105This cause came on to be heard pursuant to Section 766.304,
116Florida Statutes, upon the S tipulation and J oint P etition of
128Petitioners and Respondent, filed November 2, 2001, for the entry
138of an order approving the resolution of a formal claim for
149compensation benefits heretofore filed in this cause in
157accordance with the provisions of Chapter 766, Florida Statutes,
166and a resolution of the exclusive remedy otherwise available as
176outlined in Chapter 766, Florida Statutes. As for the
185Intervenors, they have no objection to the approval of the
195Stipulation and the acceptance of the claim as compensable.
204By the terms of t heir S tipulation, the parties have agreed
216that Petitioners, Ben Walker and Adijah Thompson Walker, are the
226parents and natural guardians of Dasia Q. Thompson (Dasia), a
236deceased minor, as well as co - personal representatives of their
247deceased daughter's est ate; that Dasia was born a live infant on
259March 23, 1997, at Lakeland Regional Medical Center, a hospital
269located in Lakeland, Florida; and that her birth exceeded 2,500
280grams. The parties have further agreed that the physician
289delivering obstetrical serv ices during the birth of Dasia was
299Keith B. Paredes, M.D., and that he was at all times material
311hereto, a "participating physician" in the Florida Birth - Related
321Neurological Injury Compensation Plan, as defined by Section
329766.302(7), Florida Statutes. Fi nally, by their S tipulation, the
339parties have agreed that Dasia suffered a "birth - related
349neurological injury," as that term is defined by Section
358766.302(2), Florida Statutes.
361After due consideration of the interests of all parties, and
371being otherwise fully advised in the premises, it is
380ORDERED that:
3821. The S tipulation of the parties, filed of record
392November 2, 2001, is hereby approved, and the parties are
402directed to comply with the provisions thereof.
4092. Petitioners, Ben Walker and Adijah Thomps on Walker, as
419the parents and natural guardians of Dasia Q. Thompson, are
429accorded a lump sum award of One hundred thousand dollars
439($100,000.00).
4413. Upon payment of the lump sum award of One hundred
452thousand dollars ($100,000.00) to the parents (claimant s),
461attorney's fees and other expenses of Ten thousand seven hundred
471fifty dollars ($10,750.00) incurred in pursuing the subject
480claim, and payment of past expenses, the claims of the
490Petitioners (Claimants) shall be deemed fully satisfied and
498extinguished .
5004. The Division of Administrative Hearings retains
507jurisdiction over this matter to resolve any dispute as to the
518interpretation of any provision of the parties' S tipulation and
528to resolve any disputes, should they arise, regarding the
537parties' compli ance with the terms of such S tipulation.
