133STATEMENT OF THE ISSUE

137The issue is whether Petitioner, Michael L. Cone, a

146convicted felon, should be placed on the convicted vendor list

156as defined in Section 287.133(1 )2(c), Florida Statutes.

164PRELIMINARY STATEMENT

166This matter began on February 6, 2001, when Respondent,

175Department of Management Services, issued its notice of intent

184to place Petitioner, Michael L. Cone, on the convicted vendor

194list so as to disqualify Petitioner from conducting business

203with the State of Florida.

208Petitioner filed a petition for formal administrative

215hearing on May 5, 2001. The Notice of Hearing was issued

226setting the final hearing for June 11, 2001. Respondent's

235Motion for Continuance, filed May 30, 2001, was granted and an

246Order continuing final hearing until to August 2, 2001, was

256issued June 4, 2001. Respondent's Motion For Sanctions for

265failure to comply with Discovery and, in the Alternative, Motion

275in Limine was filed July 5, 2001, and Petitioner's Response

285thereto was filed July 13, 2001. An Order denying Respondent's

295Motion for Sanctions was issued on July 19, 2001. Department of

306Transportation, on behalf of Ken Morefield, under subpoena for

315deposition, filed a Motion to Quash Subpoena and for Protective

325Order was filed by Steven Ferst on July 24, 2001. An Order for

338the Administrative Law Judge's signature was fax filed. Order

347denying Motion to Quash Subpoena was issued on July 26, 2001.

358On July 31, 2001, Respondent filed its Motion for Sanctions

368against Petitioner for Failure to Comply with Discovery.

376On August 1, 2001, the parties electronically submitted

384their joint "Stipulation for Entry of Final Order" settlement

393agreement (with two attachments) containing extensive stipulated

400facts and incorporating as a part thereof a "plea agreement"

410(attachment #1) with the State of Florida, Department of Legal

420Affairs, Office of the Statewide Prosecution and a "settlement

429agreement" (attachment #2) with the State of Florida, Department

438of Transportation. The purpose of this Final Order is to adopt

449the Stipulated Settlement Agreement (with attachments) as

456required by Section 287.133(3)(e) 2.f, Florida Statutes.

463FINDING OF FACT

4661. As noted above in the Preliminary Statement, the

475parties have entered into a Stipulated Settlement Agreement.

483Their Stipulated Settlement Agreement(with attachments) includes

489the following:

"491STIPULATED FACTS"

4931. Michael L. Cone, at all times pertinent

501to this proceeding and to the conviction

508upon which this proceeding is based, was an

516affiliate of Cone Constructors, Inc., as

522that term is defined in Section 287,133,

530Florida Statutes.

5322. On July 29, 1999, in Case No. 99-13256,

541Michael L. Cone entered a plea of nolo

549contendere and was adjudicated guilty by the

556Circuit Court in and for Hillsborough

562County, Florida, for the following crimes:

568Money Laundering, in violation of Section

574869.101(2)(a), Florida Statutes, a First

579Degree Felony; Unlawful Compensation or

584Reward for Official Behavior, in violation

590of Section 838.016, Florida Statutes, a

596Third Degree Felony; and Felony; and False

603Official Statement, in violation of Section

609837.06, Florida Statutes, a Second Degree

615Misdemeanor.

6163. On July 29, 1999, Michael L. Cone

624entered into a "Plea Agreement" with the

631State of Florida, by and through the Office

639of the Statewide Prosecutor, to resolve the

646charges pending against him in Case No.

65399-13256. As part of this "Plea Agreement,"

660which was adopted and incorporated by

666reference in Michael L. Cone's "Judgement"

672entered on July 29, 1999, and adjudicated

679him guilty, Michael L. Cone agreed that for

687a period of four (4) years from the date of

697the agreement, he would not, nor would any

705company or corporation under his control or

712direction, work nor contract with, nor seek

719to contract, nor act as a material supplier,

727subcontractor or consultant, on any Florida

733Department of Transportation contract or

738project, excluding two projects under

743contract at the time of execution of the

751agreement, so long as those contracts were

758completed within 15 months.

7624. Michael L. Cone and Cone Constructors,

769Inc. ( CCI) entered into a separate

"776Settlement Agreement" on July 29, 1999,

782with the State of Florida, Department of

789Legal Affairs, Office of the Statewide

795Prosecutor and the Florida department of

801Transportation. Under the terms of that

807agreement Michael L. Cone and CCI agreed not

815to contract or seek to contract or act as a

825material supplier, subcontractor or

829consultant with the Florida Department of

835Transportation or the State of Florida for a

843period of four (4) years from the date of

852the agreement.

8545. Michael L. Cone neither admits nor

861denies the underlying charges upon which the

868action is based.

8716. Section 287.132, Florida Statutes,

876provides:

877(2 ) The opportunity to bid on public

885entity contracts or to supply goods and

892services to public entities or to otherwise

899transact business with public entities is a

906privilege, not a right.

910(3 ) In order to preserve the integrity of

919the public contracting and purchasing

924process, the privilege or transacting

929business with public entities should be

935denied to persons involved in certain

941crimes.

942(4 ) Persons involved in certain crimes

949should be denied the privilege of

955transacting business with public entities

960and the opportunity of obtaining economic

966benefit through the transaction of business

972of any kind with public entities.

9787. Pursuant to the definitions and

984procedures set forth in Section 287.133,

990Florida Statutes, and based upon the facts

997set forth in this "Stipulation for Entry of

1005Final Order," Michael L. Cone is subject to

1013placement on the Convicted Vendors List for

1020a period not to exceed one (1) year.

"1028STIPULATED DISPOSITION"

10308. Michael L. Cone agrees that he shall be

1039placed upon the Convicted Vendors List as

1046defined by Section 287.133, Florida

1051Statutes. All restrictions set forth in

1057Section 287.133, Florida Statutes, for

1062persons or entities placed on the Convicted

1069Vendors List shall apply to Michael L. Cone

1077for a period beginning the date that a Final

1086Order is entered accepting this "Stipulation

1092of Entry of Final Order" and ending one

1100calendar year from that date. All

1106restrictions contained in Michael L. Cone's

1112July 29, 1999 "Plea Agreement" and Michael

1119L. Cone and CCI's July 29, 1999 "Settlement

1127Agreement" shall apply to Michael L. Cone

1134for period beginning the date that a Final

1142Order is entered accepting the "Stipulation

1148for Entry of Final Order" and ending on

1156July 30, 2003. Upon completion of the final

1164day Michael L. Cone is to be placed on the

1174Convicted Vendors List, his name shall be

1181removed from the list.

11859. Michael L. Cone shall pay $2,630.48 to

1194the Department of Management Services by

1200cashiers' check or money order no later than

120830 days from entry of the Final Order

1216accepting this "Stipulation for Entry of

1222Final Order".

122510. It is the express intent of Michael L.

1234Cone and the Department of Management

1240Services that Michael L. Cone shall be

1247placed on the Convicted Vendors List for a

1255period of one (1) year beginning from entry

1263of a Final Order accepting this "Stipulation

1270for Entry of Final Order" and ending one

1278calendar year from that date and Michael L.

1286Cone shall be restricted from engaging in

1293any business transaction with any public

1299entity in the State of Florida during that

1307period. Further, where this "Stipulation

1312for Entry of Final Order," relevant

1318statutory provisions and the previously

1323executed agreements conflict, then the most

1329stringent terms and conditions of any of the

1337following shall apply : Section 287.133,

1343Florida Statutes; Michael L. Cone's "Plea

1349Agreement" dated July 29, 1999(a copy of

1356which is attached and incorporated by

1362reference); and Michael L. Cone and CCI's

"1369Settlement Agreement" dated July 29, 1999(a

1375copy attached and incorporated by

1380reference).

138111. Michael L. Cone understands that this

1388proposed "Stipulation for Entry of Final

1394Order" is subject to the approval of the

1402Administrative Law Judge assigned to this

1408cause by the Division of Administrative

1414Hearings and the approval of the Secretary

1421of the Department of Management Services.

1427The terms of this "Stipulation for Entry of

1435Final Order" are made for the purpose of

1443settlement only. Neither the Department nor

1449the Administrative Law Judge is bound by its

1457terms should Michael L. Cone reject or fail

1465to execute this "Stipulation for Entry of

1472Final Order."

147412. Upon entry of a Final Order accepting

1482this "Stipulation for Entry of Final Order"

1489as the proper disposition of this matter

1496Michael L. Cone waives further

1501administrative procedures in the matter and

1507waives all right to seek judicial review of

1515otherwise challenge or contest this

"1520Stipulation for Entry of Final Order" or

1527the "Final Order" entered by the Division of

1535Administrative Hearings adopting this

"1539Stipulation for Entry of Final Order."

154513. Michael L. Cone agrees that any

1552violation of this "Stipulation for Entry of

1559Final Order" shall result in a placement on

1567the Convicted Vendor List for a period of

1575three (3) years from the date of Department

1583of Management Services' notification to him.

158914. Upon entry of a Final Order accepting

1597this "Stipulation for Entry of Final Order"

1604as the proper disposition of this matter

1611Michael L. Cone agrees to bear his own

1619attorneys' fees and costs which may be

1626accrued from defense of this proceeding and

1633waives the right to seek any attorneys' fees

1641or cost from the Department in connection

1648with this proceeding.

165115. Michael L. Cone is executing this

"1658Stipulation for Entry of Final Order" for

1665the purpose of entry of a final order by the

1675Division of Administrative Hearings. In

1680this matter; in furtherance of that purpose,

1687Michael L. Cone authorizes the

1692Administrative Law Judge to review and

1698examine all investigative materials

1702concerning them prior to or in conjunction

1709with consideration of this "Stipulation for

1715Entry of Final Order."

17192. The parties' stipulated settlement agreement(with

1725attachments) constitutes an informal disposition of all issues

1733in this proceeding. Accordingly, the parties have waived their

1742right to a hearing pursuant to Section 120.57(j), Florida

1751Statutes. In light of the stipulated facts and the criteria set

1762forth in Section 287.133(3)(e) .a.-k, Florida Statutes, there are

1771no disputed issues of material fact between Petitioner,

1779Michael L. Cone, and Respondent, Department of Management

1787Services, which would require a formal hearing.

1794CONCLUSIONS OF LAW

17973. The Division of Administrative Hearings has

1804jurisdiction over the parties and the subject matter pursuant to

1814Chapters 120 and 287, Florida Statutes.

18204. Section 120.57(4), Florida Statutes, provides as

1827follows:

1828(4 ) INFORMAL DISPOSITION.- Unless precluded by law,

1836informal disposition may be made of any proceeding

1844by stipulation, agreed settlement, or consent order.

18515. Section 287.133(3)(e )2.f., Florida Statutes, provides

1858as follows:

1860At any time after the filing of the

1868petition, informal disposition may be made

1874pursuant to s.120.57(4). In that event, the

1881administrative law judge shall enter a final

1888order adopting the stipulation, agreed

1893settlement, or consent order.

1897(Emphasis added.)

18996. Here, the parties have informally disposed of all

1908issues by entering into an stipulated settlement(with

1915attachments) and the mandatory nature of the statutory language

1924underscored above requires entry of "a final order adopting the

1934stipulation, agreed settlement, or consent order."

19407. Consistent with the mandate of Section

1947287.133(3)(e )2.f., Florida Statutes, it is hereby ORDERED:

1955That the Stipulated Settlement Agreement(with attachments)

1961of Petitioner, Michael L. Cone, and Respondent, Department of

1970Management Services, is adopted, and Petitioner, Michael L.

1978Cone, shall be placed on the convicted vendor list for one year

1990(365 days) as of the date of this Final Order and all terms,

2003restrictions, and conditions contained in the Stipulated

2010Settlement Agreement shall apply during that period.

2017DONE AND ORDERED this 9th day of August, 2001, in
