida Statutes.

489Coverage under the Plan

4933. Pertinent to this case, coverage is afforded under the

503Plan when the claimants demonstrate, more likely than not, that

513the infant suffered an "injury to the brain or spinal cord . . .

527caused by oxygen deprivation or mechanical injury occurring in

536the course of labor, delivery, or resuscitation in the immediate

546pos t - delivery period in a hospital, which renders the infant

558permanently and substantially mentally and physically impaired."

565Jackeline's presentation

5674. On March 29, 2001, following the filing of the claim for

579compensation, Jackeline was examined by Mich ael S. Duchowny,

588M.D., a board - certified pediatric neurologist associated with

597Miami Children's Hospital, Miami, Florida. Dr. Duchowny reported

605the results of that neurologic evaluation, as follows:

613HISTORY ACCORDING TO THE FAMILY: Jackeline

619was accompan ied by her mother who began by

628explaining that Jackeline's major problem is

634with regards to her left arm. She noted that

643Jackeline had problems with her left arm

"650since birth" and that she had acquired a

658left clavicular fracture at delivery. The

664birth to ok place at Holy Cross Hospital after

67338 weeks gestation. Jackeline weighed 9

679pounds, 7 ounces and was a difficult

686delivery. She was moved from the regular

693nursery to the special care nursery because

700of a heart murmur, but this turned out to be

710inconsequ ential.

712Jackeline subsequently was referred for

717reconstructive surgery and had this performed

723three weeks ago. Dr. John Grossman did

730transplantations of the sural nerves. The

736cast came off one week ago. Mrs. Casco had

745not yet seen return of neurologic functioning

752in Jackeline.

754Jackeline otherwise enjoys good health and

760has been developing nicely. She rolled over

767at four months and sat at five months. She

776is described as being quite socially

782interactive and attentive. There are no

788problems with reg ards to her hearing or

796vision and her feeding, swallowing and sleep

803patterns are normal.

806Jackeline's immunizations have been

810administered on time. Apart from the

816brachial plexus reconstruction, she has had

822no other surgeries. She has an allergy to

830amoxi cillin and sulfa drugs. She also has a

839vesicle ureteral reflux which was diagnosed

845after she presented with recurrent urinary

851tract infections. She now takes Primsol

857daily.

858The FAMILY HISTORY reveals the father to be

86632 and the mother to be 29 years old .

876Jackeline has a 2 - year - old sister who is

887healthy. There are two half brothers, ages 4

895and 2 and two half sisters, ages 8 and 6. No

906family members have degenerative illnesses,

911mental retardation or cerebral palsy.

916PHYSICAL EXAMINATION reveals an alert ,

921socially responsive 9 - month - old infant. The

930weight is 19 pounds. Head circumference

936measures 44.1 cm, which approximates at the

94350th percentile for age. The fontanelles are

950both opened and flat and there are no cranial

959or facial anomalies or asymmetri es.

965Jackeline has no dysmorphic features or

971evidence of spinal dysraphism. The neck is

978supple without masses, thyromegaly or

983adenopathy and the cardiovascular,

987respiratory and abdominal examinations are

992unremarkable. Jackeline does have a grade

9982/6 inno cent ejection systolic murmur. There

1005are healed scars over both posterior calves

1012and left lateral neck.

1016Jackeline's NEUROLOGICAL EXAMINATION reveals

1020her to be quite socially attentive. She

1027displays a great deal of preverbal babbling

1034and has a pleasant d isposition. She is

1042appropriately fearful. There is good central

1048gaze fixation and conjugate following

1053movements. The pupils are 3 mm and briskly

1061reactive. The iris pigment is symmetric and

1068normal. The funduscopic examination

1072discloses no significant f indings. There are

1079no facial asymmetries and the tongue moves

1086well. The uvula is midline. There is no

1094drooling. Motor examination reveals an

1099asymmetry of movement of the upper

1105extremities, where there is active movement

1111on the right, but this is much l ess developed

1121on the left where Jackeline rarely grasps an

1129object unless it is placed in close proximity

1137to her hands. She does have individual

1144finger movements and has movement of the

1151hands, but her proximal limb movement,

1157especially the shoulder girdle, shows a

1163relative absence of movement. There is an

1170asymmetric slope to the shoulder indicating

1176deltoid atrophy. There are no frank

1182fasciculations. Jackeline's proximal muscle

1186strength is judge at 1 where her distal

1194strength is 4. The deep tendon refl exes are

1203asymmetric as well being 2 at the right

1211biceps and brachial radialis and 1 at the

1219right triceps. These same reflexes on the

1226left are not elicited. The knee jerks are

12342.

1235Jackeline is able to sit with good balance

1243and has well developed head c ontrol. There

1251are no pathologic reflexes. The Moro

1257response is asymmetric with diminished left

1263arm movement. Jackeline grasps objects by

1269coming across the midline with her right

1276hand. The sensory examination is differed,

1282although Jackeline's withdrawal to

1286stimulation seemed less pronounced with the

1292left upper extremity. In contrast,

1297Jackeline's lower extremities muscle

1301strength, bulk and tone are normal and the

1309reflexes are likewise unremarkable. The

1314neurovascular examination reveals no

1318cervical, cran ial or ocular bruits and no

1326temperature or pulse asymmetries.

1330In SUMMARY, Jackeline's examination discloses

1335no significant neurologic abnormalities apart

1340from her left upper extremity. Her

1346examination is consistent with a left Erb's

1353palsy and status post brachial plexus

1359reconstruction, but does not have a

1365significant return of functioning at this

1371point. In contrast, Jackeline's mental

1376status would appear to be normal and her

1384motor development has been proceeding

1389satisfactorily.

13905. An Erb's palsy, such as that evidenced by Jackeline, is

1401a weakness of an upper extremity due to damage of the nerve roots

1414of the upper brachial plexus, 1 and does not involve the brain or

1427spinal cord. 2 Moreover, Jackeline's mental or cognitive status

1436has been described as ess entially normal. Consequently, while

1445Jackeline may have suffered a mechanical injury, permanent in

1454nature (to her right brachial plexus) during the course of birth,

1465she does not (for reasons appearing more fully in the Conclusions

1476of Law) qualify for cove rage under the Plan.

1485CONCLUSIONS OF LAW

14886. The Division of Administrative Hearings has jurisdiction

1496over the parties to, and the subject matter of, these

1506proceedings. Section 766.301, et seq. , Florida Statutes.

15137. The Florida Birth - Related Neurological Injury

1521Compensation Plan was established by the Legislature "for the

1530purpose of providing compensation, irrespective of fault, for

1538birth - related neurological injury claims" relating to births

1547occurring on or after January 1, 1989. Section 766.303(1),

1556Flor ida Statutes.

15598. The injured "infant, his personal representative,

1566parents, dependents, and next of kin," may seek compensation

1575under the Plan by filing a claim for compensation with the

1586Division of Administrative Hearings. Sections 766.302(3),

1592766.303(2 ), 766.305(1), and 766.313, Florida Statutes. The

1600Florida Birth - Related Neurological Injury Compensation

1607Association, which administers the Plan, has "45 days from the

1617date of service of a complete claim . . . in which to file a

1632response to the petition a nd to submit relevant written

1642information relating to the issue of whether the injury is a

1653birth - related neurological injury." Section 766.305(3), Florida

1661Statutes.

16629. If NICA determines that the injury alleged in a claim is

1674a compensable birth - related n eurological injury, it may award

1685compensation to the claimant, provided that the award is approved

1695by the administrative law judge to whom the claim has been

1706assigned. Section 766.305(6), Florida Statutes. If, on the

1714other hand, NICA disputes the claim, as it has in the instant

1726case, the dispute must be resolved by the assigned administrative

1736law judge in accordance with the provisions of C hapter 120,

1747F lorida Statutes. Sections 766.304, 766.307, 766.309, and

1755766.31, F lorida Statutes.

175910. In discharging this responsibility, the administrative

1766law judge must make the following determination based upon the

1776available evidence:

1778(a) Whether the injury claimed is a birth -

1787related neurological injury. If the claimant

1793has demonstrated, to the satisfaction of t he

1801administrative law judge, that the infant has

1808sustained a brain or spinal cord injury

1815caused by oxygen deprivation or mechanical

1821injury and that the infant was thereby

1828rendered permanently and substantially

1832mentally and physically impaired, a

1837rebuttable presumption shall arise that the

1843injury is a birth - related neurological injury

1851as defined in s. 766.303(2).

1856(b) Whether obstetrical services were

1861delivered by a participating physician in the

1868course of labor, delivery, or resuscitation

1874in the immediat e post - delivery period in a

1884hospital; or by a certified nurse midwife in

1892a teaching hospital supervised by a

1898participating physician in the course of

1904labor, delivery, or resuscitation in the

1910immediate post - delivery period in a hospital.

1918Section 766.309( 1), Florida Statutes. An award may be sustained

1928only if the administrative law judge concludes that the "infant

1938has sustained a birth - related neurological injury and that

1948obstetrical services were delivered by a participating physician

1956at birth." Section 766.31(1), Florida Statutes.

196211. Pertinent to this case, "birth - related neurological

1971injury" is defined by Section 766.302(2), Florida Statutes, to

1980mean:

1981. . . injury to the brain or spinal cord of a

1993live infant weighing at least 2,500 grams at

2002birth cau sed by oxygen deprivation or

2009mechanical injury occurring in the course of

2016labor, delivery, or resuscitation in the

2022immediate post - delivery period in a hospital,

2030which renders the infant permanently and

2036substantially mentally and physically

2040impaired. This definition shall apply to

2046live births only and shall not include

2053disability or death caused by genetic or

2060congenital abnormality.

206212. As the claimants, the burden rested on Petitioners to

2072demonstrate entitlement to compensation. Section 766.309(1)(a),

2078F lorida Statutes. See also Balino v. Department of Health and

2089Rehabilitative Services , 348 So. 2d 349, 350 (Fla. 1st DCA 1977),

2100("[T]he burden of proof, apart from statute, is on the party

2112asserting the affirmative issue before an administrative

2119tribunal") .

212213. Here, the proof demonstrated that Jackeline did not

2131suffer an injury to the brain or spinal cord caused by oxygen

2143deprivation or mechanical injury occurring in the course of

2152labor, delivery, or resuscitation that rendered her permanently

2160and substan tially mentally and physically impaired.

2167Consequently, the record developed in this case failed to

2176demonstrate that Jackeline suffered a "birth - related neurological

2185injury," within the meaning of Section 766.302(2), Florida

2193Statutes, and the subject claim is not compensable under the

2203Plan. Sections 766.302(2), 766.309(1), and 766.31(1), Florida

2210Statutes. See also Florida Birth - Related Neurological Injury

2219Compensation Association v. Florida Division of Administrative

2226Hearings , 686 So. 2d 1349 (Fla. 1997).

223314. Where, as here, the administrative law judge determines

2242that ". . . the injury alleged is not a birth - related

2255neurological injury . . . he [is required to] enter an order [to

2268such effect] and . . . cause a copy of such order to be sent

2283immediately to the parties by registered or certified mail."

2292Section 766.309(2), Florida Statutes. Such an order constitutes

2300final agency action subject to appellate court review. Section

2309766.311(1), Florida Statutes.

2312CONCLUSION

2313Based on the foregoing Findings of Fa ct and Conclusions of

2324Law, it is

2327ORDERED that the petition for compensation filed by

2335Luis Casco and Maria Casco, as parents and natural guardians of

2346Jackeline Casco, a minor, be and the same is hereby denied with

2358prejudice.
