74On December 18, 2001, a Final Order was rendered in the
85abov e - styled case which resolved that the subject claim
96qualified for coverage under the Florida Birth - Related
105Neurological Injury Compensation Plan (Plan), and that the
113participating physician, but not the hospital, complied with the
122notice provisions of the Plan. Left to resolve was how much
133compensation , if any, should be awarded pursuant to Section
142766.31, Florida Statutes.
145That Final Order was duly appealed to the District Court of
156Appeal, Second District, State of Florida, which, by Opinion
165filed April 2 , 2004, resolved that:
171. . . [w]e determine that the ALJ not only
181exceeded his jurisdiction in reaching the
187legal conclusions regarding immunity, but
192also exceeded his jurisdiction in addressing
198the factual issues of notice. We therefore
205reverse the ALJ' s order as to the notice
214issues. In so doing, we certify conflict
221with the Fifth District's opinion in
227O'Leary , 757 So. 2d 624, the Third
234District's opinion in University of Miami v.

329injury, and we remand for the entry of an

346On January 11, 2007, the Supreme Court of Florida rendered
356its opinion in the consolidated case, Florida Birth - Related
366Neurological Injury Compensation Association v. Division of
373Administrative Hearings ( All Children's Hospital ) and Florida
382Birth - Re lated Neurological Injury Compensation Association v.
391Ferguson , 948 So. 2d 705 (Fla. 2007). As for the Ferguson case,
403the Court found the issue raised to be moot, and dismissed the
415petition for review. However, with regard to the All Children's
425Hospital case the Court resolved the conflict question, as
434follows:
435In conclusion, when the issue of whether
442notice was adequately provided pursuant to
448section 766.316 is raised in a NICA claim,
456we conclude that the ALJ has jurisdiction to
464determine whether the hea lth care provider
471complied with the requirements of section
477766.316 . Therefore, we quash the Second
484District's decision in All Children's
489Hospital , and remand for further findings
495consistent with this opinion. We dismiss
501the petition to review Ferguson a s moot.
509On receipt of the Supreme Court's Mandate in Ferguson , the
519District Court of Appeal returned the record to the Division of
530Administrative Hearings (DOAH), and closed its file. Left
538pending before DOAH, was the obligation to conform the ALJ's
548Fina l Order to the opinions of the District Court of Appeal and
561the Supreme Court, and to resolve how much compensation, if any,
572should be awarded pursuant to Section 766.31, Florida Statutes.
581The issue of compensation was addressed by the parties'
590Stipulatio n as to the Amount of the NICA Award, filed
601September 28, 2007.
604Giving due consideration to the Opinion of the District
613Court of Appeal, the Supreme Court's Opinion , and the parties'
623Stipulation, it is
626ORDERED that:
6281. A new sentence is added at the end o f paragraph 31 of
642the Final Order to read, as follows: "Here, the participating
652physician complied with the notice provisions of the Plan, but

6662 . Paragraphs 32 through 3 8 and Endnote 9 of the Final

6823. Paragraph 39 of the Final Order is renumbered paragraph
69232, and amended to read , as follows:
69932. Where, as here, the administrative law
706judge determines that "the infant has
712sustained a birth - related neurological
718injury and that obstetrical services were
724delivered by a participating physician at
730birth," he is required to make a
737determination as to "how much compensation,
743if any, is to be awarded pursuant to s.
752766.31." Section 766.309(1)(c), Florida
756Statutes. In this case, the issues of
763compensability and the amo unt of
769compensation to be awarded were bifurcated.
775Accordingly, absent agreement by the
780parties, a further hearing will be necessary
787to resolve any existing disputes regarding
"793actual expenses," the amount and manner of
800payment of "an award to the parents or
808natural guardians," and the "reasonable
813expenses incurred in connection with the
819filing of the claim." Section 766.31(1),

8274. The "Conclusion" of the Final Order is amended to read,

1061766.31(1)(b), Florida Statutes, to be paid in lump sum, together
1071with past expenses in the sum of Two thousand five hundred four
1083dollars and fifty cents ($2,504.50), pursuant to Section
1092766.31 (1) (a), Florida Statutes. Petitioners are also award ed
1102attorney's fees, including costs, in the sum of Thirty thousand
1112dollars ($30,000.00), pursuant to Section 766.31(1)(c), Florida
1120Statutes, which shall be payable to Goldfarb, & Gold, P.A.,
1130Trust Account.
11327. Upon payment of the award of One hundred thousand
1142dollars ($100,000.00), attorney's fees and other expenses of
1151Thirty thousand dollars $30,000.00), and past expenses of Two
1161thousand five hundred four dollars and fifty cents ($2,504.50),
1171the claims of Petitioners (Claimants) shall be deemed fully

11838. The Division of Administrative Hearings retains
