35This case was remanded to the Division of Administrative
44Hearings by the Florida Commission on Human Relations to conduct
54further evidentiary hearings to determine the amounts of economic
63damages suffered by the Petitioner. The matter was duly set for

138PRELIMINARY STATEMENT
140This case was originally heard on February 5, 6, and 7,
1512002, and the Recommended Order was forwarded to the Florida
161Commission on Human Relations (FCHR or Commission) on April 30,
1712002. The Commission entered its Final Order on March 20, 2003,
182which remanded the matter to the Division of Administrative
191Hearings if the parties were unable to mediate an agreement
201regarding the damages. On June 3, 2004, the FCHR remanded the
212case to the Division of Administrative Hearings.
219On July 14, 2004, the case was set for hearing on August 3,
2322004; however, before the hearing, the parties entered into a
242stipulation regarding the factual matters which the hearing was
251to consider. The parties stipulated that the Division of
260Administrative Hearings may propose and recommend, and the
268Commission may determine and enter, an Amended Final Order
277Awarding Affirmative Relief from an Unlawful Employment Practice"
285to include the precise remedy amounts, damages, attorney's fees,
294and costs to date in the amounts to which the parties stipulated.
306The parties agreed that by entering into their stipulation,
315neither party is prejudiced in its right to file a notice of
327appeal of any Amended Final Order Awarding Affirmative Relief
336from an Unlawful Employment Practice" which the FCHR might
345approve and enter of record. The following Findings of Fact is a
357recitation of the stipulation of the parties.
364FINDINGS OF FACT
3671. The Division of Administrative Hearings may propose and
376recommend, and the Florida Commission on Human Relations may
385determine and enter, an Amended Final Order Awarding Affirmative
394Relief from an Unlawful Employment Practice to include the
403precise remedy amounts, damages, attorneys fees, and costs to
412date in the sums described below.
4182. The parties agree that by entering into their
427Stipulation, neither party is prejudiced in its right to file a
438notice of appeal of any Amended Final Order Awarding Affirmative
448Relief from an Unlawful Employment Practice which the Commission
457may approve and enter of record.
4633. Solely for the purpose of determining the precise remedy
473amounts in this matter so that they may be incorporated in the
485Amended Final Order Awarding Affirmative Relief from an Unlawful
494Employment Practice, the parties agree as follow:
502a. Back pay, benefits, and interest at the statutory
511rate awardable in behalf of Petitioner pursuant to the
520Findings of Fact and Recommendations of the Hearing Officer
529and the February 20, 2003, Final Order Awarding Affirmative
538Relief, total $77,118.47 from April 1996 through July 31,
5492004.
550b. Attorneys fees and out of pocket costs reasonably
559incurred by Petitioner total $38,000 through July 31, 2004.
5694. In consideration of entering into the Stipulation, the
578parties further agree:
581a. Petitioner waives any claim to enhancement of
589prevailing partys attorneys fees for work performed
596through July 31, 2004, but it is acknowledged by the parties
607that Petitioner may and does reserve the right to seek
617enhanced prevailing partys attorneys fees for any
624additional work performed after July 31, 2004, should there
633be subsequent agency or judicial review appeal proceedings.
641b. The Stipulation is solely intended to reflect the
650parties agreement on the back pay, attorneys fees, and
659costs incurred by Petitioner to date and is not in prejudice
670of any legal ground or claim Respondent may seek to raise or
682argue in any subsequent judicial appeal proceedings
689challenging the findings of fact or conclusions of law of
699the Florida Commission on Human Relations.
7055. The Stipulation shall be promptly submitted by the
714parties to the Florida Division of Administrative Hearings and
723the Florida Commission on Human Relations.
729CONCLUSIONS OF LAW
732The Division of Administrative Hearings has jurisdiction to
740enter this Order pursuant to the remand of FCHR and the
751stipulation of the parties.
755RECOMMENDATION
756That the FCHR enter its Amended Final Order Awarding
765Affirmative Relief from an Unlawful Employment Practice" awarding
773the Petitioner the amounts stipulated to by the parties.
