162PRELIMIN ARY STATEMENT
165On January 22, 2001, an Administrative Complaint was
173filed by the State of Florida, Department of Health against
183Ghulam Mohammed, M.D., Case Numbers 1999 - 60445 and 2000 - 05509.
195In addition to allegations concerning Patient J.N., the
203Administr ative Complaint alleged impropriety in relation to
211Patient K.C. 1
214When provided an opportunity to elect his rights,
222Respondent disputed the factual allegations in the
229Administrative Complaint and sought a formal hearing. The
237case was forwarded to the Div ision of Administrative Hearings
247to conduct the formal hearing. The hearing took place on the
258dates described.
260In its case, Petitioner presented the testimony of
268Patient J.N., Thomas Hicks, M.D., Geraldine Lundy, R.N.,
276Patient J.N.'s husband, and Patie nt J.F., a "Williams Rule"
286witness. 2 Petitioner's Exhibits 1 and 2 were admitted.
295Respondent testified in his own behalf. Donna Marie

451Consistent with a Pre - hearing Order, the parties
460submitted a Joint Pre - hearing Stipulation. Through that
469submission the parties agreed to admit Joint Exhibits 1
478throug h 4, certain patient records. Joint Exhibits 2 and 4
489were later withdrawn. Joint Exhibits 1 and 3 remain. During
499the hearing the parties agreed to the admission of Joint
509Exhibit 3A. Moreover, the parties stipulated to certain facts
518and Respondent was d eemed by order to have admitted certain
529facts propounded by Petitioner through discovery. Those

603FINDINGS OF FACT
606Stipulated Facts and Admitted Facts :
6121. Petitioner is the state agency charged with
620regulating the practice of medicine pursuant to Section 20.42,
629Florida Statutes, Chapter 456, Florida Statutes and Chapter
637458, Florida Statutes.
6402. Respondent is and has been at all times material
650hereto, a licensed physician in the State of Florida, having
660been issued License No. ME0063587.
6653. Respondent rendered medical care and treatment to
673Patient J.N.
675Add itional Facts :
6794. As of October 15, 1999, Patient J.N. had been
689Respondent's long - standing patient. On that date she came to
700Respondent's office in Perry, Florida, without an appointment.
708Her principal purpose for the visit was to ascertain whether
718she was pregnant. Although J.N. had no appointment, she was
728seen by Wendy Brannen, C.N.A., who worked in Respondent's
737office. Ms. Brannen administered a pregnancy test. The
745results were negative. On the subject of the pregnancy test,
755J.N. had commented to Ms. Brannen that if the results were
766negative from the pregnancy test, that J.N. was interested in
776obtaining diet pills to address weight gain not attributable
785to pregnancy. Her weight on this visit, as confirmed by a
796weigh - in, was not extraordinary.
8025. When Ms. Brannen had concluded her preliminary
810patient work - up concerning J.N.'s blood pressure, pulse,
819respiration and temperature, J.N. was taken to Examining Room
8285 within the office and left there. The door was open to the
841examining room and remained open during the time J.N. was
851there.
8526. On October 15, 1999, Respondent saw J.N. in Examining
862Room 5. While in the room he explained that the results of
874the pregnancy test that had been administered on that day were
885negative. He told J.N. that she was not gaining weight. J.N.
896asked Respondent about diet pills. Respondent told J.N. that
905she did not need diet pills, that she was not over weight. He
918also mentioned an existing moratorium from the Board of
927Medicine on the prescription of diet pills.
9347. Contrary to the allegations in the Administrative
942Complaint, the evidence was insufficient to prove that
950Respondent "pulled J.N. by the arm and started kissing her and
961then took her left hand and pressed it against his penis" or
973that Respondent in any othe r manner engaged in conduct with
984sexual overtones directed to Patient J.N. on the date in
994question. This determination is made having in mind the full
1004hearing record, to include the "Williams Rule" evidence from
1013Patient J.F., who had been under Respondent 's care in the
1024past.
1025CONCLUSIONS OF LAW
10288. The Division of Administrative Hearings has
1035jurisdiction over the subject matter and the parties in this
1045case in accordance with Sections 120.569, 120.57(1), and
1053456.073(5), Florida Statutes.
10569. Through the Adm inistrative Complaint Petitioner
1063accuses Respondent, in Count I, of violating Section
1071458.331(1)(j), Florida Statutes, by exercising influence
1077within a patient - physician relationship for purposes of
1086engaging a patient in sexual activity. Count II to the
1096A dministrative Complaint accuses Respondent of violating the
1104express prohibition against sexual misconduct that is stated
1112in Section 458.329, Florida Statutes, and Rule 64B8 - 9.008,
1122Florida Administrative Code, as violations of those provisions
1130demonstrate a violation of Section 458.331(1)(x), Florida
1137Statutes. Both Counts pertain to Respondent's involvement
1144with Patients K.C. and J.N.
114910. Petitioner bears the burden to prove the allegations
1158made by clear and convincing evidence. Ferris v. Turlington ,
1167510 So. 2d 292 (Fla. 1987). The term clear and convincing
1178evidence is defined in Slomowitz v. Walker , 429 So. 2d 797
1189(Fla. 4th DCA 1983).
119311. Petitioner has failed in its proof. No proof was
1203presented concerning the Patient K.C. The proof concerning
1211th e allegations pertaining to J.N. was not clear and
1221convincing.
1222RECOMMENDATION
1223Upon consideration of the facts found and conclusions of
1232law reached, it is
1236RECOMMENDED:
1237That a final order be entered which dismisses the
1246Administrative Complaint.
